HomeMy WebLinkAbout1955 01-12 CCM Regular Session Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council January 12, 1955° i The Village Council met in regular session and called to order by Arthur Paulson, Mayor, at 8 :15 P.M. The following members were present: Arthur Paulson, Wayne Gageby, Allen Lindman, Glen Sonnenberg and Paul Weekly. The minutes of the regular meeting held on December 22, 1954 and of the special meeting held on December 27, 1954 wee approved as read. At this time the Village Attorney, Donald Fraser, swore in the newly elected officials, to -wit: Wayne Gageby, Trustee; H. Russell Jones, Village Clerk; Elsworth Nelson, Constable; John Nordberg, Assessor; Sylvia Nordberg, Deputy Assessor; John Wingard, Justice of the Peace. H. Russell Jones, having qualified, replaced Paul Weekly as clerk. Motion made by Wayne Gageby and seconded by Allen Lindman to allow Kenneth Bull to employ three men, two at 80¢ per hour, one at 90¢ per hour, as attendants for skating rinks, maximum hours per rink not to be over fifty -two (52) hours; Kenneth Bull to furnish names, addresses and social security numbers of the men he selects, retroactive to January 1, 1955. All members voting in favor of this motion, motion carried. Motion made by Wayne Gageby and seconded by Allen Lindman to accept the final plat of Frank Burch's 4th Addition, subject to all the restrictions of the Platting Ordinance including Turnaround easements where necessary. Motion carried. Motion made by Allen Lindman and seconded by Wayne Gageby to accept the final plat of Pearson's Northport 3rd Addition, subject to all the restrictions of the Platting Ordinance. Mottmxm duxbyxw xguAabyxax dxsa "xtlgdxbyxxIUKXRcn mxxmpt �t$ i�Sa��a�cxl �itmmkac�a�} �ttagx��ic��xx��d :xSa��t�x8������'¢xtmxx�yasg� 8s�tttistaa� x�txic3�aicxgx�sttax�ttxt�x8mzsx�m�m: stx $mnxm�xs�x�smssxs�s���ci:asa��C 15:9X xxyxtumxtuxxkaldx ckwxtlzx cxWa dmx dzyxtnxR to Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON A PROPOSED IMPROVEMENT WHEREAS, a petition of property owners has been filed in the office of the village clerk for the construction of a proposed improvement consisting of the following: Construction of a sanitary sewer main interceptor line including lift stations, manholes, meter stations and all other usual sanitary sewer appurtenances along a route described generally as follows: Commencing at the intersection of 53rd and Lyndale Avenues North; thence north along Lyndale Avenue to 73rd Avenue; and a lateral sewer main together with the usual appurtenances thereto along a route described generally as follows: Commencing at the intersection of 57th and Lyndale Avenues North, thence west along 57th Avenue to Morgan Avenue. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $305,000.00, NOW, THEREFORE, BE IT RESOLVEDYbr the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953• ICI 204 2. A public hearing on the proposed improvement shall be held at the Earle Brown School, 5900 Humboldt Ave. N., on Wednesday, the 2nd day of February, 1955, at 8 :00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks pullication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: All that area bounded on the south by 55th Avenue, on the east by the Mississippi River, on the north by 73rd Avenue, and on the west.by a line starting at 55th and Penn Avenue, then north to Highway 100, then northerly along Highway 100 to Logan Avenue, then north along Logan Avenue to 69th Avenue, .then West on 69th Avenue to Qiver Avenue, then straight north to 73rd Avenue. The motion for the adoption of the foregoing resolution was duly seconded by member Allen Lindman, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Wayne Gageby, Allen Lindman, Glen Sonnenberg and H. Russell Jones; and the Following voted against the same: None; .whereupon said resolution was declared duly passed and adopted. Motion made by Allen Lindman and seconded by Wayne Gageby to accept the Deed of Oscar A. Smith and Clara M. Smith and Howard ©. Smith and Grace Harris Smith covering a portion of Penn Avenue, 58th to 59th, described'as the East Thirty -three (33) feet of the North Three Hundred Sixty Three (363) feet of Lot Thirty Two (32), Auditor's Subdivision #218, according to the map or plat thereof on file and of record in the office of the Register of Deeds in and for Hennepin County, the above land to be used for street purposes only. Bond in the amount of $500.00, upon recommendationcf the Village Engineer, to be posted by Winston Brothers Company tocover the cost of construction of the aforementioned street. Motion carried. A petition for oil stabilizing of streets within and abutting Twin Lake Woods 2nd Addition, presented by Douglas Uzzell, was turned over to the Village Engineer for recommendation. Motion made by Wayne Gageby and seconded by Glen Sonnenberg not to release the bond covering the street work on Knox Avenue from 150 North of 54th to 55th Avenue until the street has been approved by the Village Engineer. Motion carried. Motion made by Wayne Gageby and seconded by Allen Lindman granting the Northern States Power Company authority to install 1 pole on Penn Avenue between 54th and 55th Avenues North, and 5 poles on 54th Avenue North from Oliver to Russell Avenues. Motion carried. Motion made by Allen Lindman and seconded by Wayne Gageby granting the Northwestern Bell Telephone Company authority to install 4 poles on 60th Avenue North between Beard and Xerxes, 2 poles on 59th Avenue North between Zenith and Xerxes, 1 pole at Northport Drive and 53rd Place, and 2 poles on 68th Avenue North in blocks east and west of Scott Avenue North. Motion carried. Motion made by Allen Lindman and seconded by Glen Sonnenberg to pay Peter Lametti Construction Co. for the following: Sanitary Sewer Contract No. 1954 -1 for construction of sanitary sewer on 4th Street North between 53rd and 55th. Sanitary Sewer Contract No. 1.954 -2 for construction of sanitary sewer on Irving and James Avenues North lying between 55th Avenue and 130' North of the center line of 54th. Sanitary Sewer Contract No. 1954 -3 for construction of sanitary sewer within John Ryden's Second Addition, including sewer lines on Morgan and Penn Avenues North between 53rd and 54th. Motion carried. Motion made by Glen Sonnenberg and seconded by Allen Lindman to accept the recommendation of the Planning Commission and accept the proposed plat of Joseph Sentyrz subject to all the restrictions of the Platting Ordinance, this to include Xerxes Avenue. Motion carried. Motion made by Glen Sonnenberg and seconded by Wayne Gageby to accept 205 the recommendation of the Planning Commission and give authority to J. H. >, Tollefson to sell to Pearson Bros., under metes and bounds description, the following property: "Beginning on the North line of Lot 28, Auditor's Subdivision No. 216 where it intersects the East line of Northport Drive, as platted in Pearson's Northport 2nd Addition, thence East along said North line of Lot 28, 107.58 feet; thence South at right angles 100.0 feet; thence West parallel.to the North line of said Lot 28, 100 feet, plus or minus, to the East line of Northport Drive, as platted in Pearson's Northport lst Addition; thence North along the East line of said Northport Drive to the point of beginning, all in Lot 28 Aud. Sub. #216." and giving authority to Clarence E. Johnstone to sell to Pearson Bros., under -metes and bounds description, the following property: "All that part of Lot Twenty -eight (28), Auditor's Subdivision No. 216 described as follows: Commencing at the intersection of the West right -of -way line of Minnesota State Highway-No. 152 and a line drawn parallel with and-100 feet south of, measured at right angles to the North line of said Lot 28; thence west and parallel with the North line of said Lot 28, a distance of 169.8 feet to the point of beginning of the tract to be described; thence continuing west on the same straight line to the Easterly line of Pearson's,Northport lst Addition; thence southerly along the Easterly line of Pearson's Northport lst Addition to a point 200 feet south of, measured at right angles to the North line of said Lot 28; thence east and parallel with.the North line of said Lot 28, to a point 169.8 feet west of the west right -of -way line of said State Highway No. 152; thence northerly and parallel with said right -of -way line to the point of beginning, Hennepin County, Minnesota." Motion made by Allen Lindman and s @conded by Glen Sonnenberg to accept the recommendation of the Planning Commission and give authority to Grace Lund to sell to William Tuma, by metes and bounds, a triangular plot of ground eight feet wide at the base in'order to square up Lot 4, Block 1, Garrett's Addition, said plot described as follows: "Beginning at a point in the North line of Lot 7, Guilford's Outlots, corresponding to the Northwest corner of Lot 4, Block 1, Garrett's Addition, thence South to 62nd Avenue North, thence East to the Southwest corner of Lot 4, Block 1, Garrett's Addition, thence Northwesterly along the West line of Lot 4, Block 1, Garrett's Addition to the point of beginning." Motion carried. Motion made by Wayne Gageby and seconded by Glen Sonnenberg to advertise for bids on a new village truck, plow and sander, bids to be opened at the first regular meeting in February. Motion made by Wayne Gageby and seconded by Blen Sonnenberg to have Donald Fraser contact Municipal Engineering Advisory Committee with respect to the hiring of a full time Engineer and that he proceed to advertise for same. Motion carried. Motion made by Glen Sonne.nberg'and seconded,by Allen Lindman to accept the report of the Brooklyn Center Fire Department. Motion carried.
