DEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN
CENTER IN THE COUNTY OF HENNEPIN AND THE STATE
OF MINNESOTA
SPECIAL SESSION
APRIL 24, 1989
CALL TO ORDER
The Brooklyn Center Economic Development Authority met in special session and
was called to order by President Dean Nyquist at 10:05 p.m.
ROLL CALL
President Dean Nyquist, Commissioners Gene Lhotka, Celia Scott, Todd Paulson,
and Jerry Pedlar. Also present were EDA Director Gerald Splinter, Finance
P,
Director Paul Holmlund, Director of Planning and Inspection Ron Warren, City
Attorney Charlie LeFevere, and Administrative Aide Patti Page.
APPROVAL OF MINUTES - MARCH 27 1989 - SPECIAL SESSION
There was a motion by Commissioner Lhotka and seconded by Commissioner Paulson
to approve the minutes of the March 27, 1989, Economic Development Authority
meeting. The motion passed unanimously.
RESOLUTION NO 89 -07
Member Celia Scott introduced the following resolution and moved its adoption:

EDA RESOLUTION NO.
RESOLUTION ACCEPTING BIDS AND APPROVING CONTRACTS FOR
HERITAGE CENTER AMENITIES PROJECT NO. 89 -02
WHEREAS, pursuant to an advertisement for bids for
Heritage Center Amenities Project No. 89 -02, bids were received,
opened, and tabulated by the EDA Director and EDA Coordinator on
May 8, 1989; and
WHEREAS, bid tabulations for Project No. 89 -02 as
itemized are the lowest responsible bid for each respective
category in Project No. 89 -02.
NOW, THEREFORE, BE IT RESOLVED by the Economic
Development Authority of the City of Brooklyn Center, Minnesota,
that:
1. The President and EDA Director are hereby authorized and
directed to enter into contracts with the following
contractors in the amounts listed below in the name of the
Economic Development Authority of the City of Brooklyn Center
for Heritage Center Amenities Project No. 89 -02 according to
the plans and specifications therefore approved by the EDA
Board and on file in office of the EDA Director:

EDA RESOLUTION NO.
RESOLUTION ACCEPTING A PROPOSAL FOR PROFESSIONAL
TELEPHONE CONSULTING SERVICES AND AUTHORIZING THE
PRESIDENT TO EXECUTE A CONTRACT
WHEREAS, the Economic Development Authority In and For
the City of Brooklyn Center has established a project for the
restoration of the Earle Brown Farm; and
WHEREAS, a telephone system will be required at the
Earle Brown Farm as part of that restoration; and
WHEREAS, professional consultant proposals have been
received by the EDA for the professional service to perform a
needs analysis and develop specifications for said system; and
WHEREAS, the proposal from Eastman, Morley and Krenik
Ltd. in the amount of $6,467 is considered to be the best
proposal suiting the needs of the EDA.
NOW, THEREFORE, BE IT RESOLVED by the Economic
Development Authority In and For the City of Brooklyn Center that
the proposal for professional services from Eastman, Morley and
Krenik Ltd. is hereby accepted and the President of the Economic
Development Authority be authorized to sign a contract for the
same.

SUMMARY EXPLANATION: (supplemental sheets attached
The surplus MNDOT taking west of T.H. 252 and just south of 65th Avenue North is currently
available to the EDA for purchase. The property in question offers a number of single family
development possibilities that should be of concern to the EDA. There is approximately 2.57 acres
that by themselves could be developed into seven (7) cul -de -sac lots.
MNDOT is asking $70,800 for the land. I have asked the assessing department to review the values
for the land and provide the EDA with their estimated value. In the meantime, engineering has
developed several conceptual layouts for developing all of the area around the MNDOT land. Some of
the proposals would probably require the use of eminent domain. However, condemnation at this time
is not a consideration because the MNDOT land can be developed independently.
Dave Evanson owns and /or controls much of the adjacent vacant land. We have had several
preliminary discussions relative to a joint development of that area. It does pose an opportunity for
the EDA to have a coordinated development of the area with minimal or no cost for its involvement.
The EDA should direct staff to try to negotiate the purchase of the MNDOT land. Also, staff should
be directed to explore the joint development of the area with Mr. Evanson. An overall development
of the area would be a future discussion /decision of the EDA.

Dear Mr. Hoffman:
I am leased
p to inform you that we now have all the necessary
approvals for the reconveyance of those P ortions of the above
referenced parcels as shown in red in the enclosed map and as
described in the enclosed legal description.
In your letter to Mr. Earl Howe, District Right of Way Engineer,
you indicated that the City of Brooklyn Center is interested in
acquiring the excess land on the above referenced parcels. The
City of Brooklyn Center now has the opportunity to purchase the
lands as shown in red on the enclosed map and described in the
enclosed legal description for public purposes for its appraised
value of $70,800.00. The City will have 60 days to reply to the
State's offer.
Since the Grantor (State of Minnesota) is responsible to pay the
deed tax of $234.30, the State will accept payment in the amount
of $70,565.70 ($70,800.00 minus $234.30) and have you pay the deed
tax when you record your quit claim deed from the State. If this
is acceptable, please submit payment in the amount of $70,565.70
in the form of a certified check, cashier's check or money order
made payable to "Commissioner of Transportation - Trunk Highway
Fund." I have enclosed a self- addressed stamped envelope for the
City's reply.

purposes will be issued to the Economic Development Authority of

That part of Tracts A and B described below:
Tract A. Lots 24, 25, 26 and the south 112 feet of Lot 27
excepting therefrom the west 100 feet of said Lot 27,
all in Auditor's Subdivision No. 310, according to the
plat thereof on file and of record in the office of the
County Recorder in and for Hennepin County, Minnesota;
Tract B. Lot 1, Block 1, Clinch Valley, according to the plat
thereof on file and of record in the office of the
County Recorder in and for Hennepin County, Minnesota
which lies westerly of Line 1 described below:
Line 1. Commencing at the north quarter corner of Section 36,
Township 119 North, Range 21 West, thence run east on
an azimuth of 89 degrees 35 minutes 20 seconds (azimuth
oriented to Minnesota State Plane Coordinate System)
along the north line of said Section 36 for 498.68 feet
to Right of Way Boundary Corner B906 as shown on
