There will be no separate discussion of these items unless a Commissioner so requests, in which event the item will be removed from the consent agenda and considered at the end of Commission Consideration Items. a. Approval of Minutes - Commissioners not present at meetings will be recorded as abstaining from the vote on the minutes. 1. April 8, 1996 - Regular Session 4. Commission Consideration Items • a. Resolution Providing for a Public Hearing Regarding the Sale of Land by the Economic Development Authority in and for the City of Brooklyn Center and Authorizing the Executive Director to Negotiate a Purchase Agreement for the Sale of Such Land Located at 5449 Emerson Avenue North in Brooklyn Center • Requested Commission Action: -Adopt resolution. 5. Adjournment MINUTES OF THE PROCEEDINGS OF THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA REGULAR SESSION APRIL 8, 1996 CITY HALL CALL TO ORDER The Brooklyn Center Economic Development Authority (EDA) met in regular session and was called to order by President Myrna Kragness at 7:36 p.m. ROLL CALL President Myrna Kragness, Commissioners Kathleen Carmody, Debra Hilstrom, Kristen Mann, and Charles F. Nichols, Sr. Also present were Executive Director Michael J. McCauley, EDA Secretary Brad Hoffman, Director of Public Services Diane Spector, Assistant City Manager \Personnel Coordinator Nancy Gohman, City Attorney Charlie LeFevere, and Council Secretary Carla Wirth. APPROVAL OF AGENDA AND CONSENT AGENDA A motion by Commissioner Mann and seconded by Commissioner Hilstrom to approve the April 8, 1996, agenda and consent agenda passed unanimously. APPROVAL OF MINUTES A motion by Commissioner Mann and seconded by Commissioner Hilstrom to approve minutes of the March 25, 1996, regular session as printed passed unanimously. COMMISSION CONSIDERATION ITEMS RESOLUTION NO. 96 -13 Commissioner Debra Hilstrom introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING SUBMISSION OF BID TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT TO PURCHASE THE SINGLE - FAMILY PROPERTY LOCATED AT 6645 BRYANT AVENUE NORTH IN BROOKLYN CENTER The motion for the adoption of the foregoing resolution was duly seconded by Kristen Mann and passed unanimously. ADJOURNMENT A motion by Commissioner Nichols and seconded by Commissioner Carmody to adjourn the meeting at 7:40 p.m. passed unanimously. Resolution Providing for a Public Hearing Regarding the Sale of Land by the Economic Development Authority in and for the City of Brooklyn Center and Authorizing the Executive Director to Negotiate a Purchase Agreement for the Sale of Such Land Located at 5449 Emerson Avenue North in Brooklyn Center The property at 5449 Emerson was acquired by the Brooklyn Center EDA in 1991. At that time, the property was occupied by a single - family home that was arguably one of the most deteriorated properties in the City of Brooklyn Center at the time. The City acquired the property and cleared the lot of the single - family home. The lot is approximately 5,120 square feet with dimensions of 40'x 128' on average. Because of the small size of the lot it has been one of the more difficult to redevelop. However, it is a lot of record and is buildable. Staff has recently received a proposal from Howard Bohanon Homes, Inc., to purchase and redevelop the lot at 5449 Emerson Avenue North with a new single - family property. The assessing staff has determined a value range of the property between $13,600 and $17,000. Howard Bohanon Homes, Inc., is offering $15,000 for the lot. This is the same contractor who built the new home on the EDA lot at 6601 Bryant Avenue North. This lot was not acquired with Community Development Block Grant (CDBG) funds, so 100% of the sale proceeds can be retained by the Brooklyn Center EDA. Howard Bohanon Homes, Inc., has submitted building plans for the home to be constructed on the lot, copies of which are included with this memorandum. Additionally, Howard Bohanon Homes, Inc., has specified the types of materials to be used in construction of the home which include the following: ► exterior siding - vinyl ► soffit - vinyl ► fascia - vinyl ► front door - metal insulated ► windows - vinyl thermopane ► garage door - metal raised panel ► landscaping - sod and grading The price of the home will be $92,000, and first -time home buyer mortgage funds have been • Memorandum to Michael J. State law requires a public hearing to be held on the terms and conditions of the sale of land by the EDA prior to the sale of the property. The resolution before the EDA this evening would authorize and set a public hearing for May 13, 1996, on the terms and conditions of the sale of the property to Howard Bohanon Homes, Inc., and would also authorize the Executive Director to negotiate a purchase agreement for the property which would be presented for EDA consideration after completion of the public hearing to be held on May 13, 1996. State law does not require it, but staff recommends mailing a public hearing notice on the sale of this property to surrounding property owners given the lot size of the property and also the length of time the property has remained vacant. Staff has also requested Mr. Howard Bohanon, President of Howard Bohanon Homes, Inc., to be present at the April 22 EDA meeting to review his building plans and proposal for construction of a single - family home on the lot at 5449 Emerson Avenue North. • Commissioner introduced the following resolution and moved its adoption: EDA RESOLUTION NO. RESOLUTION PROVIDING BEARING G OR A PUBLIC HE G REGARDING THE SALE OF LAND BY THE ECONOMIC DEVELOPMENT AUTHORITY IN AND FOR THE CITY OF BROOKLYN CENTER AND AUTHORIZING THE EXECUTIVE DIRECTOR TO NEGOTIATE A PURCHASE AGREEMENT FOR THE SALE OF SUCH LAND LOCATED AT 5449 EMERSON AVENUE NORTH IN BROOKLYN CENTER WHEREAS, the Economic Development Authority in and for the City of Brooklyn Center (EDA) has received an offer to purchase the EDA -owned property located at 5449 Emerson Avenue North (the "Property"); and WHEREAS, Minnesota Statutes, Section 469.029, Subd. 2, requires a public hearing for the sale of land by the Brooklyn Center Economic Development Authority; and WHEREAS, the Brooklyn Center Economic Development Authority has received an offer from Howard Bohanon Homes, Inc., for the purchase of the EDA -owned land at 5449 Emerson Avenue North and described by the following legal description: Lot 3 Block 2 ' o , N and E Perkin s Addition to Minneapolis, according to the plat thereof on file and of record in the Office of the County Recorder in and for the County of Hennepin, State of Minnesota; and WHEREAS, the EDA ; staff has reviewed the proposal from Howard Bohanon Homes, Inc., and has recommended the EDA Board hold a public hearing on the offer and authorize the EDA Executive Director to negotiate a purchase agreement with Howard Bohanon Homes, Inc., for the purchase of the property. i NOW, THEREFORE, BE IT RESOLVED by the Economic Development Authority in and for the City of Brooklyn Center that it has determined it is in the best interest of the City of Brooklyn Center to authorize the EDA Executive Director to negotiate a purchase agreement for the sale of the property to Howard Bohanon Homes, Inc., the terms of such purchase agreement to be subject to the further review and acceptance by the EDA. BE IT FURTHER RESOLVED that the Brooklyn Center Economic Development Authority hereby authorizes a public hearing to be held on May 13, 1996, at 7:00 P.M. or as soon thereafter as the matter may be heard in the Brooklyn Center City Hall Council Chambers regarding the proposed sale of property described herein to Howard Bohanon Homes, Inc., and the provisions of such sale. • EDA RESOLUTION NO. • BE IT FURTHER RESOLVED that the Executive Director is hereby authorized and directed to publish the attached notice of public hearing in the City's legal newspaper on May 1, 1996.
