HomeMy WebLinkAbout1955 05-11 CCM Regular Session 245 Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council. May 11, 1955 The Village Council met in regular session and was called to order by Acting Mayor, Wayne Gageby, at 8 :15 P.M. The following members were present Wayne Gageby, Allen Lindman and H. R. Jones. Glen Sonnenberg came later in the meeting. Mayor Arthur Paulson was absent. Motion made by H. R. Jones and seconded by Allen Lindman; to accept petition for oiling 53rd Avenue North, Xerxes to the Belt Line. Motion carried. Motion made by Allen Lindman to commit the Village of Brooklyn Center to make the following improvements in accordance with the resolution heretofore identified as Improvement Commitments for VA Loan Purposes. Said resolution shall have inserted in it the following: Property to be improved: Hipp's 3rd Addition Estimated cost: $3,166.00 Date of completion: 12 months Improvements to be made: Installation of street signs, planting of trees and sodding of boulevards within the boundaries of this plat Builder: Hipp Construction Company The foregoing motion was duly seconded by H. R. Jones, and all members present voting in favor thereof, the motion was carried. Motion made by H. R. Jones to commit the Village. of Brooklyn Center to make the following improvements in accordance with the resolution heretofore identified as Improvement Commitments for VA Loan Purposes. Said resolution shall have inserted in it the following: Property to be improved: Twin Lake Woods 2nd Addition Estimated cost: $64o0.00 Date of completion: 12 months Improvements to be made: Grading, graveling and oil stabilizing of all streets within the boundaries of this plat Builder: Douglas Uzzell The foregoing motion was duly seconded by Allen Lindman, and all members present voting in favor thereof, the motion was carried. Motion made by H. R. Jones and seconded by Allen Lindman not to release the bond covering the street work on Knox Avenue from 150 feet north of 54th to 55th Avenue until the street has been approved by the Village Engineer. Motion carried. Motion made by Allen Lindman and seconded by H. R. Jones that the Village purchase annually a reverse directory, Minneapolis Street Address Telephone Directory, at $30.00 per year. Motion carried. The acting Mayor announced that the meeting was open for the consideration of a proposed improvement in the Village consisting of the following: Construction of Sanitary Sewer in the following designated areas: On Osseo Road and Zenith and Abbott Avenues North from 49th Avenue North to a point approximately 350 feet North of 50th Avenue North; On Beard Avenue North from 49th Avenue North to 50th Avenue North; On 49th and 50th Avenues North from Osseo Road to Beard Avenue North. 246 The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 5, 1955, which affidavit was examined and found satisfactory and ordered placed on file. The acting Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. There being no objections to said proposed improvement and a majority of the property owners appearing in favor of said improvement, member H. R. Jones introduced the following resolution and moved its adoption: RESOLUTION ORDERING IMPROVEMENT AND DETAILED PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn venter, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefited thereby that the following improvement shall be constructed: Sanitary Sewer in the following designated areas: On Osseo Road and Zenith and Abbott Avenues North from 49th Avenue North to a point approximately 350 feet North of 50th Avenue North; On Beard Avenue North from 49th Avenue North to 50th Avenue North; On 49th and 50th Avenues North from Osseo Road to Beard Avenue North. Said improvement shall be hereafter designated Sanitary Sewer Improvement No. 1955 2. The Minder Engineering Company shall forthwith prepare plans and specifications for said improvements which shall be filed with the Clerk. The motion for the adoption of the foregoing resolution was duly seconded by member Allen Lindman, and upon vote being taken thereon the following voted in favor thereof: Wayne Gageby, Allen Lindman and H. R. Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The hearing on the proposed construction of Sanitary Sewer on Queen and Russell Avenues North from 53rd Avenue North to a point approximately 200 feet North of 53rd Avenue North, and the Council having heard those persons who were opposed and those persons who were in favor of said improvement, it is hereby determined that this matter lay over until a later meeting of the Village Council. I i 7 The motion for the adoption of the foregoing resolution was duly seconded by member Allen Lindman, and upon vote being taken thereon the following voted in Favor thereof: Wayne Gageby, Allen Lindman and H. R. Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Allen Lindman and seconded by H. R. Jones to uphold the recommendation of the Planning Commission and allow the Sons Co. to build homeswithin 8 feet of the property line on Lots 22, 23, 24 25, 26 and 27, Block 6, Balfany's Northport lst Addition. Motion carried. Motion made by H. R. Jones and seconded by Allen Lindman to uphold the recommendation of the Planning Commission and accept the proposed plat submitted by Phil Dover, subject to the Platting Ordinance, temporary turnaround to be provided at the south end of Lakeview Avenue. Motion carried. Motion made by H. R. Jones and seconded by Allen Lindman to uphold the recommendation of the Planning Commission and approve corrected proposed plat for Homedale Builders. Motion carried. Motion made by Allen Lindman and seconded by H. R. Jones to accept the final plat of Homedale First Addition, subject to all the restrictions of the Platting Ordinance, and the Mayor and Clerk authorized to sign the same, bond to be posted. Motion carried. Motion made by H. R. Jones and seconded by Allen Lindman to uphold the recommendation of the Planning Commission and approve special permit to Henry Christian to build a 30 foot house on 40 foot lot, Lot 9, Block 2, Fairhaven Park Addition. Motion carried. Motion made by Allen Lindman and seconded by H. R. Jones to uphold the recommendation of the Planning Commission and issue special permit to Kenneth Bergstrom to build within 8' 10" of the North property line. Motion carried. Motion made by H. R. Jones and seconded by Allen Lindman to accept the justice report of Aldor Johnson for the month of April, 1955.. Motion carried. Motion made by H. R. Jones and seconded by Allen Lindman that we set the date for meeting of Board of Review for June 17, 1955 at 8:00 P.M. at the Village Hall of Brooklyn Center and advertise same in the official Village newspaper as required by law. Motion carried. Motion made by H. R. Jones and. seconded by Allen Lindman to allow Penn Realty Company to place an advertising sign, for a period of twelve months, at 57th and Penn and Highway 100, said sign not to exceed the size of existing signs at the intersection of Highways 100 and 152. Motion carried. Motion made by H. R. Jones and seconded by Glen Sonnenberg to authorize E. C. Peterson to have the chimney on the Municipal Building raised. Motion carried. Motion made by H. R. Jones and seconded by Glen Sonnenberg to bill Harold Johnson for street grading. Motion carried. Motion made by H. R. Jones and seconded by Glen Sonnenberg to bill Harold Aurness for street grading. Motion carried. Motion made by Allen Lindman and seconded by Glen Sonnenberg to instruct Village Attorney to draw up amendment to the Zoning Ordinance creating a multiple dwelling classification. Motion carried. Motion made by H. R. Jones and seconded by Glen Sonnenberg to uphold the recommendation of the Planning Commission and to adopt the following ordinance: THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER, MINNESOTA DO ORDAIN AS FOLLOWS: 1. Section 3.40 of the Zoning Ordinance of the Village of Brooklyn Center is amended by striking therefrom the following language: I 248 d Commencing at the Southwest corner of the Northeast Quarter of Section 34, Township 119, Rnage 21, Hennepin County, Minnesota; thence North along the West line of said Northeast Quarter 392.47 feet; thence Fast parallel with the North line of said quarter section 1317.9 feet to the Fast line of said Northeast Quarter of said Section; thence along the East line of said Section 392.47 feet to the Southeast corner of said Northeast Quarter; thence West along the South line of said Northeast Quarter to the point of beginning. 2.
