or as soon thereafter as the matter may be heard at the City Hall, 6301 Shingle Creek Parkway, to
consider An Ordinance Amending Relating to Municipal Elections; Amending City Code
Sections 29 -401, 29 -402, and 29 -403.

ORDINANCE NO. 2010-06
AN ORDINANCE RELATING TO MUNICIPAL ELECTIONS; AMENDING
CITY CODE SECTIONS 29 -401, 29 -402, AND 29 -403
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS
FOLLOWS:
Section 1. Section 29 -401 of the City Code of Ordinances of the City of
Brooklyn Center is hereby amended to read:
Section 29 -401. FILING FOR MUNICIPAL OFFICE. At least tw° 0) two
weeks before the regular °' °^ first day to file affidavits of candidacy, the city clerk shall
cause to be published in the official newspaper a notice of filing for municipal office. The notice
of filing shall designate the officer to be elected, the period during which affidavits of candidacy
may be filed, and the time and place for filing such affidavits. The city _clerk shall post a similar
notice at least ten (10) dgys before the first day to file affidavits of candidacy. Not more than
ei ghtee n (i8) w eek-s 84 days nor less than sixteen ( 6) we eks 70 days before the r-egul
municipal primpa election any person who is eligible and desires to become a candidate for a
municipal office shall file an affidavit of candidacy with the city clerk. The affidavit shall be
substantially the same form as required of candidates for state offices. Upon payment of a 0
filing fee of twenty -five dollars ($25 )by a potential candidate or filing by the petition of fifty
(50 ) registered voters on behalf of the candidate to the ^:t ^' °, v , the clerk shall certify the
eligibility of the candidate and place the name of the candidate won the offieW election ballot
without partisan designation.
Section 2. Section 29 -402 of the City Code of Ordinances of the City of
Brooklyn Center is hereby amended to read:
Section 29 -402. MUNICIPAL PRIMARY MUNICIPAL —ELECTION. In the
event more than twice the number of persons to be elected to a municipal office file for the
nomination thereof, there shall be a municipal primary election which shall be held on the t
second Tuesday ^ft°-- the seeend M,,nda;, in Se ptembe r Au ust. The number of candidates equal
to twice the number of persons to be elected to the municipal office, who receive the highest
number of votes, shall be the nominees for the office named. The city clerk shall give at least
two (2) weeks previous notice of the time and place of holding such municipal primary election

and of the officers to be elected by posting in at least one (1) public place in each voting precinct
and by one (1) publication in the official newspaper, but failure to give such notice shall not
invalidate the election. At least one (1) week before the election the city clerk shall publish a
sample municipal rim ballot in the official newspaper er and he shall post a sample ballot in 14S

the city clerk's office for public inspection.
Section 3. Section 29 -403 of the City Code of Ordinances of the City of
Brooklyn Center is hereby amended to read:
Section 29 -403. PrEGULA MUNICIPAL GENERAL ELECTION. The r-egular-
municipal eg_neral election shall be held on the first Tuesday after the first Monday in November.
The city clerk shall give at least two (2) weeks previous notice of the time and place of holding
such r-egul municipal general election and of the officers to be elected by posting in at least one
(1) public place in each voting precinct and by one (1) publication in the official newspaper, but
failure to give such notice shall not invalidate the election. At least one (1) week before any
municipal election, the city clerk shall publish a sample ballot in the official newspaper and he
shall post a sample ballot in his the ci clerk's office for public inspection.
Section 4. This ordinance shall be effective after adoption and thirty days
following its legal publication.
