Commissioner Barb Kalligher was excused from tonight's meeting. Also present were City Manager Gerald Splinter, Director of Public Works Sy Knapp, Director of Community Development Brad Hoffman, City Attorney Charlie LeFevere, and Commission Secretary Kathy Stratton. APPROVAL OF AGENDA AND CONSENT AGENDA President Paulson inquired if any Commissioner requested any items be removed from the consent agenda. No requests were made. APPROVAL OF MINUTES AUGUST 9, 1993 - SPECIAL SESSION There was a motion by Commissioner Scott and seconded by Commissioner Rosene to approve the minutes of the August 9, 1993, EDA meeting as printed. The motion passed unanimously. DISCUSSION ITEM EARLE BROWN HERITAGE CENTER CHILLER The City Manager explained the EDA was contacted by the PCA about a noise violation associated with the chiller at the Heritage Center. He reviewed the report submitted by the Director of Community Development including a memo from David Braslau Associates, Inc. regarding what could be done to alleviate the problem. 8/23/93 - 1 - Commissioner Scott questioned the costs listed in the report as compared to the total cost of the proposed improvements. The Director of Community Development clarified the project was divided into stages because of the cost. He explained the first stage was to install louvers ($6,440) to determine how much the noise would be reduced. He added since further reduction is needed, the cost to complete the project is approximately $32,000 compared to approximately $45,000 on the original estimate. There was a motion by Commissioner Scott and seconded by Commissioner Mann to direct the Director of Community Development to provide quotations for completing this project. ADJOURNMENT There was a motion by Commissioner Scott and seconded by Commissioner Rosene to adjourn the meeting. The motion passed unanimously. APPROVAL: Tom Bublitz, Community Deve Specialist MANAGER'S REVIEW/RECONEMENDATION: No comments to supplement this report Comments below /attached ® SUMMARY EXPLANATION: (supplemental sheets attached Upon staff inspection of the Willow River Apartments located at 6725, 6727, and 6729 Willow Lane North, samples of ceiling material and floor tiles were submitted for analysis to determine whether rn 0 of asbestos was resent in the materials. The test results came back positive for asbestos both P P in the ceiling and floor tiles. The amount of asbestos in the materials requires abatement as per Environmental Protection Agency (EPA) and Minnesota Department of Health regulations for asbestos abatement. The City has been working with Environmental Process, Inc., the company that assisted the City on the indoor air quality analysis for the public works garage, to determine what needs to be done to abate the asbestos in the Willow River Apartments. Environmental Process, Inc. (EPI) is working with City staff to prepare a set of specifications for removal of the asbestos, as per EPA regulations. The cost of developing the specifications will not exceed $1,200. In addition to preparing the specifications, it is advisable to conduct a formal survey of the building to determine the extent of asbestos in the building. Additional testing will be required, and there may be some additional areas where asbestos is present, including the exterior roofing material. By having a formal survey done on the building, it would place the responsibility for locating all the asbestos on the company conducting the survey. If any asbestos remained in the building after the abatement is completed, removal of it would then be the responsibility of the company conducting the survey. The cost for EPI to conduct the formal survey would be $600 to $700, plus • the cost of sample analysis which would be an additional $200 to $300. After completion of the survey, the plans and specifications for asbestos abatement would be prepared and submitted to the EDA for review. Due to the time required for preparation of the survey, plans and specifications, and the formal bidding process for the asbestos abatement, staff is recommending that the actual asbestos abatement work be conducted in the spring. There would be a cost savings to conduct the work in warmer weather, since the asbestos abatement contractors need both heat in the building and hot water to perform the asbestos abatement. Because of the condition of the heating system in the building, it is not feasible to use the heating and hot water system in the building to provide the necessary heat and hot water to the contractor. In general, EPI believes that a better bid price could be achieved if the project is undertaken in the spring. The project would be bid out over the winter months, and the asbestos abatement would be undertaken as soon as weather permits in the spring. The demolition contract would also be let in the spring. Upon completion of the asbestos abatement contract, the demolition contractor would then have a clean building as far as asbestos in concerned. Firm figures are not available at the present time, but it is estimated that the cost of abating the asbestos will likely be under $40,000. However, the formal survey will indicate if there are any other portions of the building that need to be removed because of asbestos materials in them. Also, during the asbestos abatement process, the removal procedure will need to be monitored and requires air sampling tests be taken on a regular basis during the course of the removal. It is estimated the time period for the asbestos removal will take approximately two to three weeks. During the course of these two to three weeks it will be necessary to take three samples per day per floor to comply with EPA regulations. The estimated cost for monitoring the asbestos . abatement removal would be approximately $2,000 to $3,000, with an additional $1,200 to $1,500 for testing the air samples. Staff had initially discussed letting the contract for demolition and requiring the demolition contractor to also remove the asbestos. The problem with following this process is that if the • asbestos abatement contractor does not follow EPA and Department of Health rules for asbestos abatement, the EDA could be liable for any problems created by the asbestos abatement contractor. By completing the asbestos abatement work separately, the EDA would have more control over the quality of the asbestos abatement contractor's work. Additionally, even if the demolition contractor subcontracted the asbestos abatement work, the EDA could be liable for improperly disposed asbestos once it reaches the landfill. With potential liability for both the asbestos removal process and deposit of the asbestos material in a landfill, staff is recommending that the asbestos abatement be done separately and monitored closely by any contractor working in the EDA's behalf. In addition to the liability to correct any problems created by a demolition contractor subcontracting for the asbestos abatement work, the EDA could be responsible for additional liability in the form of fines assessed by the EPA and /or Department of Health. These fines could range anywhere from $2,000 to $30,000. A summary of the estimated costs to complete the asbestos abatement project is shown below. A total of $17,000 has already been approved in the EDA budget for this project. This includes printing and design costs. Specifications and information in the brochure are a result of interviews with city staff, area realtors and the Chamber of Commerce regarding the need to communicate with residents. A subcommittee consisting of the communications coordinator, two city staff representatives, one member of the communications task force and the director of community development worked together to develop specifications and text based on this input. Specifications for the brochure include: ♦ Qty 5,000, 3- pocket folders diecut for business cards ♦ Qty 5,000, 8 -page, full color brochure stitched into folder highlighting features of Brooklyn Center and city - programs and facilities* ♦ Qty 5,000 of 12 inserts to be customized and printed by each department using existing laser printers *Some brochures will not be stitched into folder in case someone needs to send brochure by itself. Note: A limited supply of these materials will be given to area realtors, the Chamber etc., based on their need and size. Additional copies will need to be purchased by these organizations from the City at cost. The preliminary budget is designed to give the Council sufficient information to approve a preliminary 1994 E.D.A. property tax levy and budget total by the September 15, 1993 certification deadline established by State Law. Counties are responsible under the same law and regulation for mailing parcel specific tax notices notifying property owners of the required hearings held by cities, schools, counties, and other taxing districts between November 29 and December 20 of each year. Under state law, the City of Brooklyn Center may, at the request of the Economic Development Authority, levy a tax in any year for the benefit of the Authority. The 1994 preliminary budget projects total revenue from the E.D.A. levy to be $ 175,739. Property tax revenue is estimated at $ 139,256, after a 2% reduction for delinquencies, and $ 36,483 in homestead credit. This is the maximum levy allowed under state law and equals 0.01813% of taxable market value. The E.D.A. levied the maximum amount for 1993. As in previous years, the Council should understand whatever you set the preliminary tax levy at for the 1994 budget, it cannot be exceeded at a later time. You can levy less than what you establish in the preliminary 1994 levy but you cannot increase it. It is my intention to submit to the Council the Proposed E.D.A. Budget by mid - October. This preliminary document is designed strictly to establish the required preliminary property tax levy and budget figures to comply with State notice requirements. I recommend the Council approve the attached resolutions, setting the 1994 preliminary E.D.A. property tax levy at 0.01813% of taxable market value and the preliminary 1994 E.D.A. budget total at $ 665,726.
