Call to Order The Brooklyn Center City Council met in regular session and
was called to order by Mayor Philip Cohen at 7030 porn°
Roll Call Mayor Cohen, Councilmen Britts, Jensen, and Fignar. Also
present were City Manager Donald Poss, Director of Public
Works Jiro Merila , Director of Planning and Inspection
Blair Trernere, Director of Finance Paul Holmlund, and
Administrative Ass3dstants Rona, Warren and James Lacinas

Member Bill Fignar introduced the following resolution RESOLUTION
and moved its adoption- NO. 75 -59
RESOLUTION TO MODIFY AND SUPERSEDE THE EXISTING
JOINT POWERS AGREEMENT RELATING TO THE ESTABLISH-
MENT OF A JOINT HEALTH DEPARTMENT BETWEEN THE
CITIES OF CRYSTAL, BROOKLYN PARK AND BROOKLYN
CENTER
The motion for the adoption of the foregoing resolution
was duly seconded by member Maurice Britts, and upon
vote being taken thereon, the following voted in favor
thereof. Philip Cohen, Maurice Britts, Bill Fignar and
Robert Jensen, and the following voted against the same-
none, whereupon said resolution was declared duly passed
and adopted.
The City Manager next reviewed a proposed resolution Opposition to Senate
opposing Senate File No. 939. He noted that this parti- File No, 939
cular Senate File purports that the high cost of housing
in Minnesota is dine in part to unreasonable construction
standards and municipal land use and development controls
He stated that in effect the text of the proposed legislation
relates this high cost of housing to local government officials
and local zoning procedures. He briefly reviewed some of
the features of the proposed legislation dealing with apart-
ment density, minimum lot size and "reduced cost housing ".
Mayor Cohen commented briefly that the Metropolitan
Council officials and the State Housing Finance Agency
officials have expressed opposition to this bill.
Councilman Jensen inquired as to the applicability of the
referral in the resolution to federal policy decisions and
nondecisions. He suggested that this portion of the resolu-
tion might be deleted since.it was directed toward the proposed
state legislation. Mayor Cohen commented briefly to the
inadequacies of the federal proposals and programs to help save
existing housing and to provide housing subsidies. He noted
that there was a dire need for a new federal commitment in the
housing area.
Councilman Britts indicated that he supported Councilman
Jensen °s suggestion for deleting that portion of the resolution
that dealt with federal involvement.
The City Manager then recommended an addition to the resolution,
noting the developing good relationships between state and local
agencies and departments. ,

meanted that the applicant was interested in the concept of

once the initial construction began. He noted that at this
time it would be hard to determine which trees would remain
and which ones would be applicable to serve the screening
effect after construction.

The Brooklyn Center City Council recessed at 8035 p.m. Recess
and resumed at 9-05 p.m.
The next item considered was the second reading of the Housing Maintenance
Hoeing Maintenance and Occupancy Ordinance. The City and Occupancy
Manager briefly reviewed the background of the Hosing Ordinance
Maintenance and Occupancy Ordinance for those citizens
who were not in attendance at the previous meetings. He
commented as to the housing problem in general and the
intent of the code, noting that it was to ensure decent,
safe and unitary housing in the City. He noted that the
ordinance was based on a model U.S. Public Health Service
Code and other municipal codes. He stated that the code
had gone through some five revisions and presentations
since 1969 before the first reading at the February 24, 1975
meeting. He further commented that during this time the
Housing Commission was created with one of their specific
functions being to shape and recommend a Housing Mainte-
nance and Occupancy Ordinance. He noted that the ordinance
had been published in the Brooklyn Center Rost on March 6,
1975 as it was approved for first reading.
Mayor Cohen then reviewed the Housing Commission input
and noted that there had been ample opportunity for citizens
to respond to this ordinance in 'Its initial drafting stages.
He stated that; the Hosing Commission held nine meetings
for the Purpose of considering the Housing Code. He also
noted that in. addition to these nine Commission mraetings
they also held a public hearing for the purpose of receiving
input and reaction to the code. He then noted that the
Housing Maintenance and Occupancy Ordinance had been
publicized by the official newspaper of the City over the
past years and more explicitly just recently. He further
commented that the City Manager's Newsletter of April, 197
was distributed to every dwelling .nit within the municipality
likewise contained extensive information on the Ho _kng
Maintenance and Occupancy Ordinance consideration.
Mayor Cohen then reviewed the format for the conduct of the
meeting. He recommended that any citizens so inclined
present proposed a)�anduments or changes and supporting
reasons therefor in writing to Housing Comm scion Chairman
Lou Howard so that the Hosing Commission may consider
them prior to the Jane 1 effective date. He again, reviewed
the procedure regarding a second reading of the ordinance,
u ggesting that the Co�;ncil adopt the ordinance as published
and be prepared to review proposed changes recommended by
the Ho u„drug Co` `ssigno
Chairman Howard then commented briefly on the procedure
at the He sing Commission level. He emphasized that all
proposals be sub Atted in writing to him prior to the Housing
Ccmmiss.icn meeting, and that those interested citizens who
recommended changes attend the meeting so that they may
c larify them as necessary to the Commission.
Mayor Cohen then recognized Mr. Steve Englert of 3019
63rd Avenue North. Mr. Englert rooted that he was concerned
regarding the lack of feedback from citizens to the code. He
suggested a two year trial period before considering the code
on a permanent basis. He further commented as to Section
12 -804 regarding ceiling height, noting that most basement
ceilings would not be categorized as habitable because of this
six foot six inch regu ,iirement. He then noted that Section
