of the Village of Brooklyn Center in the County of Hennepin and
State of Minnesota, including all accounts audited by said Council
June 2, 195
The Village Council met in special session and called to order by
Arthur Paulson, Mayor, at 8 :30 P.M.
The following members were present: Arthur Paulson, Wayne Gageby,
Gien Sonnenberg, Alien Lindman and Paul Weekly.
Motion made by Glen Sonnenberg and seconded by Allen Lindman that
the Minder Engineering Company make up a profile on James Avenue North from
53rd to 54th Avenue North for street grades. Motion carried.
Motion made by Paul Weekly and seconded by Wayne Gageby that all
drainage of the Northport Plat to be financed by developers. Motion carried.
Motion made by Glen Sonnenberg and seconded by Paul Weekly to accept
the proposed plat of Richard Pengilly lying between 67th to 69th Avenue and
from Noble Avenue to 113 feet west of Orchard Avenue North and as recommended
by the Planning Commission. Motion carried.
Motion made by Wayne Gageby andseconded by Allen Lindman to accept the
proposed plat presented by Mr. Zachman, and as corrected and approved by the
Planning Commission. The north two lots on proposed Chowen Avenue and the
North lot and South lots on proposed Beard Avenue to have a 20 foot turnaround
easement. Motion carried.
Motion made by Glen Sonnenberg and seconded by Wayne Gageby to approve
the recomendation of the planning Commission and grant Mr. P. A. Peterson
authority to sell 5 standard lots by metes and bounds description, said lots
facing on Knox Avenue North and lying north of 58th Avenue. Motion carried.
Motion made by Wayne Gageby and seconded by Gien Sonnenberg to have
the Village attorney contact K. 0. Sandum in reference to the dedication of Drew
Avenue North between 50th and 51st Avenues in accordance with his promise made
at a public hearing, that he would dedicate Drew. Avenue when 53rd Avenue became
a full street. Motion carried.
Motion made by Wayne Gageby and seconded by Alien Lindman that the
existing hazard on the southwest corner of 53rd and Xerxes be corrected, and
that the Village contact Mr. Day and have the corner cut down. Motion carried.
Motion made by Glen Sonnenberg and seconded by Wayne Gageby to accept
the deed of Lester K. Warner and Justina M. Warner covering the N 30 feet of that
part of Lot 54 in Auditor's Subdivision No. 218, Hennepin County, Minnesota,
according to the plat thereof recorded in the office of the Register of Deeds
in and for said county, the above land to be used for street purposes only.
Motion carried.
Motion made by Glen Sonnenberg and seconded by Alien Lindman that
Mr. Fraser, village attorney, draw up an ordinance prohibiting the removal of
dirt outside the village limits. Motion carried.
Motion made by Wayne Gageby and seconded by Paul Weekly to release the
bond of Olaf. N. Aurness on payment for grading of streets coverig the North 1/2
of 58th Avenue North from Knox Avenue to a point 127 feet East thereof and the
East 1/2 of Knox Avenue from 58th to a point 280 feet North thereof. Motion
carried.
Motion made by Wayne Gageby and seconded by Paul Weekly that no parking
signs be installed along the fenced area on T.H. 152 in front of school district
#2✓or any portion thereof. Motion carried.
Motion made by Glen Sonnenberg and seconded by Paul Weekly giving the
Minneapolis Gas Co. authority to install a 3 inch main on James Avenue North
from 136 feet north of the north line of 54th Avenue North to 13 feet north of
the north line of 55th Avenue North. Motion carried.
Motion made by Wayne Gageby and seconded by Paul Weekly to abate the
assessments on the Leslie H. Hagen property against Parcel 500, Plat 31410, and
should be levied against the south 1/2 of this property and corrected accordingly

on both the storm sewer and blacktopping. Motion carried.
Motion made by Allen Lindman and seconded by Wayne Gageby to
adopt the following ordinance:
1. Section 28 and Section 30 of the ordinance amending the
Building Code of the Village of Brooklyn Center, which amending ordinance
was enacted on April 1, 1953, are hereby consolidated and renumbered
Section 29. Section 29 of said ordinance is hereby renumbered
Section 30. There shall be added to said ordinance a new section
number 28 which shall read as follows:
AN ORDINANCE AMENDING THE BUILDING CODE OF THE VILLAGE OF BROOKLYN
CENTER BY PROVIDING FOR THE LICENSING OF PERSONS ENGAGED IN THE
CONSTRUCTION OF SEPTIC TANKS AND CESSPOOLS
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS
FOLLOWS:
Section 28. License required. No person, firm, or corporation shall
engage in the business of constructing, altering, maintaining, or
repairing septic tanks or cesspools within the Village of Brooklyn
Center, nor shall any person make any connection to a public sewer
main, unless licensed to do plumbing work as provided in Section 20
of said ordinance, or unless licensed as hereinafter provided. Any
person, firm or corporation may apply for a license authorizing the
installation, construction, maintenance or repair of septic tanks or
cesspools only. Said license shall be issued only to individuals or
contractors who show a thorough understanding of the laws and regula-
tions governing septic tank and cesspool installations and who demon-
strate sufficient knowledge, skill and training to enable them to
carry on the work of installing or maintaining septic tanks and cess-
pools. These licenses shall be issued in the same manner and under
the same conditions as specified for plumbers' license, except that
the bond shall be in the amount of $1000. Such a license shall not
authorize the holder thereof to do any other kind of plumbing work.
Said license shall not be required for a person constructing a cess-
pool or septic tank on his own premises actually occupied by him as
a homestead upon the filing of an affidavit showing that he actually
performed the work himself on such homestead. Neither a homeowner
nor a person licensed to engage in septic tank or cesspool work shall
be authorized to make connections to a public sewer main.
2. This ordinance shall take effect from and after its publication
Upon vote being taken on the adoption of the foregoing ordinance, the following
voted in favor thereof: Arthur Paulson, Wayne Gageby, Glen Sonnenberg, Allen
Lindman and Paul Weekly; and the following voted against the same: None;
whereupon said ordinance was declared duly passed and adopted.
