HomeMy WebLinkAbout1970 07-07 CCM Board of Equalization Minutes of the Proceedings of the City Council of the City of Brooklyn Center In the County of Hennepin and State of Minnesota July 7, 1970 The City Council met as a Board of Equalization and was called to order by Mayor Philip Cohen at 7 :33 P. M. Roll Call. Philip Cohen, Vernon Ausen, Howard Heck and Theodore Willard. Also present were: Donald Poss. James Merila, John Nordberg, Assistant County Assessor Ray Johnson and B.E. Peterson, Mahor Cohen commented that pursuant to Minnesota State Statutes Chapter 274 and the City Charter, Section 7.04 that the City Council sits as a Board of Equalization to review assessments of property for taxation purposes according to the law. He further commented that the notice of the time and place of the meeting of the Board of Equalization had been published and been posted as required by law. The Mayor then called upon City Assessor John Nordberg for an assessment report, Mr. Nordberg then explained to members of the audience present the procedures used in equalizing over 15,000 parcels of property in Brooklyn Center. He further commented that all of his assessment records are open for public inspection. Mayor Cohen next called upon Assistant County Assessor Ray Johnson and asked him to comment about assessment practices particularly where there are three school districts which overlap into other communities, such as is the case in Brooklyn Center. Mr. Johnson commented as follows: 1. That the County is the supervisor of assessments for cities of 30,000 or more and for cities of population under 30,000 the County does the actual assessment of parcels of property; 2. That every even year is a real estate assessment year; 3. That because of inflation and the fact that market values have increased substantially since 1968 the assessed valuation of Parcels of property has increased substantially; 4. That all communities in Hennepin County will be equally assessed at 33 1/3% of current market value; S. That in the event Hennepin County should fail to equalize assessment practices throughout the County, the State Commissioner of Taxation has the authority to review and correct Hennepin County equalization practices, The City Manager then asked the Assistant County Assessor to explain the statutory appeal procedures. Mr. Johnson explained the appeal procedures as f©llowa: 1. The City Council acts as Board of Equalization on July 7, 1970; 2. The Hennepin County Board of Commissioners acts as Board of Review from July 20th thj*ught August 24th; 3. The State sits as a Board of Review on November 15th. He further explained the abatement procedures to members of the audience. Following this there was a discussion among the Council and members of the audience with the City Assessor and Assistant County Assessor. The Chair recognized Mr. Edward M. Elmer of 6540 Lyndale Avenue North who commented that he would establish an appointment with the Brooklyn Center City Assessor Mr. Nordberg, at a later date. -1- The Chair next recognized Mr. W. Rosenow of 7155 Osseo Road, owner of a parcel of property mown as Auditor's Subdivision No. 57, Parcel 56. Mr. Rosenow complained that his property taxes of $1,967.52 for an assessed valuation of $39,480 for 3.7 acres was set too high. He alledged that he is paying more for his property which he believes is identical to that of Mr. W. P. Gronfield of 7215 Osseo Road. He further complained that he had not been permitted to obtain apartment zoning for the property, Councilman Willard commented to Mr. Rosenow that the Board of Equalization is to hear grievances concerning assessment practices on property and not rezoning. In response to a question from Councilman Willard Mr. Rosenow stated that the subject property is listed for sale at $45,000. Following a thorough discussion among members of the Council and Mr. Rosenow a motion was made by Theodore Willard and seconded by Howard Heck that the City Council, sitting as a Board of Equalization as required by the State Statutes and City Charter, upholds the City Assessor's valuation of Mr. Rosenow's property. Voting in favor were,. Philip Cohen, Vernon Ausen, Howard Heck and Theodore Willard. Voting against were:. none. Motion carried unanimously. Since the City Assessor has not completely reviewed all property in the City, the City Manager recommended to the Council that it continue the Board of Equalization hearing for 20 days until July 27th. Motion by Howard Heck and seconded by Vernon Ausen to adjourn the Board of Equalization until July 27, 1970 at which time it will convene between the hours of 7:30 P. M, and 8:00 P. M. Voting in favor were: Philip Cohen, Vernon Ausen, Howard Heck and Theodore Willard. Voting against were: none, Motion carried unanimously. The Board of Equalization adjourned at 8:50 P. M.
