HomeMy WebLinkAbout1955 06-29 CCM Special Session 270 Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council June 29, 1955 The Village Council met in special session, a continuation of adjourned meeting of May 11, and was called to order by Arthur Paulson, Mayor, at 8:15 P.M. The following members were present: Arthur Paulson, Wayne Gageby, Allen Lindman, Glen Sonnenberg and H. R. Jones. Motion made by Wayne Gageby and seconded by H. R. Jones to adopt the following ordinance: AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF BROOKLYN CENTER BY DESIGNATING CERTAIN LAND AS COMMERCIAL AND RESIDENTIAL. THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS: 1. The Zoning Ordinance of the Village of Brooklyn Center is hereby amended by zoning the following described land to commercial and adding said description to Section 3.40 of said ordinance: Lot 49, Auditor's Subdivision No. 216 That part of Lots 50, 51, 52, 53, 5 4 , 55 and 56, Auditor's Subdivision No. 216, lying East of the West 225 feet thereof That part of Lot 57, Auditor's Subdivision No. 216, lying West of State Highway 100 and East of the West 225 feet thereof Lots 10 and 11, Auditor's Subdivision No. 218 That part of Lots 12, 13, 14, 15 and 16, Auditor's Subdivision No. 218, lying West of Highway 100 2. The Zoning Ordinance of the Village of Brooklyn Center is hereby amended by zoning the following described land to residential and adding said description to Section 3.20 of said ordinance: The West 225 feet of Lots 50, 51, 52, 53, 54, 55, 56 and 57, Auditor's Subdivision No. 216 3. This ordinance shall take effect from and after its publication. Motion carried. ' Motion made by Allen Lindman and seconded by Glen Sonnenberg to adjourn. Motion carried. The Village Council reconvened at 8 :50 P.M. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BIDS AND APPROVING CONTRACT FORM BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the bid of John W. Horbal as to the furnishing of all work, labor and material in connection with Sanitary Sewer Improvement No. 1955 -3, according to the plans and specifications therefor now on file in the office of the Village Clerk, is deemed to be the lowest and best bid submitted for said work by a responsible bidder, and said bid is hereby accepted. BE IT FURTHER RESOLVED that the form of contract proposed for execution between the Village and John W. Horbal is approved, and the Mayor and Village Clerk are hereby authorized and directed to execute the same on I i behalf of the village upon the filing with the Village Clerk of a bond with an approved corporate surety in the amount of $20,179.72 conditioned for the faithful performance of the said contract. The motion for the adoption of the foregoing resolution was duly seconded by member H. R. Jones, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Wayne Gageby, Allen Lindman and H. R. Jones; and the following voted against the same: Glen Sonnenberg; the majority voting in favor thereof, said resolution was declared duly passed and adopted. Motion made by H. R. Jones and seconded by Allen Lindman that we establish a sanitary sewer rate of $5.70 per quarter per house connection, effective as of January 1, 1955. Motion carried. Motion made by Allen Lindman to commit the Village of Brooklyn Center to make the following improvements in accordance with the resolution heretofore identified as Improvement Commitments for VA Loan Purposes. Said resolution shall hae inserted in it the following: Property to be improved: Brook Park Addition Estimated cost: $5466.o0 Date of completion: 12 months, Improvements to be made: Grading, graveling and oil stabilizing of all streets within the boundaries of this,plat; also planting of one boulevard tree per lot, and installation of necessary street name signs. Builder: Joseph F. Dahinden and Mary Dahinden The foregoing motion was duly seconded by Glen Sonnenberg, and all members present voting in favor thereof, the motion was carried. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON A PROPOSED IMPROVEMENT WHEREAS, a petition of property owners has been filed in the office of the village -clerk for the construction of a proposed improvement consisting of the following: Avenue North Grading and oil stabilizing of N G 5 g g 2nd Aven between France Avenue and Lake Place; and of Greatview Avenue North between 52nd and 53rd Avenues WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $5,000.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953• 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Wednesday, the 27th day of July, 1955, at 8 :00 o'clock P.M., and the Clerk shall publish notice of the time and place of hearing by two weeks publication in the official newspaper of the village. The area proposed to be assessed for said improvement is as follows: All lots and parcels of land abutting thereon. t he motion for the adoption of the foregoing resolution was duly seconded by ! member H. R. Jones, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Allen Lindman, Wayne Gageby, Glen Sonnenberg and H. R. Jones; and the following voted against the same: None; whereupon said resolution was declared dul passed and adopted. y p p 272 Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON A PROPOSED IMPROVEMENT WHEREAS, a petition of property owners has been filed in the office of the village clerk for the construction of a proposed improvement consisting of the following: Blacktopping Twin Lake Boulevard between 53rd Avenue North and northern extremity of Twin Lake - Boulevard WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $7,000.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Wednesday, the 27th day of July, 1955, at 8 :00 o'clock P.M., and the Clerk shall publish notice of the time and place of hearing by two weeks publication in the official newspaper of the village. 3. Jones that Truman Nelson be authorized to sign checks for the check cashing fund for the Special Liquor Store Account during the vacation periods of James R. Fischbach, and the Camden Northwestern State Bank be so notified. Motion carried. Arthur Paulson made the following appointment: Weed Inspector - Arthur E. Swanson Motion made by H. R. Jones and seconded by Glen Sonnenberg that the appointment of Arthur E. Swanson as Weed Inspector at a salary of $125.00 for the season, made by Arthur Paulson, Mayor, be accepted. Motion carried.
