called to order by President Myrna Kragness at 8 p.m.

Subject: Resolution Requesting Hennepin County Housing and Redevelopment Authority
to Operate the Minnesota Housing Finance Agency Community Fix -Up Fund
Loan Program in the City of Brooklyn Center
On September 9, 1996, the Brooklyn Center City Council passed Resolution No. 96 -172, a
Resolution Approving Hennepin County Application to the Minnesota Housing Finance
Agency for Community Fix -Up Fund. This resolution essentially supported the County's
application to the Minnesota Housing Finance Agency (MHFA) to provide loans under the
MHFA's Community Fix -Up Fund loan program.
As noted at the time of approval of Resolution No. 96 -172, the benefit to the City would be
the availability of additional state funds to provide loans for home remodeling and
rehabilitation in the city of Brooklyn Center with no direct cost to the City, other than staff
time assisting Hennepin County with marketing the program in the city's southeast
neighborhood, which is the target area for the loan program.
The Community Fix -Up Fund does not provide a specific dollar amount of funding to the City,
but there will be approximately $10,000,000 available in the total Community Fix -Up Fund
program, with approximately $5,000,000 set aside for Anoka, Carver, Chisago, Dakota,
Hennepin, Isanti, Ramsey, Scott, Sherburne, Washington and Wright counties. The funds are
available to designated communities in the counties as long as there are funds in the pool. The
targeted communities for Hennepin County would be Brooklyn Center and Brooklyn Park.
Hennepin County would market the program and originate the loans. Borrowers could earn up
to $62,790 in household income and qualify for a loan of up to $25,000 at interest rates of 2-
8 %, depending on income. The maximum loan term would be 20 years.
Loan funds can be used in single- family through fourplex properties. The funds can be used
for a wide variety of home repair and remodeling projects, including most room additions,
alterations, renovations and repairs, including insulation, furnaces, wiring, plumbing,
painting, roofing, and remodeling of kitchens and bathrooms.
In addition to Council Resolution No. 96 -172, the Hennepin County Attorney's Office has
requested an additional resolution to be passed by the City's Economic Development
• Authority. The reason for this request is that Minnesota Statutes states that if a city HRA
requests the Hennepin County Housing and Redevelopment Authority (HCHRA) to exercise a

power, the HCHRA may do so. Since the Brooklyn Center EDA includes all authority
granted under State statute to an HRA, the resolution in Brooklyn Center would be passed by
the EDA rather than an HRA resolution. It is the County Attorney's opinion that a resolution
requesting the HCHRA to operate the Community Fix -Up Fund program in the City of
Brooklyn Center by the EDA is required for the HCHRA to operate the loan program within a
city. The County Attorney has requested a resolution by the EDA requesting the HCHRA
operate the MHFA Community Fix -Up Fund loan program within the city of Brooklyn Center.
A resolution addressing the County Attorney's request is included with this memorandum.

PROGRAM IN THE CITY OF BROOKLYN CENTER
WHEREAS, the Community Fix -Up Fund is a loan program offered by the
Minnesota Housing Finance Agency (MHFA) to provide home rehabilitation and remodeling loans
to qualified single - family through four -unit residential properties; and
WHEREAS, Hennepin County Housing and Redevelopment Authority has applied
to the MHFA to participate in the Community Fix -Up Fund and has offered to provide the
program in the city of Brooklyn Center; and
WHEREAS, the County Housing and Redevelopment Authority's participation in
the Community Fix -Up Fund would provide needed home rehabilitation funds to residents of the
city of Brooklyn Center; and
• WHEREAS, in order for the Hennepin County Housing and Redevelopment
Authority to offer Brooklyn Center residents rehabilitation loans under the Community Fix -Up
Fund, the Brooklyn Center Economic Development Authority (EDA) must request that the
Hennepin County Housing and Redevelopment Authority operate the MHFA Community Fix -Up
Fund loan program within its boundaries and specifically targeting the city's southeast
neighborhood; and
WHEREAS, based on the current waiting list for the Community Development
Block Grant loan program, it appears the city's southeast neighborhood has a significant need for
home rehabilitation funds; and
WHEREAS, the Brooklyn Center EDA supports Hennepin County Housing and
Redevelopment Authority's efforts in providing additional home rehabilitation opportunities to
Brooklyn Center residents in the city's southeast neighborhood.
NOW, THEREFORE, BE IT RESOLVED by the Economic Development
Authority in and for the City of Brooklyn Center, Minnesota, as follows:
1. The EDA supports Hennepin County Housing and Redevelopment Authority's
application to the Minnesota Housing Finance Agency for the Community Fix-
Up Fund program.

Amending EDA Resolution No. 91 -33, a Resolution Establishing Endowment
Account and Authorizing Certain Housing Activities and Programs be Undertaken
by the Economic Development Authority in and for the City of Brooklyn Center
The City Council approved the 53rd Avenue Development and Linkage Project by passing
Resolution No. 96 -207, which reprogrammed 1996 Urban Hennepin County Community
Development Block Grant funds from scattered site redevelopment project to the 53rd Avenue
Development and Linkage Project. The EDA has traditionally been the implementing agency
for Community Development Block Grant (CDBG) projects and activities and redevelopment
projects and activities. If the City Council wishes to continue that role for the EDA, the
attached resolution would request the EDA to approve the project budget and take additional
actions to begin implementing the 53rd Avenue Development and Linkage Project.
In 1991, the EDA assed Resolution No. 91 -33 see attached which was a companion

resolution to City Council Resolution No. 91 -277. Both resolutions addressed the transfer of
$1,000,000 to the EDA for an endowment fund restricting expenditures to the earnings from
the principal balance in the fund. Resolution No. 91 -33 also addressed the types of activities
and projects on which the EDA could expend funds. The attached Resolution No. 91 -33
describes these activities which include activities authorized by Minnesota Statutes Section
469.012, Subd. 1, Clause (7), which primarily addresses the acquisition, demolition, and
construction of buildings and improvements on real property.
In order to access the endowment account principal balance for the 53rd Avenue Development
and Linkage Project, the EDA should amend Resolution No. 91 -33. A proposed resolution
amending Resolution No. 91 -33 is included with this memorandum. The amended resolution
adds eligible activities on which the EDA may expend endowment account funds to activities
authorized under Minnesota Statutes Section 469.012, Subd. 1, which includes the schedule of
powers of the EDA authorized by statute.
As the implementing body for the 53rd Avenue Development and Linkage Project, the
resolution would also approve a project budget amount of $3.2 million.

Authority in and for the City of Brooklyn Center, Minnesota, as follows:
1. EDA Resolution No. 91 -33 is hereby amended as follows:
a. The fourth paragraph of EDA Resolution No. 91 -33 is amended to read:
"NOW, THEREFORE, BE IT RESOLVED, by the Economic
Development Authority in and for the City of Brooklyn Center that the
funds received from the above - described transfer of funds be deposited in
an endowment account and that the deposited funds may be used by the
EDA for the housing activities and programs described in this resolution."
b. Following paragraph (d) on the second page of EDA Resolution No. 91-
33, the following paragraph shall be added: "e. Expenditures authorized
under Minnesota Statutes, Section 469.012, Subdivision 1, may be
undertaken by the Brooklyn Center Economic Development Authority

Subject: Resolution Approving Request for Proposal for Acquisition and Relocation Services
for the 53rd Avenue Development and Linkage Project and Authorizing Staff to
Solicit Proposals
The attached Request for Proposal would provide for acquisition and relocation services for
the 53rd Avenue Development and Linkage Project. The resolution included with this
memorandum would provide for approval of the Request for Proposal by the EDA Board and
would authorize staff to solicit proposals for acquisition and relocation services. The RFP is
based on one that was used by the City for acquisition and relocation in conjunction with the
construction of the Park & Ride facility on Brooklyn Boulevard.
Budget estimates for acquisition relocation services are as follows:

REQUEST FOR PROPOSAL
ACQUISITION AND RELOCATION SERVICES FOR THE
53RD AVENUE DEVELOPMENT AND LINKAGE PROJECT
A. INTRODUCTION
The City of Brooklyn Center has approved the 53rd Avenue Development and Linkage Project
which will involve the acquisition of up to 26 properties in the city's southeast neighborhood.
Exhibit A shows the project location map and Exhibit B lists the properties to be acquired as
part of this project, along with a property data sheet for each property. An information brochure
distributed at a September 12, 1996, meeting with persons in the project area is also included
to provide background information on the project.
The city's Economic Development Authority, whose Board of Commissioners is the Brooklyn
Center Citv Council, will implement the project and the contract for services will be executed
with the Brooklyn Center Economic Development Authority.
B. DESCRIPTION OF REQUESTED SERVICES
It is the intent of the Brooklyn Center EDA to select a qualified acquisition/relocation
consultant to provide the following services. All services shall be performed in conformance
with the Uniform Relocation Act (Federal Regulations 49 CFR, Part 24). Additionally, since
Community Development Block Grant (CDBG) funds will be used to fund a major portion of
the project, all acquisition and relocation services must comply with the requirements and
procedures set forth in the Housing and Community Development Act of 1974, as amended.
C. ACQUISITION OF REAL PROPERTY SERVICES AND PROCESS
1. Develop an acquisition file for each parcel of property to include written correspondence,
title information, appraisals, contracts, parcel tax information, etc. Such file shall also
include documentation of all verbal and written communications with the property owner(s).
2. Conduct a title search to identify owners based on information received from owners and
information available in public records. Note: This contractor is not required to obtain a
certificate of title since this will be obtained by the City Attorney prior to closing.
3. Prepare "Just Compensation Offer" (Initial Offer of Sale and Summary Statement of the
Basis of Just Compensation with Receipt) and submit to EDA Executive Director for
signature by him or his designee.
• 4. Conduct and document acquisition negotiations with each property owner. The extent of
such negotiations shall be in full compliance with applicable laws, rules and regulations.
• 5. If an agreement for acquisition of a parcel of property is reached, submit an executed
purchase agreement to the City Attorney, together with title search information, including
copies of abstracts or torrens certificates which have been obtained, and other information
required by the City Attorney.
D. RELOCATION PROCESS
1. Develop a relocation assistance file relating to each parcel of property to include
information needed to determine the eligibility of property owners, residents, and tenants
for relocation assistance. Such files shall also include documentation regarding verbal or
written communications with such person(s), documentation regarding determination of
eligibility, and documentation regarding determination of relocation assistance benefits
provided.
2. Prepare and send notices of relocation eligibility and information brochures.
3. Conduct necessary investigations to identify persons eligible to receive relocation assistance
and the type and level of relocation assistance required for each person. Two copies of a
report summarizing these findings, for each parcel of property, shall be submitted to the
Brooklyn Center Economic . Development Authority.

4. Prepare a relocation assistance offer for each person eligible to receive such assistance.
• Such offer shall be based on the minimum level of assistance determined to be required by
law. All such offer letters shall be submitted to the EDA Executive Director for signature
by him or his designee.
5. If the issuance of "Notices to Vacate" becomes necessary, such notices shall be prepared
and submitted to the EDA Executive Director for signature by him or his designee.
6. Prepare relocation claims with recommendations for payment of eligible costs.
7. Conduct and document all relocation assistance activities. The extent of such activities shall
be in full compliance with applicable laws, rules, and regulations. Close out and maintain
files and make available for monitoring as necessary.
E. SERVICES TO BE PROVIDED BY OTHERS
The following services will be provided by the City Attorney:
1. - Secure an updated abstract or torrens certificate at a time prior to closing or initiation of
eminent domain proceedings.
2. Conduct the closings on all negotiated purchases.
• 3. Eminent domain proceedings, if required. Note: In the event eminent domain proceedings
are required, the City Attorney may require this contractor's participation in the process.

F. DESCRIPTION OF REQUIRED EXPERIENCE
Each firm submitting proposal for g p p these services shall submit documentation of its experience
in the following areas:
1. Experience and capacity to perform all acquisition and relocation processes as defined
above, in full conformance with all federal and state rules and regulations, specifically
including federal regulation 49 CFR, Part 24. Note: Experience with the application of 49
CFR, Part 24, is considered mandatory.
2. Experience in performing such services specifically relating to acquisition of single - family
homes and apartments.
3. Experience in working with governmental agencies, specifically including cities in the State
of Minnesota. Provide a list of at least six recent clients with names of their contact
persons, addresses, and telephone numbers.
4. Demonstration of ability to meet schedules and deadlines without cost escalation or
overruns.
G. SUBMISSION OF PROPOSALS
Consultants desiring to be considered for this work shall submit a proposal in two parts, i.e.:
1. "Envelope A"
a. Cover letter. This should include the name and address of the lead consultant and the
names of other firms or individuals participating in the proposal.
b. Description of the firm(s), including staff size and classification of personnel.
c. A statement of the proposer's understanding of the project and project objectives.
d. Client references (as described above), especially including for similar work performed
during the past three years.
e. Qualifications of the key personnel to be assigned to the various elements of this
project, i.e., appraisals, review appraisals, acquisition negotiations, and relocation
assistance.
f. A description of the proposer's approach to the processes which will be followed to
assure compliance with these specifications, and all state and federal laws, rules, and
regulations.
• g. If the firm submitting the proposal will be utilizing the services of other firms to provide
some of the required services, provide a list of projects on which this "team" has worked

2. "Envelope B"
This document shall contain a cost proposal to provide the services required by this
document, utilizing the following format:
a. Provide a listing of all key personnel who will be assigned to work on this project,
listing their names and compensation schedule, and the basis on which their services
will be charged to the project.
b. Consultants shall submit a total not -to- exceed price for all acquisition and relocation
services in accordance with the requirements specified in this Request for Proposal for
the properties described in Exhibit B.
c. In addition to a total not -to- exceed price for the acquisition and relocation services, the
consultant shall provide a breakdown of the total not -to- exceed price as described by the
following:
Acquisition Services
i. Per single - family residential property: $
ii. Per multi - family property: $
Residential Relocation Services
i. Per homeowner: $
ii. Per tenant: $
Note: This not -to- exceed amount shall not include (1) the costs for updating appraisal(s)
if directed by the City Attorney due to passage of time; and/or (2) participation in
eminent domain proceedings, if required by the City Attorney.
d. Consultants shall provide an hourly rate compensation schedule for services in the event
the consultant's participation is needed in any eminent domain proceedings.
H. CONSULTANT SELECTION PROCESS
Selection of a contractor to provide these services will proceed as follows:
1. Step A. A selection committee will first open, review, and evaluate all Statements of
Qualification contained in all "Envelope A's" and will rank all proposers on the basis of
their evaluation of the information contained in those envelopes. Upon completion of that
process, the selection committee will open, review, and evaluate the proposals contained
in all `'Envelope B's" and submit a recommendation to the Brooklyn Center EDA based on
• its evaluation of which proposal best serves the needs of the City of Brooklyn Center.

2. Step B. The final selection of a consultant and award of a contract will be considered by
the Brooklyn Center EDA, with consideration of the recommendations of the selection
committee. The Brooklyn Center EDA reserves the right to reject any or all proposals for
these services.
I. SCHEDULE
1. Each proposer shall submit three complete sets of sealed envelopes, clearly marked on the
outside as "Envelope A" and "Envelope B ", and with the name and address of the firm
submitting the proposal. All six envelopes shall be submitted in a sealed larger envelope
marked "53rd Avenue Development and Linkage Project ".
2. It is anticipated that the Consultant Selection Committee will complete its review of all
proposals and forward its recommendation to the EDA on November 25, 1996, and that the
EDA will consider the matter at its November 25, 1996 meeting.
3. If a contract for these services is awarded, a Notice to Proceed will be issued to the
contractor within 10 days of the award.
4. Upon receipt of a Notice to Proceed, the contractor shall stand ready to start providing
required services. Priority consideration shall be accorded those property owners, residents,
and tenants who request the City to proceed on a "fast track" basis.
5. The City's goal is to complete acquisition of all ro erties i.e., execution of closing

6. All proposals must be received at Brooklyn Center City Hall no later than 4:30 p.m. on

EDA RESOLUTION NO.
RESOLUTION APPROVING REQUEST FOR PROPOSAL FOR ACQUISITION
AND RELOCATION SERVICES FOR THE 53RD AVENUE DEVELOPMENT
AND LINKAGE PROJECT AND AUTHORIZING STAFF TO SOLICIT
PROPOSALS
WHEREAS, the City Council has approved the 53rd Avenue Development and
Linkage Project and has designated the Economic Development Authority in and for the City of
Brooklyn Center to implement the project activities; and
WHEREAS, the Economic Development Authority has approved a project budget
for the 53rd Avenue Development and Linkage Project; and
WHEREAS, the project will require the acquisition of 26 parcels of land; and
WHEREAS, the Executive Director has recommended the EDA hire a land services
consultant and a relocation consultant to provide acquisition and relocation services for the owners
of said properties; and
WHEREAS, a Request for Proposal for acquisition and relocation services for the
53rd Avenue Development and Linkage Project has been prepared by staff.
NOW, THEREFORE, BE IT RESOLVED by the Economic Development
Authority in and for the City of Brooklyn Center, Minnesota, that:
1. The Request for Proposal for acquisition and relocation services for the 53rd
Avenue Development and Linkage Project is hereby approved.
2. EDA staff is hereby authorized to solicit proposals from qualified land services
and relocation services consultants.

James M. Klas, Senior Vice President, will attend the EDA meeting to discuss with the EDA
Board of Directors the direction you would like to see taken in updating their previous study of
the Earle Brown Heritage Center and other information in order to be able to provide the
EDA/Council with an understanding of the operations and issues. Mr. Klas, based on the
information received from the EDA Board/Council, will then prepare a scope of services
proposal for your consideration at the November 12th meeting.
I would suggest the following potential items for inclusion in Marquette Advisors work:
- update their 1993 report
- prior recommendations implemented
- prior recommendation yet to be implemented
- new recommendations
- evaluate operational organization
- identify and quantify options for operations and organization
- work sessions with EDA board/council
- to familiarize EDA with study and operations
- identify additional information/study desired by EDA
- insure that direction taken meets needs of EDA
- evaluate general level of hospitality industry development
- review /analyze any synergy between EBHC and hotels, restaurants, etc.
- review /analyze market/implications of additional hospitality development in
Brooklyn Center such as additional hotels and restaurants
