Minutes of the proceeding of the Village Council
of the Village of Brooklyn Center in the County
of Hennepin and State of Minnesota, including all
accounts audited by said Council
June 8, 1.955
The Village Council net in regular session and was called to order
by Arthur Paulson, Mayor, at 8:10 P. M.
The following,members were present: Arthur Paulson, Glen Sonnenberg,
Wayne Gageby, Allen Lindman and H. R. Jones.
The minutes of the meetings of May 25, May 26, and May 31_ were read
and approved.
Motion made by Glen Sonnenber and seconded by Wayne Gageby to up-
hold the recommendation of the Planning Commission to grant request of J. D.
Campbell and Louis Matson to. sell the zest 79 feet of their lots at 5301 Osseo
Road and 5309 Osseo Road, respectively. Motion carried.
Motion made by Wayne Gageby and seconded by Glen Sonnenberg to up-
hold the recommendation of the Planning Commission and deny petition of Wesley
Omod.t for rezoning from open development to commercial a parcel_ of land at
5000 Drew Avenue North for the purpose of operating a root beer drive -in.
Motion carried.
Motion made by Glen Sonnenberg and seconded by Allen Lindman to up-
hold the recommendation of the Plannin Commission and approve special permit
to David Brandvold to build a 14 x 26 addition to north side of his house at
5713 Irving Avenue North, said addition to be within 5 feet of north line,
which line is the south line of the Northern States Power Company right -of -way.
Motion carried.
Motion made by Wayne Gageby and seconded by Glen Sonnenberg to up-
hold the recommendation of the Planning; Commission relative to request of
property owners on 66-1 Avenue North asking that Chowen Avenue be extended from
its present termination at about 66th Avenue.to 67th Avenue so that these own-
ers can get gas service. The Village Engineer is instructed to look over the
situation. Motion carried.
Motion made by Wayne Gageby and seconded by H. R. Jones to uphold
the recommendation of the Planning Commission and allow Fred L. Hoppe to sell
by metes and bounds description_ two parcels of land on Noble Avenue as follows:
"A tract of land Ti in the northwest quarter (NWT) of the
southwest quarter ) of section twenty - seven, township one
hundred nineteen north, range twenty -one west (5 -27, T- 119 -N,
R -21W), Village of Brooklyn Center, County of Hennepin, State
of Minnesota, more particularly described as follows:
Beginning at a point located one hundred seventy -two and
five- tenths (172.5) feet north N from the southwest (SW) cor-
ner of said northwest quarter (NWW) of the Southwest quarter
(SW -,' -) of Section twenty -seven (5 -27) and on the west (W) line
of said northwest quarter (NW, -) of the southwest quarter (SW4)
of Section twenty -seven (27); thence northerly (N) along said
west (W) line of the northwest quarter (NW4) of the southwest

Motion made by H. R. Jones and seconded by Wayne Gageby to adopt
the following ordinance:
AN ORDINANCE AMENDING THE ORDINANCE
REGULATING DISPOSAL OF GARBAGE AND
REFUSE TO RESTRICT THE BURNING OF
RUBBISH
Upon vote being taken on the adoption of the foregoing ordinance, the fol-
lowing voted in favor thereof: Arthur Paulson, Wayne Gageby, Allen Lind -
man and H. R. Jones; and the following voted against the same: Glen
Sonnenberg; whereupon said ordinance was declared duly passed and adopted.
Member Wayne Gageby introduced the following resolution and moved
its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING
ON A PROPOSED IMPROVEMENT
WHEREAS, a petition of property owners has been filed in the of-
fice of the village clerk for the construction of a proposed improve -
ment consisting of the following:
Installation of curbs and gutters, and grading, stabilizing
and blacktopping 57th Avenue North between Highway 100 and
Lyndale Avenue North.
WHEREAS, the village engineer has made a preliminary report advis-
ing that said proposed improvement is feasible and that it can be con -
structed at an estimated cost of 60,000.00,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Vil-
lage of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953.
2. A public hearing on the proposed improvement shall be held at
the Village Hall in the village on Wednesday the 22nd day of June,
1955, at 8:00 o'clock P. M., and the clerk shall publish notice of the
time and place of hearing by two weeks publication in the official news-
paper of the village.
3. The area proposed to be assessed for said improvement is as fol-
lows:
All lots and parcels of land lying within a distance of 630
feet on either side of 57th Avenue North between Highway 100
and Lyndale Avenue North.

The :notion for the adoption of the foregoing resolution was duly seconded
by member H. R. Jones, and upon vote being taken thereon the following voted in
favor thereof: Glen Sonnenberg, H. R. Jones, Allen Lindman, Art Paulson, and
j Wayne Gageby; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
IMotion made by Glen Sonnenberg and seconded by Wayne Gageby to authorize
another telephone extension in the Village office. Motion carried.
Member H. R. Jones introduced the following resolution and moved its
adoption:
WHEREAS, it is necessary, advisable and in the public interest that
the Village of Brooklyn Center extend the east side of Drew Avenue
North as a public street from Highway 100 to a point 250 feet north
thereof, more or less, and
-WHEREAS, in order to accomplish such purpose it is necessary to
acquire an easement in the following described land, namely:
The West Thirty (30) feet of the following described par -
eels:
North One hundred fifty (150) feet of the South One hun-
dred eighty -three (183) feet of the West One hundred sixty -
five (165) feet of the Northeast 1/4 of the Southwest 1/4
of the Northeast 1/4 except State Highway 100, Section Ten
(10), Township One Hundred Eighteen (118), Range Twenty -
one (21).
That part of the West One hundred sixty -five (165) feet of
the Northeast 1 of the Southwest 1/4 of the Northeast 1/4
lying south of the north Three hundred seventy (370) feet
thereof and north of the south One hundred eighty -three
(183) feet thereof, except State Highway 100, Section Ten
(10), Township One Hundred Eighteen (118), Range Twenty -one
(21),
AND WHEREAS, the Village Council is advised and believes that the most
feasible through thoroughfare necessary to the development of the Vil-
lage is on the land above described, and
WHEREAS, it has become necessary to procure an easement in such lands
by right of eminent domain, NOW THEREFORE,
BE IT RESOLVED, That the Village of Brooklyn Center proceed to pro-
cure an easement for street purposes in such land under its right of
,.eminent domain and that the Village attorney be instructed and di-
rected to file the necessary Petition therefor and to prosecute such
,action to a successful conclusion or until it is abandoned, dismissed
or terminated by the Village or by the Court; that the Village attorney,
the Mayor and the Clerk do all things necessary to be done in the com-
mencement, prosecution and successful termination of such action.
