HomeMy WebLinkAbout1954 03-24 CCM Regular SessionMinutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council March 24, 195 The Village Council met in regular session and called to order by Arthur Paulson, Mayor, at 8:00 P.M. The following member were present: Arthur Paulson, Wayne Gageby, Glen Sonnenberg, Allen Lindman and Paul Weekly. The minutes of the regular meeting held on March 10, 1954 were approved as read. Motion made by Paul Weekly and seconded by Allen Lindman to secure a building inspector. Motion carried. adoption: Glen Sonnenberg introduced the following resolution and moved its WHEREAS, it appears that the village presently has title to a strip of property 30 feet wide known as the Easterly 30 feet of Lots 11, 12, 13, 14 and 15, Block 4, "N. & E. Perkins' Addition to Minneapolis "; and WHEREAS, it appears that said property was acquired from the owner thereof approximately 12 years ago; and WHEREAS, it appears that said strip of land was given to the village with the intention of providing the village with an easement for road purposes; and WHEREAS, it appears that said 30 feet is not needed by the village for road purposes since a 60 foot right -of -way already exists exclusive of said 30 foot strip; and WHEREAS, it appears that said strip of land has not been in fact used as a public road; and WHEREAS, it appears that said transfer of property was inadvertent and the village has no use therefor, NOW THEREFORE, be it resolved by the Village Council of the Village of Brooklyn Center as follows: 1. It is in the best interests of the village that said 30 foot strip referred to above be deeded forthwith to the present owners of the respective lots abutting to the west thereof. 2. Said conveyance shall be made by Quit Claim Deed, and the Mayor and the Clerk are herewith authorized and directed toexecute said Quit Claim Deed in favor of said owners. 3. Any special assessments which may have been made against said 30 foot strip shall be abated to the extent that the total special assessment against the lots abutting to the west thereof shall carry such assessments as said lots would have carried had the 30 foot strip been a part of said lots at the time of making said assessment. 87 The motion for the adoption of the foregoing resolution was duly seconded by Wayne Gageby and upon vote being taken thereon and all members voting in favor of the motion, motion carried. Motion made by Allen Lindman and seconded by Paul Weekly to accept the deeds of Ernest Johson and Harold Johnson deeding the west 30 feet of Lot 9, Gould's Riverview Addition for street purposes and also the Bond in the amount of $250.00 for construction of street across principal's property. Motion carried. 88 Motion made by Glen. Sonrenbe g and seconded by Paul Weekly to increase the salary of George Jenson, Janitor, to $150.00 per month, and on an hourly basis of 11.0 hours per week effective April 1, 1954. Motion carried. Motion made by Wayne Gageby and seconded by Paul Weekly to accept the recommendation of the Planning Commission and that a building permit be issued to Mr. Gilbertson for a motel to be erected within one year and to be constructed according to plans submitted on March 19, 195 and to conform to the Building Code of the Village. All members voting in favor of this motion motion carried. Motion made by Wayne Gageby and seconded by Glen Sonnenberg to increase the salary of Emil Carlson, Plumbing Inspector, from $75.00 per month to $125.00 plus mileage at 60 per mile. Motion carried. The Mayor announced that the meeting was open for the consideration of a proposed improvement in the village consisting of the following: Sanitary sewer on that part of Irving and James Avenues North lying between 55th Avenue and 130 feet North of the center line of 54th Avenue. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks publication thereof in the official newspaper, the last publication being on March 11, 195 which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. The following appeared and entered objections: None; and the following appeared in favor of said improvement: None. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ORDERING IMPROVEMENT AND APPROVING PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Saitary sewer on that part of Irving and James Avenues North lying between 55th Avenue and 130 feet North of the center line of 54th Avenue. Said improvement shall be hereafter designated Sanitary Sewer Improvement No. 1954 -2. 2. The Minder Engineering Company shall forthwith prepare plans and specifications for said improvements which shall be filed with the Clerk. The motion for the adoption of the foregoing resolution was duly seconded by member Glen Sonnenberg, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Wayne Gageby, Allen Lindman, Glen Sonnenberg and Paul Weekly; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Glen Sonnenberg and seconded by Allen Lindman to set the salary of the Village Clerk for the first three months of 1954 at $325.00 per month and the balance of the year at $150.00 per month. Motion carried. adoption: Glen Sonnenberg introduced the following resolution and moved its RESOLUTION WHEREAS, the Twin Lake School PTA consisting of residents of the Village of Brooklyn Center have petitioned the Villge Council of the Village of Brooklyn Center to work for the installation of traffic control signals at the intersection of Highway 152 and 50th Avenue North; and WHEREAS, said requested is based upon safety of the children during school hours and for the safety of those children and residents who use the playground facilities after school hours; and WHEREAS, said residents have further petitioned for "No Parking During School Hours" signs in front of said school, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF `lilt; VILLAGE OF BROOKLYN CENTER AS FOLLOWS: 1. Said request is approved as being consistent with the welfare of the residents and school children in the immediate vicinity of said school. 2. The Clerk is herewith directed to transmit a copy of this resolution to the State Highway Department for such further consideration as can be given to this request. The motion for the adoption of the foregoing resolution was duly seconded by Paul Weekly and upon vote being taken thereon and all members voting in favor of the motion, motion carried.
