SUBJECT: Review of Planning Commission Application No. 2002-001 Submitted by
Speedway SuperAmerica, LLC
A public hearing has been scheduled for Thursday, January 31, 2002, for the Planning
Commission to consider Application No. 2002-001, which is a request by Speedway
SuperAmerica, LLC for a Planned Unit Development (PUD) rezoning and site and building plan
approval for the redevelopment of the SuperAmerica site and adjoining sites located at the
southwest corner of 57th and Logan Avenues North. As a member of the Southeast
Neighborhood Advisory Group, you are invited to attend and participate, if you wish, in this
public hearing.
The property in question is currently zoned C-2 (Commerce) and R-1 (One Family Residence)
and is made up of a portion of the Milavetz law firm property at 1915 57th Avenue North, the
SuperAmerica site at 1901 57th Avenue North and the residential property located at 5649 Logan
Avenue North. The applicant is seeking a Planned Unit Development rezoning with a C-2
(Commerce) underlying zoning. They are seeking the PUD designation to provide modifications
to the typical requirements that would allow them to better utilize the site. They propose to make
exceptions to allow a gasoline station to abut R-1 zoned property, also allow a building
encroachment into a 35 ft. buffer area where the property would abut with 5633 Logan Avenue
North and also to have a less than 15 ft. green strip along the 57th Avenue North right of way
line. All of these modifications from the general C-2 standards, they believe, are justified on the
basis of the development being an appropriate redevelopment and that these items are offset, or
mitigated, by various factors contained in their proposed site plan.
Normally rezoning applications considered by the Planning Commission are referred to the
respective Neighborhood Advisory Group. Your group has in the past met on a few occasions to
review such proposals. Recently, State Statutes have been amended to require cities to respond
to rezoning requests within 60 days of the date a properly submitted application has been filed
with the City. If no action is taken by the City Council within that time frame, the application is

considered to be approved. Our city ordinances require publication and a legal notice sent to
surrounding properly owners for rezoning applications, which require submission of a rezoning
application at least four weeks in advance of the Planning Commission’s public hearing. Almost
half of the State required 60 day time frame has been used up before the Planning Commission’s
public hearing is even held. This requirement makes it almost impossible for the City to hold the
Neighborhood Advisory Group meetings we normally have and also meet this time requirement.
The Planning Commission has instituted a new procedure because it still wishes to receive
Neighborhood Advisory Group input with respect to these rezoning applications. We now invite
Neighborhood Advisory Group members to the public hearing and encourage their participation
and comment. Enclosed with this memo is a copy of the staff report for this application along
with a staff report for Planning Commission Application No. 2002-002 which is a replatting of
the property under consideration. Hopefully you will have an opportunity to review these
matters and participate in the public hearing, which is set for January 31, 2002, at 7:30 p.m. This
public hearing will be held at the City’s West Fire Station, which is located at 6250 Brooklyn
Boulevard (the southeast corner of 63rd Avenue North and Brooklyn Boulevard).
I am also aware that you were invited and attended a neighborhood meeting held by
SuperAmerica at the Earle Brown Elementary School in early December of 2001. Again, I hope
you are able to attend the Planning Commission meeting and offer your comments for
consideration.
