Adjournment MINUTES OF THE PROCEEDINGS OF THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA SPECIAL SESSION JUNE 13, 1988 CITY HALL CALL TO ORDER The Brooklyn Center Economic Development Authority met in special session and was called to order by President Pro tem Bill Hawes at 11:13 p.m. ROLL CALL President Pro tem Bill Hawes, Commissioners Gene Lhotka, Celia Scott, and Rich Theis. Also present were EDA Director Gerald Splinter, Director of Public Works Sy Knapp, Director of Planning and Inspection Ron Warren, City Attorney Ron Batty, EDA Coordinator Brad Hoffman, and Administrative Aid Patti Page. President Pro tem Hawes noted President Nyquist was absent from this evening's meeting. APPROVAL OF MINUTES - MAY 23 1988 There was a motion by Commissioner Scott and seconded by Commissioner Theis to approve the minutes of the May 23, 1988, Economic Development Authority meeting as submitted. The motion passed unanimously. Commissioner Lhotka abstained from the vote. REVIEW OF EARLE BROWN FARM SCHEMATIC DESIGN The EDA Director stated all the materials necessary for the review of the schematic design were not quite ready and staff would like this item tabled to the next meeting. There was a motion by Commissioner Lhotka and seconded by Commissioner Scott to table review of Earle Brown Farm schematic design to the next meeting of the Economic Development Authority. The motion passed unanimously. RESOLUTION NO. 88 -09 Member Gene Lhotka introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING CONTRACT WITH METRO HRA FOR HOME REHAB GRANT ADMINISTRATION The motion for the adoption of the foregoing resolution was duly seconded by member Rich Theis, and the motion passed unanimously. ADJOURNMENT There was a motion by Commissioner Lhotka and seconded by Commissioner Theis to adjourn the meeting. The motion passed unanimously. RESOLUTION APPROVING ONE (1) BROOKLYN CENTER ECONOMIC DEVELOPMENT AUTHORITY GRANT (FILE NO H63) WHEREAS, the Brooklyn Center Economic Development Authority established a Home Rehabilitation Grant Program' to assist low and moderate income individuals in the maintenance and repair of their homes; and WHEREAS, the Brooklyn Center Economic Development Authority has received one (1) application (file no. H63) from an eligible individual to receive grant assistance; and WHEREAS, an inspection by the City of Brooklyn Center has determined that the work is necessary and appropriate under the Brooklyn Center Economic Development Authority Grant Program; and WHEREAS, the estimated cost of the proposed grant application is estimated at $8,250. NOW, THEREFORE, BE IT RESOLVED by the Brooklyn Center Economic Development Authority that: 1. The Brooklyn Center y Economic Development Authority does approve the one (1) housing rehabilitation grant application (file no. H63) as recommended by the staff. 2. That the work be performed as recommended in the request for council consideration form dated June 27, 1988, and that the applicant be directed to obtain the necessary bids for staff review and approval. 3. The project shall not exceed the grant limit of $8,250 per house. Wall and Ceiling Repair General Specification: 1. Wherever existing walls or ceilings are to be repaired, the damaged and loose material shall be completely removed and new material shall be sized and installed to match and blend in with the adjoining and surrounding work. All repairs shall be properly prepared to receive the finish application. 2. Plastering - New plastering work shall be installed in compliance with the State Building Codes. 3. Wall Board - shall be installed in compliance with the State Building codes. 4. Perforated Tape Mix - shall comply with the recommendations of the manufacturer. A minimum temperature of 55 degrees Fahrenheit shall be maintained in the room where work is done until the cement is completely dry. 5. Perforated Tape Application - Follow manufacturer's directions. a. Over Joints the tape shall be embedded in cement and covered with a thin layer of cement. A second and third coat shall be applied. Each coat shall be dry before applying the next coat. Each coat shall be featheredged and extended beyond the previous coat (approximately 2 The finish coat shall be sanded lightly and any imperfections filled in prior to any painting and decorating. b. Check to see that all nails have been driven so that their heads are below the surface of the board leaving a dimple in the surface without breaking the paper. Cover the nails dimple with three applications of cement allowing time to dry between each coat. The final coat shall be -sanded lightly before application of paint or other decoration. c. Inside corners shall be reinforced with tape embedded in cement finished as specified "Over Joints ". d. Where previous coats have chipped and peeled, the edge shall be feathered to the maximum extent feasible and spot primed with a high quality oil base paint before finish coats are applied. No paint shall be applied until all nail holes have been filled and sanded and all defects in wood work have been eliminated. Paint shall be medium grade and applied according to the manufacturer's specifications and applied to secure full coverage. Use primer where required. GUTTERS AND DOWN SPOUTS ❑ Provide gutters and down spouts as follows: a) New gutters shall be minimum 5" wide .032 gauge aluminum with hangers placed under roofing. b) New downspouts shall be minimum 2 x 3" rectangular .020 gauge aluminum. C) Finish of gutters and downspouts shall be a baked on enamel finish. Owner to select color from readily available selection. d) Gutters shall be installed with slight pitch to the downspout. Gutters shall be securely mounted to the roof, 36" or less on center. Downspouts to be installed at one end of gutters and extend 2' at the bottom with extension. ROOFING Q Provide new roof per City of Brooklyn Center Handout and as follows: New roofing shall be in compliance with the State Building Codes and Manufacturer's installation instructions. Flashing, plumbing jacks and roof vents shall be checked and replaced with new when damaged, rusted or missing. Drip edge shall be installed along eave edge. All damaged or rotted sheathing boards shall be replaced with new. End joints shall be made over a rafter and all sagging portions of roof shall be corrected. Materials - New roofing shall carry the Class C label of wind resistance from the Underwriter's Laboratories and be applied according to the manufacturer's specifications. The type and weight of the materials used for the roofing shall be in compliance with the State Building Codes. Application - Surfaces to which roofing is to be applied shall be even, sound, thoroughly clean, dry and free from all defects that might affect the quality of application. a) Asphalt Shingles - No more than one overlay of asphalt shingles shall be applied over an existing asphalt shingle roof. Shingles shall be fastened with not less than four nails or staples per shingle. Installed shingles shall be 235# - 240# 3 -tab self sealing. Roll roofing shall be installed when the slope is 4 or less. Owner to select color of shingles from readily available selection. b) Built -up - Existing roofing material shall be removed down to bare wood. New roofing shall be 4-ply built -up tar and slag or gravel roof, including all new flashing of either metal or asphalt mineral roll material. Roof shall be installed in such a way that there is no ponding water. c) Wood Shingles and Shakes - Repair of existing roof shall match existing or blend in with the adjoining and surrounding work and include a contractor warranty for the repair work. d) Fiberglas - is an acceptable roofing material. THIS SERVICE AGREEMENT entered into this day of , 1988 by and between the Economic Development Authority of the City of Brooklyn Center, 6301 Shingle Creek Boulevard, Brooklyn Center, Minnesota 55430 (Owner), and McGough Construction Co., Inc., 2737 North Fairview Avenue, Roseville, Minnesota 55113 (McGough), is for the purpose of providing professional services for the restoration and redevelopment of the Earle Brown Farm in Brooklyn Center, Minnesota. The project for restoration and redevelopment of the Earle Brown Farm is being undertaken by the Economic Development Authority f the Ci of Brook Center for the p urpose of Y Y Y P P establishing a multi - purpose trade show center, banquet facility and /or business conference center. The Owner has contracted with an architect, Winsor /Faricy Architects, Inc., 28 West 5th Street, Suite 375, St. Paul, Minnesota 55102 (Architect), for the preparation of the Plans and Specifications for the restoration or redevelopment of the Earle Brown Farm. NOW, THEREFORE, the Owner and McGough agree to the following: 1. McGough will report to the Construction Manager and shall assist in supervising the restoration and redevelopment of the Earle Brown Farm in Brooklyn Center in accordance with the Plans and Specifications to be supplied to McGough by the Owner and Architect. The services to be supplied the Owner and Construction Manager include assisting in the obtaining of bids from contractors and subcontractors in accordance with the provisions of Minnesota Statute Section 471.345, commonly known as the Uniform Municipal Contracting Law. McGough shall supply its recommendations as to appropriate contractors and subcontractors to the Construction Manager and Owner with regard to contract terms with the contractors and subcontractors, and the awarding of bids. McGough shall provide field supervision of all contractors and subcontractors, and shall maintain a daily construction diary and construction schedule. 2. The Owner shall enter into all contracts for construction work and McGough shall not enter into any contracts with contractors or subcontractors for performance of the work required by the Plans and Specifications. -2- - 3. Subject to compliance with the Uniform Municipal 40 Contracting Law and to the receipt of Plans and Specifications sufficient for the obtaining of bids from contractors and subcontractors for the work required, it is the goal of the Owner that the work to be performed under this contract shall be commenced on or before September 1, 1988, and the work substantially completed on or before December 31, 1989. 4. The Contract Documents to be used by McGough in supplying the services shall be supplied by the Owner and Architect, including the plans detailing the work required for the renovation and general reconstruction of the Earle Brown Farm as prepared by the Architect and approved by the Owner, which shall be the working drawings. 5. McGough agrees to work with the Owner, Architect, and Construction Manager to assist in insuring that all contracts and the work to be performed are in compliance with and meet the requirements of Minnesota Statute Section 471.345, the Uniform Municipal Contracting Law. 6. Work on the various buildings comprising the Earle Brown Farm will proceed concurrently with the goal of the Owner that construction be completed within a 16 -month period from the start of construction. 7. McGough shall not be responsible for services related to tenant improvements and parking ramp facilities. 8. The Owner shall pay McGough for the performance of the services required by this contract as follows: -3- - If Construction Cost is at least $3,500,000 but less than $4,500,000, compensation shall be 3.25% of Construction Cost. If Construction Cost totals or exceeds $4,500,000, compensation shall be $146,250.00. If Construction Cost is less than $3,500,000, compensation shall be 4.0% of construction costs. Construction Cost is defined as the total of the final contract sums of all the individual contracts required for the completion of the project in accordance with the Plans and Specifications. Construction Costs shall not include compensation paid to the Construction Manager, the Architect, the cost of land and right -of -way. In addition to the fixed -fee to be paid McGough for its services, McGough shall be paid additional amounts for performing the general conditions preliminarily described on Exhibit B attached to this agreement. These general conditions are to be separately reimbursable to McGough. 9. Progress Payments Based upon Applications for Payment submitted to the Construction Manager by McGough and Project Certificates for Payment issued by the Architect, the Owner shall make progress payments on the fixed fee contract sum and for the work performed on the general conditions to McGough as provided in the contract documents for the period ending the 25th day of each month as follows: McGough will submit monthly invoices for general conditions items which shall be paid in full. He briefly reviewed the first meeting and noted staff has tried to develop the input received from citizens at the first meeting into ideas which would meet the State and County mandates. He noted by 1990, 16% of the City's solid waste must be recycled. He went on to briefly review the process that has been used so far in Brooklyn Center. He noted the Hennepin Recycling Group has been formed and Brooklyn Center is a member of this group, but the City is not committed at this time to going the same route as everyone else. He stated staff expects the City Council to make a decision in the next four to six months with or without the approval of the cities of Crystal and New Hope. He briefly reviewed the options which were outlined at the March 10, 1988, meeting. He noted two of the options had been ruled out at this meeting. Those were to do nothing at all and let Hennepin County handle the recycling or to take over the garbage hauling for the City and handle everything in- house. He briefly reviewed the three remaining options and stated staff has been evaluating these options. He went on to review the three options and the projected costs of these options and noted that not one of the systems will meet all the priorities which staff has presented. He stated using the current garbage haulers for other refuse and hiring someone to handle only the recycling would amount to more money being spent by each resident. He added that none of the systems will minimize the City's administrative burden because the City has to be involved to make the system work. He stated the staff recommendation to the Council will be to direct the Hennepin Recycling Group to negotiate a full service contract with a consortium of haulers, and if this is unsuccessful to then write specifications and bid out a full service contract. The City Manager then opened the meeting for public discussion. A number of residents inquired as to what type of items would be recycled and the methods for separating and storage. The EDA Coordinator stated in the City of Plymouth the residents are required to separate recyclables into three categories: metals which include tin, aluminum, and scrap metal; glass which includes all colors; and paper. He noted generally you rinse out all glass and metal containers. He added this is more for the residents benefit to avoid spoilage and odors from the leftover foods. He added you can crush your metal or aluminum cans, but it is not required. The City Manager noted so far there are no rules for crushing the cans but it does save space if you crush your tin or aluminum cans. The EDA Coordinator added at this time some of these questions are somewhat premature and cannot be answered completely until a program is in place. 5 -16 -88 -1- The City Manager recognized Mr. Floyd Stewig, 5455 Colfax Avenue North, who stated he presently crushes and saves aluminum cans to give to his grandsons to sell. He inquired if the City will buy the aluminum from residents. The City Manager responded negatively. Mr. James Woods, 5900 Upton Avenue North, inquired if the City had given any thought to not renewing licenses for businesses such as fast food restaurants which have large amounts of plastic and styrofoam. The City Manager noted this is not an area that can be regulated but they can encourage the use of more acceptable substitutes through the health regulations. A resident noted there are some types of biodegradable plastics and foam which are especially good for composting with yard wastes. Mr. Don Poss, 3212 64th Avenue North, stated he would like a few more details on how the recommendation for the consortium method has evolved. He added he thought State law required a bidding process in cities. The City Manager stated State law allows communities to form a joint powers group and allows for negotiated contracts. A brief discussion then ensued regarding how the City can be assured it is receiving a good comparable price and whether or not a consortium eventually creates a monopoly. A resident inquired how the bills would be handled. The City Manager stated it would depend upon the system chosen whether the residents would be receiving one bill for the total garbage and recycling collection or two bills, one for the garbage collection and one for the recycling. A resident inquired if there would be lower charges for two member families, as opposed to four or six member families. The City Manager noted at this time there is no difference in rate . but added some communities are charging people more money for their garbage collection if they do not recycle. A resident inquired whether there would be a senior citizen discount. The City Manager stated most communities do not have a senior citizen discount for garbage and recycling costs. Several residents noted their hauler has stated it will not be picking up yard wastes and they did not know how to dispose of them. The City Manager noted there are a few areas where yard wastes can be taken for composting, and a resident noted that two of the Hennepin County parks will accept leaves for composting, however, you must haul the bags to the parks yourself. The City Manager stated under the recycling program staff is recommending weekly pickup of yard wastes. A resident stated there is no doubt of the necessity for recycling, and he feels the easiest and cheapest method should be chosen to accomplish this. He added he felt option 4 would be the least expensive to the residents. The City Manager pointed out that no matter what system is chosen, the garbage hauling and recycling costs will rise as compared to what they are now. He added the options will be before the City Council in June or July, and there will be notices of this in the Post newspaper and on the City cable channel No. 37.
