HomeMy WebLinkAbout1955 07-18 CCM Special Session 278 MINUTES of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council July 18, 1955 The Village Council met in special session and was called to order by Arthur Paulson, Mayor, at 8 :30 P.M. The following members were present: Arthur Paulson, Wayne Gageby, Glen Sonnenberg and H. R. Jones. Allen Lindman was absent. Motion made by Glen Sonnenberg and seconded by Wayne Gageby to renew service agreement with Remington Rand for the period August 15, 1955 to August 15, 1956. Motion carried. Motion made by Wayne Gageby and seconded by Glen Sonnenberg to approve application of Carl Cahlander for license to operate dymp for six months ending Decwmber 31, 1955 and that a license be issued to said party. ,Motion carried— Motion made by Glen Sonnenberg and seconded by H. R. Jones to release bond of James Wichterman & Son to blacktop the street and sod the boulevard on Knox Avenue North between 54th and 55th Avenues North.. Motion carried. Motion made by Wayne Gageby and seconded by,_G1en Sonnenberg to release bond of Harold L. Johnson for grading and surfacing East half. of Girard and South half of 58th Avenue, Fremont to Girard. Motion carried. Motion made by Wayne Gageby and seconded by Glen Sonnenberg to release bond of Hipp Construction Company for surfacing and oiling-of streets, planting of boulevard trees and installation of street signs in connection, with extension of Irving Avenue North between 55th aad 57th Streets and extension of 56th atv4p t North for 170 feet west of Irving Avenue North. Motion carried. Motion made by Glen Sonnenberg and seconded by Wayne Gageby to release bond of Hipp Construction Company for surfacing and grading of Street Extension from the North ? of Meri -Dale Addition North on James Avenue North to 55th t and Extension from the North Line of Meri -Dale Addition a distance of 234 feet on Irving Avenue North between 54th and 55th 6,tvots (known as Rockwell's 1st and 2nd Additions). Motion carried. Motion made by Glen Sonnenberg and seconded by H. R. Jones that the Village enter into an agreement with Winston Bros. Company wherein Winston Bros. Company guarantees payment of all special assessments on property owned by the University of Minnesota, and that the Mayor and Clerk be authorized to execute the same., Motion carried. Member H. R. Jones introduced the following resolution and moved its adoption:, RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FORM BE IT RESOLVED by the Village,Council of the Village of Brooklyn Center, Minnesota, that the bid of Lametti & Sons, Inc. as to the furnishing of all work, labor and material in connection with Sanitary Sewer Improvement No. 1955 -1 according to the plans and specifications therefor now on file in the office of the Village Clerk is deemed to be the lowest and best bid submitted for said work by a responsible bidder, and said bid is hereby accepted. BE IT FURTHER RESOLVED that upon the receipt from the Dayton Company of a letter stating that they will grant an easement over the route which correspondstD Vincent Avenue extended between Highway 100 and 57th Avenue North, the Mayor and Clerk are hereby authorized and directed to execute the form of contract proposed for execution between the village and Lametti & Sons, Inc. which form is hereby approved, subject, however, to the filing with the village clerk of a bond with an j approved corporate surety in the amount of $307,326.31 conditioned for the faithful performance of said contract. 2!9 The motion for the adoption of the foregoing resolution was duly seconded by member Glen Sonnenberg, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Wayne Gageby, Glen Sonnenberg and H. R. Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Glen Sonnenberg and seconded by H. R. Jones to authorize Minder Engineering Co. to hire resident inspector for supervision and inspection of Sanitary Sewer Improvement No. 1955 -1. Motion carried. Member Glen Sonnenberg introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BIDS AND APPROVING CONTRACT FORM BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the bid of Gust A. Holm as to the furnishing of all work, labor and material in connection with Street Improvement No. 1955 -4, according to the plans and specifications therefor now on file in the officeof the Village Clerk, is deemed to be the lowest and best bid submitted for said work by a responsible bidder, and said bid is hereby accepted. BE IT FURTHER RESOLVED that the form of contract proposed for execution between the Village and Gust A. Holm is approved, and the Mayor and Clerk are hereby authorized and directed to execute the same on behalf of the Village upon the filing with the Village Clerk of a bond with an approved corporate surety in the amount of $10,092.50 conditioned for the faithful performance of the said contract. The motion for the adoption of the foregoing resolution was duly seconded by member H. R. Jones, and upon vote being taken thereon the following voted in favor thereof: Arthur Paulson, Wayne Gageby, Glen Sonnenberg and H. R. Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member H. R. Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON A PROPOSED IMPROVEMENT WHEREAS, a petition of property owners has been filed in the office of the village clerk for the construction of a proposed improvement consisting of the following: Installation of sanitary sewer lateral along North Lilac Drive from its intersection with 50th Avenue North for a distance of 850 feet northeast. WHEREAS, the village engineer hasme.de a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $3000.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953• 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Wednesday, the 10th day of August, 1955, at 8:00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks publication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: All lots and parcels of land abutting thereon. The motion for the adoption of the foregoing resolution was duly seconded by member Glen Sonnenberg, and upon vote being taken thereon the following voted ICI 280 in favor thereof: ARthur Paulson, Wayne Gageby, Glen Sonnenberg and H. R. Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. y . Motion made by H. R. Jones and seconded by Glen Sonnenberg to accept the application for Cigarette License from Klein Foods, and that Cigarette License be approved and issued to said party. Motion carried. Motion made by H. R. Jones and seconded by Glen Sonnenberg to accept the application for Non - Intoxicating Malt Liquors from Klein Foods, and that Non Intoxicating Malt Liquors License be approved and issued to said party. Motion carried. Motion made by H. R. Jones and seconded by Glen Sonnenberg to complete the survey asked for by Crystal Village, copy of completed survey to be sent to the Village upon its completion. Motion made by Glen Sonnenberg and seconded by H. R. Jones to complete the survey asked for by the League of Minnesota Municipalities, copy of completed, survey to be sent to the Village upon its completion.
