HomeMy WebLinkAbout1954 07-28 CCM Regular SessionMinutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council July 28, 1954 The Village Council met in regular session and called to order by Arthur Paulson, Mayor, at 8:00 o'clock P.M. The following members were present: Arthur Paulson, Wayne Gageby, Allen Lindman and Paul Weekly. Glen Sonnenberg was absent. as read. The minutes of the regular meeting held on July 14, 195 were approved Motion made by Wayne Gageby and seconded by Paul Weekly giving the Civil Defense authority to purchase 4 M 21 x 11 Warden Census forms and 6 M Recruiting Cards. All members voting in favor of this motion, motion carried. Motion made by Paul Weekly and seconded by Wayne Gageby giving the givil Defense authority to install 3 air raid warning signals within to Village at a cost of $85.00 each, also the $5.00 service charge on the 3 Bell and Light Systems. All members voting in favor of this motion, motion carried. Motion made by Allen Lindman and seconded by Wayne Gageby to accept the recommendations of the Planning Commission covering the proposed plat of the Lawnridge Addition, and that this proposed plat be accepted with turnaround easements. Motion carried. Motion made by Paul Weekly and seconded by Wayne Gageby to accept and adopt an ordinance regulating the cleaning of septic tanks and cesspools as follows: ORDINANCE REGULATING THE CLEANING OF SEPTIC TANKS AND CESSPOOLS AND THE DISCHARGE OF THE CONTENTS THEREOF BY REQUIRING PERMITS AND LICENSES THEREFOR. The Village Council of the Village of Brooklyn Center do ordain as follows: 1. No person, firm or corporation shall hereafter engage in the business of cleaning or pumping cesspools or septic tanks within the Village of Brooklyn Center unless they shall be licensed by the Village Council which license shall be granted to any applicant therefor on compliance with the following: (a) The applicant shall pay a $25.00 license fee, and licenses shall run from May 1 to April 30 of the following year. (b) The applicant shall file a bond in the amount of $1000.00 with the Village Clerk conditioned upon observance and compliance with all of the ordinances of the Village of Brooklyn Center governing the cleaning and pumping of septic tanks an4esspools. (c) The applicant shall demonstrate that he has sufficient knowledge and experience to properly perform the functions of a scavenger. (d) The applicant shall demonstrate that he has adequate equipment to perform the foregoing. 2. Before commencing any cleaning or pumping operations of any cesspool or septic tank within the Village of Brooklyn Center, a permit shall first be obtained from the village offices. A permit fee of $3.00 shall be paid, and the permit shall state the premises at which the septic tank or cesspool is located and the estimated gallonage required to be discharged from said cleaning or pumping operations. The permit holder shall thereupon be authorized to discharge the contents from the pumping operations at a designated place lying within the City of Minneapolis. 3. Every person engaged in scavenger operations in accordance with the foregoing shall provide sealed tanks for the transportation of any waste matter through the Village of Brooklyn Center and shall also provide " 143 144 with said equipment a discharge hose which can be dropped into the discharge manhole. 4. Any violation of any of the foregoing provisions by any person, firm or corporation shall be a misdemeanor and may be punishable by a fine of not more than $100 or by not more than thirty days imprisonment. Any person who shall, in the course of carrying out any of the operations regulated in this ordinance, commit a private or public nuisance shall also be guilty of a misdemeanor and subject to the same penalties as set forth above. 5. This ordinance shall take effect from and after its publication. Upon vote being taken on the foregoing ordinance and all members voting in favor thereof, the ordinance was declared duly passed and adopted. Motion made by Allen Lindman and seconded by Wayne Gageby to accept the final plat of the Hipp's Second Addition, and that a Bond in the amount of $3305.00 be filed with the Village Clerk covering the grading, graveling and oil stabilizing of all streets within the boundaries of said addition and planting of boulevard trees and installation of necessary street signs, all members voting in favor of this motion, motion carried. Motion made by Paul Weekly and seconded by Wayne Gageby to accept the final plat of the Garrison's Addition, and that a'bond in the amount of $530. be filed with the Village Clerk covering the grading, graveling, oil stabilizing of all streets within the boundaries of this addition, planting of boulevard trees and installing street signs on the corner of Girard and 58th Ale. North. All members voting in favor of this motion, motion carried. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON A PROPOSED IMPROVEMENT WHEREAS, a petition of property owners has been filed in the office of the village clerk for the construction of a proposed improvement consisting of the following: Construction of sanitary sewer on Camden Avenue North between 53rd and 55th Avenues North WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $9300.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Wednesday, the 25th day of August, 1954, at 8:00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks publication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: All lots and parcels of land abutting thereon. The motion for the adoption of the foregoing resolution was duly seconded by member Paul Weekly, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Wayne Gageby, Allen Lindman and Paul Weekly; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Paul Weekly and seconded by Wayne Gageby that $1.00 be charged for all special assessment searches. Motion carried. Motion made by Wayne Gageby and seconded by Allen Lindman to accept the application of the Brooklyn Center Cab Service, subject to the acceptance of the fare rate and also subject to proof of insurance. All members voting in favor of this motion, motion carried. The Mayor announced that the meeting was open for the consideration of a proposed improvement in the village consisting of the following: Grading and oil stabilizing France Avenue North from 49th to 50th Ave. 50th Avenue North from France to Highway 100 The Clerk produced an affidavit of pblication of notice of hearing on the proposed improvement showing two weeks publication thereof in the official newspaper, the last publication being on July 22, 1954, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. The following appeared and entered objections: None; and the following appeared in favor of' said improvement: None. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Paul Weekly introduced the following resolution and moved its adoption: RESOLUTION ORDERING IMPROVEMENT BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Grading and oil stabilizing France Avenue North from 49th to 50th Ave. 50th Avenue North from France to Highway 100 Said improvement shall be hereafter designated Oil Stabilizing Improvement No. 1954 -1. The motion for the adoption of the foregoing resolution was duly seconded by member Allen Lindman, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Wayne Gageby, Allen Lindman, Paul Weekly; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Paul Weekly and seconded by Wayne Gageby giving the Northern States Power Company authority to install 2 poles on 5th Street between 67th and 68th Avenue North. Motion carried. Motion made by Allen Lindman and seconded by Paul Weekly to abate the Storm Sewer Assessments on Parcels 5400 and 5900, Auditor's Subdivision #218. Motion carried. Motion made by Paul Weekly and seconded by Allen Lindman to uphold the recommendations of the Planning Commission which was introduced by Mr. Stodghill at their meeting on July 22, 1954, reading as follows: WHEREAS, it appears to the planning commission that the probability of the lake on Pearson's Northport 1st Addition overflowing is very remote, and WHEREAS, should an overflow storm drain become necessary, we recommend that established village policy be followed in construction of such a storm drain and benefitted property owners to be assessed for said costs, and WHEREAS, the proposed lake on this plat will not be a future village liability inasmuch as the bottom of this lake will undoubtedly revert to the State through non - payment of taxes, and WHEREAS, as of this date Pearson Brothers have obligated themselves by Contract with several parties to create lakeshore property through the dredging of said lake, Now, Therefore, Be it resolved, that the Planning Commission after due consideration of the drainage problem questioned by the Village Council does strongly urge that 145 #793 Distillers Distributing Co. 794 Old Peoria Co., Inc. 795 Lynn Johnson Co. 796 Ebin Brothers Co. 797 Famous Brands, Inc. 798 James Fischbach 799 Earl W. Under these recommendations Pearson Brothers file a bond in the amount to be set by the Minder Engineering Co.,Village Engineers, to cover the costs of the Lake abutting his property and also the cost of installing streets within the plat according to the restrictions of the Platting Ordinance. All members voting in favor of this motion, motion carried. The council proposed to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Wednesday, the llth day of August, 1954, at 8:00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks publication in the official newspaper of the village. 3. The motion for the adoption of the foregoing resolution was duly seconded by member Allen Lindman, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Wayne Gageby, Alien Lindman and Paul Weekly; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted.
