Adjournment MINUTES OF THE PROCEEDINGS OF THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA SPECIAL SESSION MAY 22, 1989 CALL TO ORDER The Brooklyn Center Economic Development Authority met in special session and was called to order by President Dean Nyquist at 10:10 p.m. ROLL CALL President Dean Nyquist, Commissioners Celia Scott, Todd Paulson, and Jerry Pedlar. Also present were EDA Director Gerald Splinter, Director of Planning and Inspection Ron Warren, City Attorney Charlie LeFevere, EDA Coordinator Brad Hoffman, and Administrative Aide Patti Page. APPROVAL OF MINUTES - MAY 1 1989 - SPECIAL SESSION There was a motion by Commissioner Scott and seconded by Commissioner Pedlar to approve the minutes of the May 1, 1989, Economic Development Authority meeting. The motion passed unanimously. APPROVAL OF MINUTES - MAY 8 1989 - SPECIAL SESSION There was a motion by Commissioner Scott and seconded by Commissioner Pedlar to approve the minutes of the May 8, 1989, Economic Development Authority meeting. The motion passed unanimously. RESOLUTIONS The EDA Director presented a Resolution Approving Revised Mechanical Plans and Specifications for the Earle Brown Farm Restoration Project and directed advertisement for bids. He noted the initial bids received were $500,000 above the original estimate. He noted there have been some changes in the plans to allow for reduction in cost, and therefore, staff is presenting the revised mechanical plans and specifications for the EDA's approval. RESOLUTION NO. 89 -13 Member Jerry Pedlar introduced the following resolution and moved its adoption: RESOLUTION APPROVING REVISED MECHANICAL PLANS AND SPECIFICATIONS FOR THE EARLE BROWN FARM RESTORATION PROJECT AND DIRECTING ADVERTISEMENT FOR BID The motion for the adoption of the foregoing resolution was duly seconded by member Celia Scott, and the motion passed unanimously. RESOLUTION NO. 89 -14 Member Celia Scott introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BIDS AND APPROVING CONTRACTS FOR HERITAGE CENTER AMENITIES PROJECT NO. 89 -02 5/22/89 -1- a • ` �i The motion for the adoption of the foregoing resolution was duly seconded by member Todd Paulson, and the motion passed unanimously. DISCUSSION ITEM MEMBERSHIP IN THE NORTHERN MAYOR'S - NORTH METRO DEVELOPMENT ASSOCIATION The EDA Director explained approximately three years ago the Northern Mayor's Association was formed to serve as a promoter to the north metro area. He noted at the time it appeared there was a consistent pattern of major public and private development going to the southwest area of the metro area. He noted to accomplish this roll, the North Metro Development Association was established and a separate budget was given to it so that cities could choose to be involved in just the mayor's association and /or the development promotional activities. He noted from his perspective, the promotion activities of the North Metro Development Association offers the opportunity for the City to join with other communities in the area to develop a quality effort promoting the assets and attributes of our area. He explained by pooling resources the North Metro Development Association can make an impact. He noted if the City were to try and do this alone, we would spend major time and dollar efforts which might be counter productive. He stated he is recommending the EDA become a member of the North Metro Development Association. He stated the cost of the membership for 1989 is $21,169 which could be paid from EDA funds. There was a motion by Commissioner Scott and seconded by Commissioner Paulson authorizing membership for 1989 in the North Metro Development Association and authorizing payment of $21,169 from EDA funds towards this membership. The motion passed unanimously. OTHER BUSINESS The EDA Director stated there have been some revisions to the farm activities. He stated staff and the Earle Brown Farm Committee has recommended delaying installation of restaurant kitchen facilities on the farm at this time. He noted Mr. Beisner's office has contacted several restaurants but for a variety of reasons these restaurants are not interested at this time. He added by delaying the restaurant kitchen facilities, money would be saved on the project. He stated staff is also recommending demolition of the G barn because it is in such poor condition there would be no sense in trying to restore it. He noted staff is recommending utilities be stubbed in, and a building could be built at a later date if someone, perhaps a restaurant, is interested in this area. The EDA Director stated the Earle Brown Farm Committee has been approached by someone who is interested in using the bunkhouse as a small museum for the highway patrol. He noted at this time there is no programmed use for the bunkhouse, and it would cost approximately $50,000 to restore it. He explained the Earle Brown Farm Committee is recommending demolition of the bunkhouse unless the highway patrol is truly interested in using the bunkhouse and will make a dollar commitment for restoration. There was a motion by Commissioner Scott and seconded by Commissioner Pedlar accepting the following recommendations from the Earle Brown Farm Committee and staff members: demolition of bunkhouse unless a commitment from the highway patrol is obtained by June 15, 1989; demolition of G barn with utilities stubbed Is 5/22/89 -2- in for future construction; delay of restaurant kitchen facilities until a later date. The motion passed unanimously. ADJOURNMENT There was a motion by Commissioner Pedlar and seconded by Commissioner Scott to adjourn the meeting. The motion passed unanimously. The Brooklyn Center Economic Development Authority adjourned at 10:37 p.m. Mayor 5/22/89 -3- Member introduced the followinc / resolution and moved its adoption: J j EDA RESOLUTION NO. RESOLUTION ACCEPTING BIDS AND APPROVING CONTRACTS FOR HERITAGE CENTER AMENITIES PROJECT NO. 89 -02 WHEREAS, pursuant to an advertisement for bids for Heritage Center Amenities Project No. 89 -02, bids were received, opened, and tabulated by the EDA Director and EDA Coordinator on June 6, 1989; and WHEREAS, bid tabulations for Project No. 89 -02 bid category #32 are as follows: COMPANY BID Horwitz, Inc. $ 997,657.00 Northland Mechanical $ 999,000.00 Doody Mechanical, Inc. $1,018,700.00 New Mech Companies $1,074,600.00 Kumar Mechanical $1,111,000.00 NOW, THEREFORE, BE IT RESOLVED by the Economic Development Authority of the City of Brooklyn Center, Minnesota, that: 1. The President and EDA Director are hereby authorized and directed to enter into a contract with the following contractor in the amount listed below in the name of the Economic Development Authority of the City of Brooklyn Center for Heritage Center Amenities Project No. 89 -02 according to the plans and specifications therefore approved by the EDA Board and on file in office of the EDA Director: BID CATEGORY BIDDER BID AMOUNT 32 Horwitz, Inc. $997,657.00 2. The EDA Director is hereby authorized and directed to return forthwith to all bidders any deposits made with their bids, except that the deposit of the successful bidder and the next lowest bidder shall be retained until a contract has been signed. MEMORANDUM TO: Gerald G. Splinter, City Manager FROM: Brad Hoffman, EDA Coordinator DATE: June 8, 1989 SUBJECT: Excess MNDOT Property At the May 8, 1989, City Councii meeting, the EDA considered the acquisition of some surplus land from MNDOT (see attached memo). As a follow up, Mark Parish did an appraisal of the property. It is the opinion of the Assessor's Office that the property has a current value of $81,200. Cost. of the land to the EDA would be $70,565.70. At best, I believe this is a break -even cost for the EDA. Our benefit from the acquisition would be an increased tax base and a greater degree of control of the development of the area. I feel the price is still high but would recommend its acquisition. The EDA has until June 19, 1989, to accept the offer. I will be available Monday evening to discuss the matter. y� Member introduced the following resolution and moved its adoption: EDA RESOLUTION NO. RESOLUTION AUTHORIZING THE PURCHASE OF EXCESS MNDOT LAND WHEREAS, the Minnesota Department of Transportation ( MNDOT) has excess land in Brooklyn Center from its T.H. 252 taking; and WHEREAS, MNDOT has offered said land to the EDA for $70,565.70 and the City Assessor has appraised the value at $81,200; and WHEREAS, the EDA desires to see said land developed in a manner consistent with the needs of Brooklyn Center. NOW, THEREFORE, BE IT RESOLVED that the Economic Development Authority in and for the City of Brooklyn Center does approve and authorize the acquisition of excess MNDOT land (parcels 17, 17A, 17B, 18, and 21) in the amount of $70,565.70. MEMORANDUM TO: Brad Hoffman, EDA Coordinator FROM: Mark Parish, Appraiser DATE: May 8, 1989 .J SUBJ: Valuation of Surplus MNDOT ROW (A part of PID #36- 119 -21 -12 -0032, 36- 119 -21 -12 -0028, 36- 119 -21 -12 -0029, and 36- 119 -21 -12 -0030) Per your request, I have valued the above referenced property and estimate the current value to be $81,200.00 (Eighty -One Thousand Two Hundred Dollars). The following information was utilized in this conclusion: 1) This parcel consists of approximately 22 acres of level unimproved land that is located to the east of T.H. 252 between 69th Avenue North and 5th Street North. 2) The highest and best use under current R -1 zoning is determined to be single family residential. 3) According to Gary Shallcross, this parcel could be divided into 7 single family lots. Additional lot(s) may be possible but would need specific approval. 4) Improved lot values are estimated at $24,000. 5 Development costs including legal, engineering, utilities streets , P 9 g 9 g and profit are estimated at $12,400 per lot. 6) Current value equals improved value less development costs. Therefore; $24,000 - $12,400 = $11,600 x 7 lots = $81,200 In conclusion, this is a preliminary estimate based on these factors and no development conflicts. However, I would recommend review of the Northeast Neighborhood file in Engineering. This parcel was one of several which have been under study since 1975 -1976. The property in question offers a number of single family development possibilities that should be of concern to the EDA. There is approximately 2.57 acres that by themselves could be developed into seven (7) cul -de -sac lots. MNDOT is asking $70,800 for the land. I have asked the assessing department to review the values for the land and r v' o ide the EDA with h their estimated value. In the meantime engineering e gineering has developed several conceptual layouts for developing all of the area around the MNDOT land. Some of the proposals would probably require the use of eminent domain. However, condemnation at this time is not a consideration because the MNDOT land can be developed independently. Dave Evanson owns and /or controls much of the adjacent vacant land. We have had several preliminary discussions relative to a joint development of that area. It does pose an opportunity for the EDA to have a coordinated development of the area with minimal or no cost for its involvement. The EDA should direct staff to try to negotiate the purchase of the MNDOT land. Also, staff should be directed to explore the joint development of the area with Mr. Evanson. I In your letter to Mr. Earl Howe, District Right of Way Engineer, you indicated that the City of Brooklyn Center is interested in acquiring the excess land on the above referenced parcels. The City of Brooklyn Center now has the opportunity to purchase the lands as shown in red on the enclosed map and described in the enclosed legal description for public purposes for its appraised value of $70,800.00. The City will have 60 days to reply to the State's offer. Since the Grantor (State of Minnesota) is responsible to pay the deed tax of $234.30, the State will accept payment in the amount of $70,565.70 ($70,800.00 minus $234.30) and have you pay the deed tax when you record your quit claim deed from the State.
