The Council should be at City Hall at 8:00 a.m.; interviews will begin at 9 a.m. All interviews are scheduled for 1 hour. What interests you about this position? 2. Discuss your past experience with City Councils, commissions, community groups and citizens. 3. Tell us about your team building, organizational development and goal setting skills. 4. What actions would you take in the first week should you join our City? If you feel changes are necessary, how would you go about making those changes? • 5. Describe your experience with capital improvement programs and/or bond issues. 6. Have you been involved in any redevelopment and housing activities? If so, please describe. 7. How do you deal with processing or forwarding complaints the City receives to ensure the complaints are addressed and resolved. 8. MEMORANDUM • TO: Mayor Myrna Kragness Councilmember Kathleen Carmody Councilmember Debra Hilstrom Councilmember Barbara Kalligher Councilmember Kristen Mann FROM: Cam Andre, Interim City Manager C DATE: November 16, 1995 SUBJECT: Suggested Selection Methods for City Manager Candidates There are a number of methods that could be used in coming to consensus in selection of a candidate. Listed below are several suggested methods to assist in making such a decision. 1. RANKING 1 - 5 In this method, after interviews are complete, each member of the Council will rank each candidate 1,2,3,4,5; with number 1 being the highest or top • selection; number 5 being the lowest. Each number can only be used once. All Council rankings of each candidate will be forwarded to the Interim City Manager to tally. Once the scores are combined that candidate with the overall lowest score is the candidate to consider as City Manager. If the Council desires, the Council may want to eliminate any candidate which scored a 5, to eliminate the selection of a candidate who scored the lowest by any one member of our Council. 2. STRIKE OR VETO PROCESS In this method, each member of the Council has one vote each to veto one candidate; this vote of veto occurs after interviews are complete. The candidates remaining after the veto or striking process will be further considered as a City Manager candidate. Either method can be used to secure consensus in the selection of a City Manager. Finally, it is important that any offer be made contingent on a complete and acceptable background check to be completed by our Police Department. • Employment Agreement For City Manager THIS AGREEMENT, made and entered into this of 1995 by and between the City of Brooklyn Center, State of Minnesota, a Minnesota municipal corporation ( "Employer ") and ("Employee")- WITNESSETH: WHEREAS, Employer desires to employ the service of Employee as City Manager of the City of Brooklyn Center; and WHEREAS, it is the desire of the City Council to provide certain benefits, to establish certain conditions of employment, and to set working conditions of the Employee. NOW, THEREF in consideration of the mutual covenants contained in this agreement, Employer and Employee agree as follows: • Section 1. Duties. Employer agrees to employ Employee as City Manager to perform the functions and duties specified in the Charter of the City and the City Code and to perform other legally permissible and proper duties and functions as the City Council of the City may from time -to -time assign to Employee. Section 2. Term. A. Employee's employment shall commence on , 1995. B. Nothing in this agreement prevents, limits, or otherwise interferes with the right of the City Council of the City to terminate the services of Employee at any time, subject only to the provisions set forth in Section 3 of this Agreement. C. Nothing in this agreement prevents, limits, or otherwise interferes with the right of the Employee to resign at any time, subject only to the provisions of Section 3 of this agreement. D. Employee agrees to remain in the exclusive employ of the Employer and neither to accept other employment nor to become employed by any other employer during the • term of his employment. -1- The term "employed" is not construed to include occasional teaching, writing, consulting, or military reserve service performed on Employee's time off. Section 3. Termination. A. Employee may be terminated by the City Council at any time, and for any reason in the absolute and sole discretion of the City Council, upon not less than thirty (30) days' written notice to Employee. If the Employee is discharged during such time that the Employee is willing and able to perform the duties of City Manager, the City shall pay the Employee a lump sum cash payment equal to aggregate salary; provided that, if the Employee is discharged because of a conviction for any illegal act involving personal gain, gross misconduct, or failure to perform statutory duties, the Employee shall not be entitled to any lump sum payments whatsoever. B. Employee may resign from his position at any time upon not less than thirty (30) days' advance notice to the City Council, unless such thirty (30) days' notice is waived by the Council. C. Upon termination, Employer will pay Employee salary through the effective date of termination. Section 4. Salary. Employee's salary for the term of this Agreement shall be Dollars per year. Section 5. Automobile. Employee shall be provided an automobile for Employee's 24 -hour business use. In the event the Employee is not provided with such automobile, Employee shall receive additional compensation of $250 per month as an automobile allowance. Section 6. Vacation and Sick Leave. Employee shall be granted sick leave and holidays granted to other employees pursuant to Chapter 17 of the Brooklyn Center City Code. Employee shall be granted vacation leave which shall accrue at the rate of two (2) days for each month of full-time service. Section 7. Disability Health and Life Insurance Coverage. City shall provide health, long and short term disability, life insurance and dental insurance • for Employee and dependents equal to that which is provided to all other City employees. -2- Section 8. Moving and Relocation Expenses. Employee shall be reimbursed for the expenses of packing and moving Employee, Employee's family, and Employee's personal property to Brooklyn Center with said reimbursement not to exceed the sum of $2,000, provided the Employee moves within two years of the date of hire. Section 9. Professional Development. City shall budget for and pay the travel and subsistence expenses of Employee for professional and official travel, meetings, and occasions adequate to continue the professional development of Employee and to adequately pursue necessary official and other functions for the City, as approved by the Council. These functions generally include but are not limited to the Annual Conference of International City Management Association, State Manager's Conference, the League of Minnesota Cities, and such other national, regional, state, and local governmental groups and committees which Employee serves as a member, as approved by the City Council. Section 10. General Expenses. Employer recognizes that certain expenses of a non - personal and generally job - related nature Will be incurred by Employee and agrees to reimburse or pay those general expenses in accordance • with the normal and customary practices and procedures of the City. Section 11. Indemnification. Employer will defend, save harmless, and indemnify Employee against any tort, professional liability claim or demand, or other legal action, whether groundless or otherwise, arising out of an alleged act or omission occurring in the performance duties as City Manager. Employer may compromise and settle any claim or suit and will pay the amount of any settlement or judgment rendered thereon. Nothing herein shall be deemed a waiver of the limitations on liability set forth in Minnesota Statutes Chapter 466. Section 12. Bonding. Employer will bear the full cost of any fidelity or other bonds required of the Employee under any law or ordinance. Section 13. Other terms and Conditions of Employment. The Council, in consultation with the Employee, may fix such other terms and conditions of employment as it may determine from time -to -time relating to the performance of Employee, provided those terms and conditions are not inconsistent with or in conflict with the provisions of this Agreement, the City Charter, the City Code, or any other law. -3- ` s Section 14. Notices. i Notices pursuant to this Agreement are given by deposit in the custody of the United States Mail, postage paid, addressed as follows: A. Employee: Alternatively, notices required pursuant to this Agreement, may be personally served in the same manner as is applicable to process in a civil action. Notice shall be deemed given as of the date of personal service or as of the date of deposit of such written notice in the United States Mail. Section 15. General Provisions. A. This Agreement constitutes the entire Agreement between the parties. • B. This Agreement may be amended at any time by the mutual consent of Employer and Employee. IN WITNESS WHEREOF, the City of Brooklyn Center by its City Council has caused this Agreement to be executed and delivered on its behalf by its Mayor and by its Acting City Manager, and the Employee has executed this Agreement as of the day and year first above written.
