of the Village of Brooklyn Center in the County of Hennepin and
State of Minnesota, including all accounts audited by said Council
May 26, 1954
The Village Council met in regular session and called to order by
Arthur Paulson, Mayor, at 8:15 P.M.
The following members were present: Arthur Paulson, Wayne Gageby,
Glen Sonnenberg, Allen Lindman and Paul Weekly.
The minutes of the Special Meeting held on May 4, 1954 and the Regular
Meeting held on May 12, 1954 wee approved as read.
The Mayor announced that the meeting was open for the consideration
of a proposed improvement in the village consisting of the following:
Constructing a water distribution system including mains,
laterals and all appurtenances incidental thereto within
John Ryden's Second Addition, said installation including
water main on Penn Avenue North between 53rd and 54th Avenues North
The Clerk produced an affidavit of publication of notice of hearing
on the proposed improvement showingtwo weeks publication thereof in the official
newspaper, the last publication being on May 20, 1954, which affidavit was
examined and found satisfactory and ordered placed on file.
Member Paul Weekly introduced the following resolution and moved its
adoption:
RESOLUTION DEFERRING ACTION ON WATER IMPROVEMENT
WHEREAS, the Village Council has heretofore entered into
negotiations with the City of Minneapolis for an agreement under
which the City of Minneapolis would supply the village with
water, and
WHEREAS, negotiations for such an agreement are still pending, and
WHEREAS, the policy of the City of Minneapolis in connection
with such a proposed agreement has not yet been established,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. Action to approve or disapprove the water distribution
system improvement shall be deferred until the outcome of the
negotiations with the City of Minneapolis are known.
The motion for the adoption of the foregoing resolution was duly seconded by
member Allen Lindman, and upon vote being taken thereon the following voted
in favor thereof: Arthur Paulson, Glen Sonnenberg, Wayne Gageby, Allen Lindman
and Paul Weekly; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.

After hearing and considering all objections, and the property
owners appearing in favor of said improvement, member Paul Weekly introduced
the following resolution and moved its adoption:
RESOLUTION ORDERING IMPROVEMENT AND APPROVING
PLANS AND SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. It is hereby determined that it is necessary and for the best
interests of the village and the owners of property specially benefited
thereby that the following improvement shall be constructed:
Constructing sanitary sewer system within that area known
as John Ryden's Second Addition, said installation including
sanitary sewer lines on Morgan and Penn Avenues North between
53rd and 54th Avenues North
Said improvement shall be hereafter designated Sanitary Sewer Improvement
No. 1954 -3.
2. The plans and specifications for said improvement heretofore
prepared by Minder Engineering Company, Engineer, are hereby approved and
ordered filed with the Clerk.
3. The advertisement for bids for said improvement have heretofore
been published in accordance with a previous resolution of the Village
Council.
The motion for the adoption of the foregoing resolution was duly seconded by
member Alien Lindman, and upon vote being taken thereon the following voted
in favor thereof: Arthur Paulson, Glen Sonnenberg, Wayne Gageby, Alien Liman
and Paul Weekly; and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Motion made by Allen Lindman and seconded by Paul Weekly that the
property of Alvin Blade covering the two lots be construed as one parcel, and
change the description to one lot and a correction be issued to the County
Auditor covering the abatement of Plat 3140, Parcel 4400 on Blacktopping. Motion
carried.
The Mayor announced that the council was met to receive, open and
consider bids for labor and materials in the construction of Sanitary Sewer
Improvement Nos. 1954 -1, 1954 -2 and 1954 -3.
The Village Clerk presented affidavits showing publication of
advertisement for bids in the official newspaper and the Construction Bulletin,
which affidavits were examined and found to be in accordance with law and
ordered placed on file.
The Clerk then presented the bids which had been received. These
were numbered consecutively and were then opened and examined and all persons
who desired were given an opportunity to inspect all bids. These were
tabulated and found to be as follows:

Member Paul Weekly introduced the following resolution and moved its
RESOLUTION ACCEPTING BIDS
AND APPROVING CONTRACT AND BOND
BE IT RESOLVED by the Village Council of the Village of Brooklyn Center,
Minnesota, that the bid of Peter Lametti Construction Company as to the
furnishing of all work, labor and material in connection with
Sanitary Sewer Improvement Nos. 1954 -1, 1954 -2, 1954 -3
according to the plans and specifications therefor now on file
in the office of the Village Clerk, is deemed to be the lowest
and best bid submitted for said work by a responsible bidder,
and said bid is hereby accepted.
BE IT run•rrr..n RESOLVED That the form of contract proposed
for execution between the Village and Peter Lametti Construction
Company is approved, and the Mayor and Village Clerk are hereby
authorized and directed to execute the same on behalf of the village.
BE IT r RESOLVED That the bond, with Seaboard Surety
Company, as surety, in the amount of $32,758.27 conditioned for the
faithful performance of the said contract, be approved and filed
with the Village Clerk.
The motion for the adoption of the foregoing resolution was duly seconded
by member Wayne Gageby, and upon vote being taken thereon the following voted
in favor thereof: Arthur Paulson, Glen Sonnenberg, Wayne Gageby, Allen
Lindman and Paul Weekly; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Motion made by Wayne Gageby and seconded by Paul Weekly to purchase
1 - New Seaman Model G7 tow type pulvi- mixer, powered with a 90 H.P. gasoline
Engine, hydraulically controlled type FR 7 ft. rotor with SC tines, mounted
on two 7 :50 x 20 pneumatic tires and tubes, Price F.O.B. Brooklyn Center,
Minn. $4590.00. The Village Attorney is to arrange for sales of Certificates.
All members voting in favor of this motion, motion carried.
Motion made by Wayne Gageby and seconded by Glen Sonnenberg to
advertise for a Village Engineer. Arthur Paulson cast a no vote. Motion
carried.
Motion made by Glen Sonnenberg and seconded by Wayne Gageby to accept
the final plat of the Perron Addition, subject to all the restrictions of the
Zoning Ordinance. Motion carried.
Motion made by Wayne Gageby and seconded by Paul Weekly to accept
the final plat of the Gilbertson Acres Addition, subject to all the
restrictions of the Zoning Ordinance. Motion carried.
Motion made by Paul Weekly and seconded by Glen Sonnenberg to cancel
the storm sewer assessment against the Minneapolis, St. Paul and Sault St.
Marie Railroad in the Brooklyn Manor Addition; License No. 13056 of August 1,
1953 specifically states the railroad company in granting the easement are not
to assume any costs. Therefore all assessments be cancelled. All members
voting in favor of this motion, motion carried.
