Also present were City Manager Gerald Splinter, Director of Public Services Diane Spector, City Attorney Charlie LeFevere, and Council Secretary Barb Collman. Couneilmember Barb KaIligher was absent from tonight's meeting. APPRO OF AGENDA AtLD CONSENT AGENDA President Paulson inquired if any Commissioner requested any items be removed from the consent agenda. No requests were made. There was a motion by Commissioner Mann and seconded by Commissioner Rosene to approve the September 26, 1994, EDA agenda and consent agenda as presented. The motion carried. RESOLUTIONS RESOLUTION NO 94-45 Commissioner Kristen Mann introduced the following resolution and moved its adoption: RESOLUTION APPROVING ONE (1) BROOKLYN CENTER ECONOMIC DEVELOPMENT AUTHORITY DEFERRED LOAN (File No. H -126 [8052]) The motion for the adoption of the foregoing resolution was duly seconded by Commissioner Dave Rosene, and the motion passed unanimously. APPROVAL, OF MINUTES SEPTEMBER 12 1994 - REOULAR SESSION There was a motion by Commissioner Scott and seconded by Commissioner Rosene to approve the minutes of the September 12, 1994, EDA meeting as printed. It provides for the acquisition by direct negotiated purchase or condemnation by eminent domain authority. The reason for acquisition of the property is to carry out the purposes and goals of the redevelopment plan adopted by the City in April of 1994. Presently, there is no specific redevelopment proposal for this site, but it is part of an area that has been viewed as a high priority for redevelopment for the past several years. -5all Commissioner introduced the following resolution and moved its adoption: EDA RESOLUTION NO. RESOLUTION AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY LOCATED AT 6500 WEST RIVER ROAD (THE BROOKDALE MOTEL PROPERTY) BY PURCHASE OR EMINENT DOMAIN PROCEEDINGS WHEREAS, the Economic Development Authority in and for the City of Brooklyn Center (the "EDA ") is an economic development authority duly constituted and organized under law, with all of the powers enumerated in Minnesota Statutes, Section 469.090 to 469.1081 (the "Act "); and WHEREAS, the EDA is authorized to develop and carry out housing development and redevelopment projects, as those terms are respectively defined in Minnesota Statutes, Section 469.002, subdivisions 15 and 14; and WHEREAS, the EDA adopted a redevelopment plan (the "Plan") in an area in the City of Brooklyn Center identified as Housing Development and Redevelopment Project No. 1 (the "Project Area ") on April 25, 1994; and WHEREAS, the Plan incorporates, consolidates and expands the redevelopment plans for projects formerly known as the Earle Brown Farm Redevelopment Project and the Housing Development Project No. 1, which projects were created by the City Council and the Housing and Redevelopment Authority in and for the City of Brooklyn Center ( "HRA "), and control over which was transferred from the HRA to the EDA by City Council Resolution No. 87 -170, pursuant to Minnesota Statutes, Section 469.094, Subdivision 2; and WHEREAS, the Plan contemplates the acquisition of certain real property (the "Property ") which is located in the Project Area and which is more particularly described below in this resolution; and WHEREAS, the EDA has determined that acquisition of the Property is necessary to carry out the goals and objectives of the Plan. NOW, THEREFORE, BE IT RESOLVED by the Economic Development Authority in and for the City of Brooklyn Center as follows: 1. It is necessary to acquire the Property as described below in this resolution in order for the EDA to carry out the purposes of the Project and Plan, as modified, and the Act. 2. Acquisition of the Property by direct purchase or by eminent domain, in the manner provided by Minnesota Statutes, Chapter 117, is deemed to be necessary EDA RESOLUTION NO. for a public purpose and is hereby authorized. 3. The EDA's attorney and staff are authorized and directed to acquire fee simple absolute title to the Property, by negotiation and purchase or by commencing eminent domain proceedings. 4. The Property to be acquired is described as follows: That part of Lot 16, AUDITOR'S SUBDIVISION NO. 310, Hennepin County, Minnesota, lying West of a line running from a point in the South line of said Lot 16 a distance of 284.53 feet East from the Southwest corner thereof to a point in the North line of said Lot 16 a distance of 232 feet East from the Northwest corner thereof, except streets. Summary Explanation: (supporting documentation attached ) This information is private and not available to the general public. This home /applicant has not received a previous grant under the deferred loan program. I have received one (1) application for a rehabilitation deferred loan ( File No. H -127 [8053]). Attached is the application and recommendation for work to be performed on the home. The applicant filed the initial application for the deferred loan program on November 20, 1992 which is the date that established the applicant's position on the deferred loan program waiting list. The application dated September 26, 1994 is the date of the applicant's formal income verification application which is completed by Hennepin County staff. This application has been moved up on the waiting list due to life /safety threat regarding the furnace. Upon inspection by Minnegaso this furnace was red tagged and a follow up inspection by the city building inspector verified this posting. The exterior is in good condition , however, the soffit and fascia requires upgrade. The 1994 market value for File 127 i 7 e No. H [8053] property s $ 5,000. Commissioner introduced the following resolution and moved its adoption: EDA RESOLUTION NO. RESOLUTION APPROVING ONE (1) BROOKLYN CENTER ECONOMIC DEVELOPMENT AUTHORITY DEFERRED LOAN (FILE NO. H -127 [80531) WHEREAS, the Brooklyn Center Economic Development Authority established a Home Rehabilitation Deferred Loan Program to assist low and moderate income individuals in the maintenance and repair of their homes; and WHEREAS, the Brooklyn Center Economic Development Authority has received one (1) application (file no. H -127 [8053]) from eligible individuals to receive deferred loan assistance; and WHEREAS, an inspection by the City of Brooklyn Center has determined that the work is necessary and appropriate under the Brooklyn Center Economic Development Authority Deferred Loan Program; and WHEREAS, the estimated cost of the proposed deferred loan application is estimated at $15,000. NOW, THEREFORE, BE IT RESOLVED by the Brooklyn Center Economic Development Authority that: 1. The Brooklyn Center Economic Development Authority does approve the one (1) housing rehabilitation deferred loan application (file no. H -127 [8053]) as recommended by the staff. 2. That the work be performed as recommended in the request for council consideration form dated October 11, 1994, and that the applicants be directed to obtain the necessary bids for staff review and approval. 3. The project shall not exceed the deferred loan limit of $15,000.
