Minutes of the proceeding of the Village Council
of the Village of Brooklyn Center in the County
of Hennepin and State of Minnesota, including all
accounts audited by said Council
August 10, 1955
The Village Council met in regular session and was called to order

by Arthur Paulson, Mayor, at 8 :00 P.M.
The following members were present: Arthur Paulson, Glen Sonnenberg,
Wayne Gageby, Allen Lindman and H. R. Jones.
The minutes of the regular session of July 27, and the special session
of August 3 were read and approved.
The Mayor announced that the meeting was open for the consideration
of a proposed improvement in the village consisting of the following:
Installation of sanitary sewer lateral along North
Lilac Drive from its intersection with 50th Avenue North
for a distance of 850 feet northeast.
The Clerk produced an affidavit of publication of notice of hearing
on the proposed improvement showing two weeks publication thereof.in the official
newspaper, the last publication being on August 4, 1955, which affidavit was
examined and found satisfactory and ordered placed on file.
The Mayor then called upon all property owners present to present arguments
either for or against the proposed improvement. There being no objections, member
Wayne Gageby introduced the following resolution and moved its adoption:
RESOLUTION ORDERING IMPROVEMENT AND APPROVING PLANS AND
SPECIFICATIONS AND AUTHORIZING CONTRACT FOR SAID IMPROVEMENT
BE IT RESOLVED by the Village Council of the Village of Brooklyn Center,
Minnesota, as follows:
1. It is hereby determined that it is necessary and for the best
interests of the village and the owners of property specially benefited
thereby that the following improvement shall be constructed:
Installation of sanitary sewer lateral along North
Lilac Drive from its intersection with 50th Avenue North
for asdistance of 850 feet northeast.
Said improvement shall be hereafter designated Sanitary Sewer Improvement
No. 1955 -8.
2. The plans and specifications for said improvement heretofore
prepared by Minder Engineering Co., Engineer, are hereby approved and
ordered filed with the Clerk.
3. The officers of the Village are authorized to contract for said
i improvement with John Horbal at a cost of $2,,624.10.
4. It is hereby determined that the to f Sanitary Sewer
Improvement No. 1955 -8 is $3000.00, of which t o shall be paid by
,1 the municipality and rree shall be assessed upon property benefited
by the improvement.
5. The Clerk with the assistance of the engineer shall forthwith
calculate the proper amount to be specially assessed for the improvement
against every assessable lot, piece or parcel of land within the district
affected, without regard to cash valuation, based upon the benefits
received.
6. Said improvement shall be financed from the proceeds from the
sale of the bonds in the amount of $497,000 heretofore advertised for sale, bids
to be opened on August 17, 1955•
The motion for the adoption of the foregoing resolution was duly seconded by member
Glen Sonnenberg, and upon vote being taken theeon the following voted in favor
thereof: Arthur Paulson, Glen Sonnenberg, Wayne Gageby, Allen Lindman and

H. R. Jones; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Motion made by Glen Sonnenberg, seconded by H. R. Jones, to uphold
the recommendation of the Planning Commission that no corner of the proposed
residence on Tract P and the North half of Tract Q, registered Land Survey
No. 40, be closer to the street line than 68 feet nor less than the minimum
distance specified by Section 35.41 of the Zoning Ordinance from the side lot
line. Motion carried.
Motion made by H. R. Jones, seconded,by Glen Sonnenberg to uphold
the recommendation of the Planning Commission to approve the proposed plat
submitted by Frank Burch, said plat subject to the usual conditions of the
Platting Ordinance. Motion carried.
Motion made by Glen Sonnenberg, seconded by Wayne Gageby.to uphold
the recommendation of the Planning Commission to approve the sale of the
Westerly 135 feet of Elmer Seburg's at 5323 Osseo Road by metes and bounds
description subject to the dedication of 'the Southwest corner for street purposes
and the usual provisions of the Platting Ordinance. Motion carried.
Motion made by Allen Lindean, seconded by Wayne Gageby to uphold
the recommendation of the Planning ommission in approving the proposed plat
submitted by J. E. Sandahl subject to tae usual provisions of the Platting
Ordinance. Motion carried.
Motion made by H. R.,Jones, seconded by Glen Sonnenberg to uphold the
recommendation of the Planning ommission in approving the sale of three lots by
George Seeman, 5 046 Drew Avenue North, under metes and bounds description subject
to obtaining the deed tothe land for service road parallel to Highway 100 and the
usual provisions of the Platting Ordinance. Motion carried.
Motion made by Wayne Gageby, seconded by Glen Sonnenberg to accept the
petition for vacating alley between Emerson and Fremont Avenue North from 55th to
56th Avenues North. Public hearing was set for September 14, 1955. The Village
Attorney was instructed to publish same. Motion carried.
Motion made by H. R. Jones, seconded by Wayne Gageby to accept the
Justice of Peace report for June, 1955. Motion carried.
Motion made by Allen Lindman to commit the V illage of Brooklyn Center
to make the following improvements in accordance with the resolution heretofore
identified as Improvement Commitments for VA Loan Purposes. Said resolution
shall have inserted in it the following:

Property tote improved: The East one -half of June Avenue from 63rd
Avenue to the North line of Wangstad's Brooklyn Terrace
Estimated cost: $710
Date of completion: 12 months
Improvements to be made:
Grading, graveling and oil stabilizing of all streets
within the boundaries of said property
Builder: Kenneth L. Bergstrom
The foregoing motion was duly seconded by Wayne Gageby, and all members present

voting in favor thereof, the motion was carried.
Motion made by Glen Sonnenberg, seconded by Allen Lindman to pay the
membership dues in the League of Minnesota Municipalities for the year beginning
September 1, 1955, in the amount of $132. Motion carried.'
Motion made by H. R. Jones, seconded by Glen Sonnenberg, to approve the
cost of printing and cut of voting precinct map made on the back of Emergency
Telephone Cards to be y

Motion made by Wayne Gageby, seconded by H. R. Jones, that-the following
property be inserted in the revision of the present Zoning Ordinance as listed:
Frank Burch's Third Addition, Gilbertson Acres, John W. Nyberg's 2nd Addition,
Hoffman Addition, Pearson's Northport, Balfany Northport lst Addition, Pearson's
Northport 2nd Addition, Lawnridge Addition, Nordstrom lst Addition, Burch's 4th
Addition, Pearson's Northport 3rd Addition, Fair Meadows Addition, Homedale lst
Addition, Hipp's 3rd Addition, Bergstrom's Delphian Gardens, Miller's Northview

Motion made by Wayne Gageby, seconded by Allen Lindman, to advertise
for bids to supply the Village of Brooklyn Center with gas and oil for Village
use. Motion carried.
Motion made by H. R. Jones, seconded by Wayne Gageby that the Village
Clerk be instructed to apply for an advance of $10,000 from the County Auditor.
Motion carried.
Motion made by H. R. Jones, seconded by Glen Sonnenberg, to transfer
$20,000 from Storm Sewer #1 to 1955-A Fund. This sum of $20,000 shall be used
to pay the estimate of John Horbal on Sanitary Sewer #1955 -3 and the estimate
of Sandstrom and Hafner for Sanitary Sewer 1955 -2• This sum of $20,000 shall
be in anticipation of the sale of bonds for the above mentioned Sanitary Sewer
project and upon the sale of said bonds, Storm Sewer #1 Fund shall be reimbursed
the sum of $20,000. Motion carried.
Motion made by H. R. Jones, seconded by Wayne Gageby, to allow Klein
Supermarket to erect three signs in the Village of Brooklyn Center, same signs to
be taken down by the last of August. Motion carried.
Motion made by H. R. Jones, seconded by Glen Sonnenberg to` notify
the county that we will submit a claim for reimbursement from the county for
relief expenditures in excess of 1 mill for the years 1952 thru 1954' if'other
communities do the same. Motion carried.
Motion made by H. R. Jones, seconded by Glen Sonnenberg to buy a
Royal Typewriter, expenditure for same to be taken from the Liquor Store Funds.
Motion carried.
Motion made by Glen Sonnenberg and seconded by H. R. Jones to authorize
the hiring of additional help for making }gyp the assessment rolls. Hiring to
be done by A. J. Lee and E. C. Petemn. Motion carried.
Motion made by Glen Sonnenberg and seconded by Wayne Gageby to hire
Minder Engineering Company to make up the assessment rolls for Improvements
Nos. U5 -1, 1955 -3, 1955 -4 and 1955 -6 at a cost of 1,% of the construction cost.
Motion carried.
