Warren, Planning Commission Secretary DATE: October 19, 2005 SUBJECT: Review of Planning Commission Application No. 2005-015 Submitted by The Luther Company Limited Partnership A public hearing has been scheduled on Thursday, October 27, 2005, for the Planning Commission to consider Application No. 2005-015. This application is a request by The Luther Company Limited Partnership for a Planned Unit Development Rezoning from C-2 (Commerce) to PUD/C-2 (Planned Unit Development) and a development plan approval for a two phased redevelopment and expansion of the Brookdale Dodge automobile dealership at 6800 Brooklyn Boulevard and the former Ryan Olds property at 6700 Brooklyn Boulevard. As a member of the Northwest Neighborhood Advisory Group, you are invited to attend and participate in this public hearing, if you wish. The Luther Company has acquired all the automobile dealership property on the easterly side of th Brooklyn Boulevard between I-94 and 69 Avenue North. Their plan under the first phase is to expand the Brookdale Dodge operation showroom/service building and also expand their Dodge th Truck Center into a remodeled building at 4215 69 Avenue North that has served as an accessory parking and detailing operation. Also proposed under the first phase is the demolition of all of the former Ryan Olds buildings at 6700 Brooklyn Boulevard. Phase two, which would be considered later under a Planned Unit Development Amendment, would be the redevelopment of this site as a new Luther Company Automobile Dealership. Normally rezoning applications considered by the Planning Commission are referred to the respective Neighborhood Advisory Group. Your group has met on a few occasions to review such proposals. Recently, State Statutes have been amended to require cities to respond to zoning requests within 60 days of the date a properly submitted application has been filed with the City. If no action is taken by the City Council within that time frame, the application is considered to be approved. Our ordinances require publication and a legal notice sent to surrounding properly owners for rezoning applications, which require submission of a rezoning application at least four weeks in advance of the Planning Commission’s public hearing. Almost Northwest Neighborhood Advisory Group Page 1 half of the State required 60 day time frame has been used up before the Planning Commission’s public hearing is even held. This requirement makes it almost impossible for the City to hold the Neighborhood Advisory Group meetings we normally have and also meet this time requirement. The Planning Commission, however, still wishes to receive Neighborhood Advisory Group input with respect to these rezoning applications. We now invite Neighborhood Advisory Group members to the public hearing and encourage their participation and comment. A staff report for this application will be completed no later than Tuesday, October 25, 2005, and it will be delivered to you for review. This memo is sent to you with a copy of the notice of public hearing, which is attached, and to let you know that further information will be provided.
