HomeMy WebLinkAbout1980 11-03 CCM Special Session MINUTES OF THE PROCEEDINGS OF THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA SPECIAL SESSION NOVEMBER 3, 1980 CITY HALL CALL TO ORDER The Brooklyn Center City Council met in a special closed session called by the City Attorney and was called to order by Mayor Dean Nyquist at 9:22 p.m. ROLL CALL Mayor Dean Nyquist, Councilmembers Tony Kuefler, Bill Fignar, Gene Lhotka, and Celia Scott. Also present were City Manager Gerald Splinter, City Attorney Richard Schieffer, Director of Planning and Inspections Ron Warren, and Administrative Assistant Tom Bublitz. REVIEW OF HOWE FERTILIZER CASE The City Attorney reviewed the Howe case for Council members explaining that the nuisance portion of the trial will be taken first. He reviewed the procedures involved for the use of information in the trial regarding past Council decisions on Howe. The City Attorney concluded his review of the case by stating that the question in the case is the constitutionality of the phase -out ordinance and that the intent of the case was to test the constitutionality of the ordinance. ADJOURNMENT There was a motion by Councilmember Kuefler and seconded by Councilmember Scott to adjourn the meeting. Voting in favor: Mayor Nyquist, Council- members Kuefler, Fignar, Lhotka, and Scott. Voting against: none, the motion passed unanimously. The Brooklyn Center City Council adjourned the special session at 9:33 p.m. 1 14 , Clerk 11 -3 -80 -1-
