of the Village of Brooklyn Center in the County of Hennepin and
State of Minnesota, including all accounts audited by said Council
October 28, 1953
The Village Council met in regular session and called to order by
Arthur Paulson, President, at 8:00 P.M.
The following members were present: Arthur Paulson, Merrill Stodghill,
Wayne Gageby and Paul Weekly. Glen Sonnenberg came later in the meeting.
The minutes of the regular meeting held on October 14, 1953 were
approved as read.
The clerk announced that the proposed assessments for Blacktopping
Improvement No. 53 -1 and Sanitary Sewer Improvement No. 53 -1 had been filed
in his office on the 23rd day of September, 1953 and that notice of a hearing'
on said assessments had been given in the form and manner required by law. The
clerk presented an affidavit showing publication of such notice in the official
newspaper which affidavit was examined and found satisfactory and ordered placed
on file.
The mayor announced that the meeting was open for the consideration of
objections to any of the assessments theretofore filed with the village clerk
for said improvements. The clerk reported that no written objections had
been filed. No one appeared at the meeting in opposition to the assessments.
Trustee Merrill Stodghill introduced the following resolution and moved
its adoption :
RESOLUTION CONFIRMING ASSESSMENTS IN
BLACKTOPPING IMPROVEMENT NO. 53 -1 AND
SANITARY SEWER IMPROVEMENT NO. 53 -1
BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, as follows:
1. The village clerk has with the assistance of the engineer
heretofore selected by this council for such purpose, 'calculated
the proper amounts to be specially assessed for the construction
of the street improvements known as Blacktopping Improvement
No. 53-1 and Sanitary Sewer Improvement No. 53 -1 of said Village
against every assessable lot, piece or parcel of land in
accordance with the provisions of law, and has prepared and
filed with the village clerk tabulated statements in duplicate
showing the proper description of each and every lot, piece or
parcel of land to be specially assessed and the amount
calculated against the same.
2. Notice has been duly published as required by law that
this council would meet in regular session on October 28, 1953 to
pass on the proposed assessments.
3. Said proposed assessment has at all times since its
filing been open to inspection and copying by all persons
interested, and an opportunity has been given to all interested
persons to present their objections, if any, to such proposed
assessments, or to any item thereof.
4. No changes in the proposed assessment are necessary.
5. This council finds that each of the lots, pieces or
parcels of land enumerated in said proposed assessments was and
is specially benefitted by said improvements in the amount of
said proposed assessments set opposite the description of
each such lot, piece or parcel of land and that amount
so set out is hereby levied against each of the respective
lots, pieces or parcels of land therein described.
6. Such proposed assessments are affirmed, adopted
and confirmed, and the sums fixed and named in said proposed

assessments are affirmed, adopted and confirmed as the
proper special assessments for each of said lots, pieces
or parcels of land respectively.
7. Said assessments so affirmed, adopted and
confirmed shall be certified to by the village clerk and
filed in his office and shall thereupon be and constitute
the special assessments for the paying of Blacktopping
Improvement No. 53 -1 and Sanitary Sewer Improvement No. 53 -1.
8. The amounts assessed against each lot, piece or
parcel of land shall bear interest from the date hereof until
the same have been paid at the rate of 5% per annum.
9. Such assessments shall be payable in equal installments
beginning in the year 1954 payable on the 1st day of January
in each year and continuing until all of said installments shall
have been paid, each installment to be collected with taxes
collectible during said year by the county auditor, as follows:
Blacktopping Improvement No. 53 -1 in 5 equal annual
installments
Sanitary Sewer Improvement Igo. - 53 -1 in 10 equal annual
installments
10. The village clerk is hereby directed to make up and
file in the office of the County Auditor of Hennepin County a
certified statement of the amount of all of such unpaid assess -
ments and the amount which will be due thereon on the 1st day of
January in each year.
The motion for the adoption of the foregoing resolution was duly
seconded by member Wayne Gageby, and upon vote being taken thereon, the
following voted in favor thereof: Paul Weekly, Wayne Gageby, Arthur Paulson
and Merrill Stodghill; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.

BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, as follows:
1. The village clerk has with the assistance of the
engineer heretofore selected by this council for such purpose,
calculated the proper amounts to be specially assessed for the
oiling of certain streets as follows:
Camden Avenue North from 55th to 57th Avenue North
Aldrich Avenue North from 56th to 57th Avenue North
Bryant, Colfax, Dupont, Nmerson, Fremont, Girard and
Humboldt Avenues North from 53rd to 57th Avenue North
Logan Avenue North from 55th to 57th Avenue North
54th Avenue North from Dupont to Humboldt Avenue North
55th Avenue North from Lyndale to Logan Avenue North
56th Avenue North from Lyndale to Dupont Avenue North and
Emerson to Fremont Avenue North
of said Village against every assessable lot, piece or parcel
of land it accordance with the provisions of law, and has
prepared and filed with the village clerk /tabulated statements
in duplicate showing the proper description of each and every
lot, piece or parcel of land to be specially assessed and the
amount calculated against the same.
2. Notice has been duly published as required by law that
this council would meet in regular session on October 28, 1953
to pass on the proposed assessments.
3. Said proposed assessment has at all times since its
filing been open to inspection and copying by all persons

persons to present their objections, if any, to such proposed
assessments, or to any item thereof.. -

assessments are affirmed, adopted and confirmed as the
proper special assessments for each of said lots, pieces or
parcels of land respectively.
7. Said assessments so affirmed, adopted and confirmed
shall be certified to by the village clerk and filed in his
office and shall thereupon be and constitute the special
assessments for the paying of the foregoing enumerated improve-
ment.
8. Such assessments shall be payable in one installment
due on January 1, 1954 and shall be collected with taxes
collectible during said year by the county auditor.
9. The village clerk is hereby directed to make unaid
file in the office of the County Auditor of Hennepin County
a certified statement of the amount of all of such unpaid
assessments and the amount which will be due thereon.
The motion for the adoption of the foregoing resolution was duly
seconded by member Wayne Gageby, and upon vote being taken thereon, the
following voted in favor thereof: Paul Weekly, Wayne Gageby, Arthur Paulson
and Merrill Stodghill; and the following voted against the same:
None; whereupon said resolution was declared duly passed and adopted.
Motion made by Merrill Stodghill and seconded by Wayne Gageby
that the Planning Commission receive written notice on all actions taken by
the Village Council on their minutes, effective January 1, 1954. Motion
carried.
Motion made by Paul Weekly and seconded by Wayne Gageby that
Mr. Wichterman be granted a permit to build within 1O feet of the side street
on property legally described as Lot 1, Block 2, John Rydeens Addition.
Motion made by Paul Weekly and seconded by Merrill Stodghill that
Mr. Glisan be given authority to divide his lot on 55th and Humboldt (legally
described as Bast 158 feet of the /it of the South two- fifths of the WW of the
NVi of the S1& of Section 1, Township 118, Range 21) into two 66 foot lots.
Motion carried.
Motion made by Merrill Stodghill and seconded by Wayne Gageby
allowing 5 foot side yards on Lot 6, Block 4, N & B. Perkins Addition. Motion
carried.

Motion made by Merrill Stodghill and seconded by Paul Weekly
that plat of the Lilac Addition be accepted and the President and Clerk
be authorized to sign the final plat. All members voting in favor of
this motion, motion carried.
Motion made by Wayne Gageby and seconded by Paul Weekly that
the Village take care of lowering the storm sewer manhole on 54th and
James Avenue North. Motion carried.
Motion made by Merrill Stodghill and seconded by Paul Weekly
to accept the petition of W. William V. Tuma for blacktopping Emerson
Avenue from 61st to 62nd Avenue North and 62nd Avenue North from
Dupont Avenue to Emerson Avenue North in Garrett Addition, the public
hearing to be held after January 1, 1954. Motion carried.
Motion made by Merrill Stodghill and seconded by Wayne Gageby
authorizing the addition to the contract of the Lee Electric Company
for wiring the electric stove and two outlets over the work bench in the
Fire Department. Motion carried.
Motion made by Merrill Stodghill and seconded by Wayne Gageby
to accept the deeds on Camden Avenue of Lloyd A. HOlthus and wife,
Leslie A. Slind and wife and Victor H. Edberg and wife. All members
voting in favor of this motion, motion carried.
Motion made by Paul Weekly and seconded by Merrill Stodghill
that the Council rescind the action of Richard Jennrich taken on Oetober
14, 1953, with the full understanding that he must be an active member
of the Fire Department. Motion carried.
Motion made by Paul Weekly and seconded by Merrill Stodghill
to accept the Bond of James Wichterman & Son in the amount of $1800.
to blacktop the street and sod the boulevard on Knox Avenue North
between 54th and 55th Avenue North the Bond to expire One year from
date. Motion carried.
Motion made by Paul Weekly and seconded by Wayne Gageby
giving the Northern States Power Company authority to 1110111 two poles
on 57th Avenue North between Knox and Morgan Avenue North, one pole on
58th Avenue North and Knox Avenue, one pole on 58th Avenue North between
Knox and Logan Avenue North. Motion carried.
Motion made by Paul Weekly and seconded by Wayne Gageby to
accept the Justice Report of Russ Jones for the month of September 1953.
Motion carried.
