of the Village of Brooklyn Center in the County of Hennepin and
State of Minnesota, including all accounts audited by said Council
October 13, 1954
The Village Council met in regular session and called to order by
Arthur Paulson, Mayor, at 8 :00 P.M.
The following members were present: Arthur Paulson, Wayne Gageby,
Glen Sonnenberg, Allen Lindman and Paul Weekly.
The minutes of the regular meeting held on September 22, 1954 were
approved as read.
Motion made by Paul Weekly and seconded by Wayne Gageby that a Cigarette
License and an Off -sale malt license be issued to Mrs. Bernice Harriet Jubert
at 5357 Emerson Ave. N. effective October 15, 1954. All members voting in favor
of this motion, motion carried.
Motion made by Paul Weekly and seconded by Allen Lindman to accept the
pettition of abutting property owners in Block One (1), Humboldt Addition,
requesting that 5 feet on either side of said alley be vacated, making this
alley twenty (20) feet in width and that a public hearing be- held on November 10,
1954. Motion carried.
Motion made by Paul Weekly and seconded by Wayne Gageby to accept the
deed of Frank R. Storest and Clara Lillian Storest for street purposes; the
north 30 feet and the east 30 feet of the West half of the North half of the
Southwest Quarter of the Southeast quarter of the Northeast quarter (W 1/2 of
N 1/2 of SW 1/4 of the SE 1/4 of the NE 1/4) of Section 2, Twp 118, Range 21,
also known as Lot 56 in Auditor's Subdivision No. 218, Hennepin County, Minnesota,
to be used by said second party as easement for road purposes. All members
voting in favor of this motion, motion carried.
Motion made by Paul Weekly and seconded by Wayne Gageby that the
Village Clerk be given authority to deposit the certified check presented by
Joseph W. Betker dated March 13, 1953 to the General Fund account of the Village.
Motion carried.
Motion made by Wayne Gageby and seconded by Alien Lindman to accept the
Justice Report presented by H. R. Jones for the month of September. Motion carried.
Motion made by Paul Weekly and seconded by Wayne Gageby requesting the
Camden Park State Bank to provide guaranty collateral in the amount of $100,000.00
for various bank accounts of the Village of Brooklyn Center. Motion carried.
Motion made by Wayne Gageby and seconded by Paul Weekly giving the
Northern States Power Co. authority to install one pole on 53rd Avenue North
west of Northport Drive. Motion carried.
Motion made by Paul Weekly and seconded by Allen Lindman to abate the
assessments on that part of Lot 21 lying South of the North 75 feet thereof and
West of Betker's Addition. All members voting in favor of this motion,motion)arried.
Motion made by Glen Sonnenberg and seconded by Allen Lindman to deny the
request of the Planning Commission to supply them with an independent professional
planning engineer to advise them in regards to the two commercial centers now
appearing before the Commission. Those voting in favor of this motion: Ayes -
Glen Sonnenberg and Alien Lindman; nayes Arthur Paulson; no vote - Wayne
Gageby and Paul Weekly. Motion carried.
Motion made by Glen Sonnenberg and seconded by Allen Lindman giving
Dan Elmer, Fire Chief, authority to use the balance of the budget appropriated
for the fire department for 1954, in the amount of $628.38 for more needed
equipment. Motion carried.

Motion made by Wayne Gageby and seconded by Glen Sonnenberg to deny
the request of the Northern States Power Co. to construct a new power transmission
line on steel towers from the west bank of the Mississippi River to their switching
station on 57th Avenue North and Shingle Creek. Motion carried.
Member Wayne Gageby introduced the following resolution and moved its

RESOLUTION MODIFYING OILING IMPROVEMENT NO. 1954 -4
WHEREAS, on September 22, 1954 at a regular meeting of the
Village Council certain work was approved to be performed which
work was described as Oiling Improvement No. 1954 -4, and
WHEREAS, it appears that due to adverse weather conditions only
a certain portion of said work can be performed within the current
calendar year, and
WHEREAS, it appears that the best interests of the village and
of the affected property owners would be served by reducing the scope
of said project onoy to such streets as will have been oiled within
this calendar year,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. Oiling Improvement No. 1954 -4 is hereby modified in that only
the following streets shall be oiled during the calendar year 1954:
62nd Ave. North between Aldrich Ave. and Lyndale Ave. North
61st Ave. between Camden Ave. and Lyndale Ave. North
59th Ave. North between Emerson and Lyndale Ave. North
Humboldt Ave. between 53rd and 55th
Emerson between 59th and 61st
Dupont between 53rd and 55th
Dupont between 58th and 61st
Colfax between 58th and 59th
Bryant Ave. between 53rd Ave. and 57th Ave.
2. The assessment roll shall be modified so as to only assess those
property owners who are benefited by the oiling of the streets set forth
above.
The motion for the adoption of the foregoing resolution was duly seconded by
member Allen Lindman, and upon vote being taken thereon the following voted in
favor thereof: Arthur Paulson, Wayne Gageby, Allen Lindman, Glen Sonnenberg,
and Paul Weekly; and the following voted against the same: None -; whereupon said
resolution was declared duly passed and adopted.
Member Paul Weekly introduced the following resolution and moved its adcption:
RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE
OF $22,500 STREET IMPROVEMENT BONDS
WHEREAS, the village council has let contracts for the construction
of Storm Sewer Improvement No. 1954 -1 and Blacktopping Improvement
No. 1954 -1, and the village has ordered the work by day labor on
Oiling Improvements Nos. 1954 -1, 1954 -2, 1954-3 and 1954-4, all under the
provisions of Chapter 398, Laws of Minnesota 1953,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. It is hereby determined that the total cost of each of the
improvements heretofore commenced is as follows:
Storm Sewer Improvement No. 1954 -1
Blacktopping Improvement No. 1954 -1
Oiling Improvement No. 1954 -1
Oiling Improvement No. 1954 -2
Oiling Improvement No. 1954 -3
Oiling Improvement No. 1954 -4
the aggregate cost thereof being determined to
be approximately
$8,000.00

2. It is hereby determined that the total cost of each of said
improvements shall be assessed upon property benefited by the improvement.
The Clerk shall forthwith calculate the proper amount to be specially
assessed for the improvements against every assessable lot, piece or
parcel of land within the district affected, without regard to cash
valuation, based upon the benefits received.
3. It is hereby determined to finance the entire cost of said
improvements by the issuance of improvement bonds.
4. There is hereby created a special fund to be designated as
Street Improvement No. 1954 -B Fund out of which shall be paid the cost of the
said improvements and the principal and interest on the Improvement Bonds
authorized hereunder and into which shall be paid all of the proceeds of
the special assessments and taxes to be levied for said improvement and
the moneys received from the sale of Improvement Bonds.
5. In anticipation of the collection of said special assessments
and taxes, the village shall forthwith issue and sell $22,500 Street
Improvement Bonds. The full faith and credit of the village shall be
pledged for the payment of the principal and interest on the bonds when
the moneys on hand in the Street Improvement No. 1954 -B Fund are
insufficient for the purpose.
6. The Improvement Bonds shall be 25 in number and numbered 1 to
25, both inclusive, in the denomination of $1000 each except for those
bonds maturing in 1961 to 1965 inclusive, which bonds will be in the
principal amount of $500 each, all of said bonds having interest payable
semi- annually commencing July 1, 1955. The bonds will mature in the
yeas and amounts as follows:
The full faith and credit of the Village will be pledged to payment of
the bonds, and there will be no option of prior payment.
7. The village council shall meet at the village hall in the
village on Wednesday, the 27th day of October, 1954, at eight o'clock
p.m., for the purpose of receiving sealed bids for the purchase of
said bonds and the village clerk is authorized and directed to cause
notice of the sale of said bonds to be given by publication ten days
in Commercial West, a financial paper published in Minneapolis,
Minnesota. Said notice shall recite that the village will furnish
printed bonds and approving legal opinion of Messrs. Faegre & Benson,
Minneapolis, Minnesota, both without expense to the purchaser,
shall require that all bids be unconditional and accompanied by a
good faith check in the amount of at least $1000.00 and shall specify
one or more interest rates in multiples of one -tenth or one- quarter
of one percent. Said notice shall further provide that delivery of
the bonds will be made by the village within forty days after the
date of sale at the office of the village clerk or, at the option
of the purchaser, at Minneapolis or St. Paul without expense to the
purchaser.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted in
favor thereof: Arthur Paulson, Wayne Gageby, Allen Lindman, Glen Sonnenberg,
and Paul Weekly; and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.

The Village Council met in Special Session and called to order by
Arthur Paulson, Mayor, at 8 :30 P.M.
The following members were present: Arthur Paulson, Wayne Gageby,
Glen Sonnenberg, Allen Lindman and Paul Weekly.
Motion made by Wayne Gageby and seconded by Paul Weekly that we
refund the sum of $57.20 to Mrs. Maud Johnson of 5435 Emerson Avenue North,
she being assessed for two sanitary sewer stubs and only one being installed.
Motion carried.
Motion made by Paul Weekly and seconded by Allen Lindman to accept
the deed presented by Arden Burguist covering his portion of the street known
as Lake Drive. Motion carried.
Motion made by Paul Weekly and seconded by Glen Sonnenberg that the
Northern States Power Co. be given permission to construct a 115,000 volt double
circuit transmission line on steel towers from the west bank of the Mississippi
River to their Brooklyn Center switching station located west of Shingle Creek
and immediately adjacent to 57th Avenue North. All members voting in favor
of this motion, motion carried.
