Adjournment MINUTES OF THE PROCEEDINGS OF THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA SPECIAL SESSION NOVEMBER 23, 1987 CITY HALL CALL TO ORDER The Brooklyn Center Economic Development Authority met in special session and was called to order by Chairman Dean Nyquist at 10:46 p.m. ROLL CALL Chairman Dean Nyquist, Commissioners Gene Lhotka, Celia Scott, Bill Hawes, and Rich Theis. Also present were EDA Director Gerald Splinter, Finance Director Paul Holmlund, Director of Planning and Inspection Ron Warren, Director of Public Works Sy Knapp, City Attorney Charlie LeFevere, HRA Coordinator Brad Hoffman, and Personnel Coordinator Geralyn Barone. APPROVAL OF MINUTES - NOVEMBER 9 1987 There was a motion by Commissioner Hawes and seconded by Commissioner Scott to approve the minutes of the November 9, 1987, Economic Development Authority meeting as submitted. The motion passed unanimously. DISCUSSION ITEM ELECTING OFFICERS FOR THE BROOKLYN CENTER ECONOMIC DEVELOPMENT AUTHORITY The EDA Director reviewed the memorandum to him from Brad Hoffman dated November 16, 1987. There was a motion by Commissioner Lhotka and seconded by Commissioner Hawes to appoint Chairman Dean Nyquist as President and Treasurer of the EDA, and Commissioner Rich Theis as Vice President of the EDA. The motion passed unanimously. RESOLUTION NO. 87 -09 Member Gene Lhotka introduced the following resolution and moved the following adoption: RESOLUTION AUTHORIZING THE TREASURER AND ASSISTANT TREASURER TO SIGN CHECKS FOR THE ECONOMIC DEVELOPMENT AUTHORITY IN AND FOR THE CITY OF BROOKLYN CENTER The motion for the adoption of the foregoing resolution was duly seconded by member Bill, Hawes, and the motion passed unanimously. Attached are the recommendations for work to be performed on the home. I recommend approval by the EDA. The information contained in this memo is private and not available to the general public. RESOLUTION APPROVING THREE (3) BROOKLYN CENTER ECONOMIC DEVELOPMENT AUTHORITY GRANTS WHEREAS, the Brooklyn Center Economic Development Authority established a Home Rehabilitation Grant Program to assist low and moderate income individuals in the maintenance and repair of their homes; and WHEREAS, the Brooklyn Center Economic Development Authority has received three (3) applications from an eligible individual to receive grant assistance; and WHEREAS, an inspection by the City of Brooklyn Center has determined that the work is necessary and appropriate under the Brooklyn Center Economic Development Authority Grant Program; and WHEREAS, the estimated cost of the proposed grant applications is estimated at $24,750. NOW, THEREFORE, BE IT RESOLVED by the Brooklyn Center Economic Development Authority that: 1. The Brooklyn Center Economic Development Authority does approve the three (3) housing rehabilitation grant applications as recommended by the staff. 2. That the work be performed as recommended in the confidential memorandum dated December 11, 1987, and that the applicant be directed to obtain the necessary bids for staff review and approval. 3. The project shall not exceed the grant limit of $8,250 per house. Housing Rehabilitation Grant "Housing rehabilitation grant" or "grant" means the commitment of funds on behalf of recipients for the purpose of making eligible improvements to eligible properties, as described in Sections IV and V of these Procedural Guides. B. Recipient "Recipient" means an individual or household meeting the requirements of Section VI who applies for and receives a grant. C. Grant Package The "grant package" consists of all documents listed below and explained in Section VII. 1. Homeowner Application for Grant 10. Mortgage Status Verification 2. Completion Certificate 9. Title Verification 18. Complaint Record (if needed) D. Resident Resident means a person, other than a renter, living in the household for at least nine months of the year. E. Household Gross Income "Hou eho s ld gross income " means the annual income of all residents of the 9 recipient's household, as determined in accordance with Section VI. F. Assets "Assets" means the assets of a recipient as determined in accordance with Section VI. G. Handicapped Person "Handicapped person" means a person who has a permanent physical condition which substantially reduces such person's ability to function independent- ly in a residential setting, or which substantially limits such person's ability to become employed or to participate in the community. A person with a condition such as chronic emphysema, arthritis, heart disease and i r other "invisible" conditions not requiring the use of devices to increase mobility shall not be deemed a handicapped person, unless a licensed phy_ sician verifies in writing that such person's condition does substantial- y limit his or her ability to function independently in a residential set- ting or to become employed or to participate in the community. H. Accessibility Improvements "Accessibility improvements" include structural improvements, exterior im- provements, bathroom improvements, kitchen improvements,`and other improve - ments to one or two unit dwellings, which are necessary to enable a handi- capped person to function independently in a residential setting. I. Grant Administrator The "grant administrator" means the person and /or agency processing the grant. J. The City The "city" means the administering agency processing the grant. 2 i II. CONDITIONS GOVERNING ADMINISTRATION A. Amendments; Directives These Procedural Guides may be amended or supplemented from time to time by Hennepin County by issuance of revised pages, which shall be effective as of the date of issue, or such later date as the amendment shall specify. Administrative memoranda may also be issued which discuss policy interpretations, clarification of procedures and other administrative matters. B. Federal and State Regulations Nothing in these Procedural Guides shall be construed in such a manner as to conflict with, alter, or amend any Federal or State regulation appli- cable to the conduct of the city's business, affairs, or functions. C. Administrative Subcontracts The city may enter into agreements with other entities for the purpose of obtaining assistance in the performance of certain administrative tasks with respect to the delivery of grant funds. Regardless of such agree- ments, the city shall fulfill the following requirements: 1. The city hall bear full re for the p erformance of an Y P Y P Y subcontracting entity with respect to the grant program. Such perfor- mance shall include, but is not limited to, the full adherence to policies and procedures set forth in these Procedural Guides. 2. The city is fully liable for all warranties and representations made regardless of who does the actual originating and /or packaging of grants. 3. Any city may exercise the option to allow Hennepin County to administer the program within the city. In this event, Hennepin County will assess a fee equal to 7% of total CDBG funds allocated by the city for housing rehabilitation. The city may then recapture only administrative expenses directly related to housing inspections. If a city administers the program locally, the administrative costs cannot exceed 10% of the total rehabilitation allocation in any single year. The city will recapture all costs related to the administration of the program up to that limit. D. Delivery of Grant Funds The city must disburse funds to contractors for completed work, in compliance with Sections III and IX. The city will be reimbursed by Hennepin County for grant amounts as out - lined in Section IX. The city may make and deliver grants having an aggregate principal amount not to exceed the amount stated in Section III. 3 E. Approval of Grant Packages No work may commence on any structure prior to the issuance by the city o s a Proceed to Work Order referring to that particular grant. F. Statement of Warranties The city hereby makes the following warranties with regard to the grant program. 1. The city is legally authorized and constituted to administer the Housing Rehabilitation Grant Program in the State of Minnesota. 2. No payments, fees, or remuneration of any type whatsoever have been solicited or received from any grant recipients or applicants. 3. That after reasonable inspection, the city has no knowledge that any improvement covered by the grant is in violation of any applicable zoning law or regulation. 4. Any employee of the city who is authorized to sign or countersign checks, drafts, or to certify vouchers shall be covered by a fidelity and forgery bond in an amount at least equal to the lesser of $25,000.00 or one -third (1/3) of the city's total authorized grant funding; such an employee must be an authorized signatory as evidenced by a written instrument of the governing body. S. The city shall maintain documentation accounting for all funds i s received through the collection of liens as prescribed in the Repay- ment Agreement. Such funds must be submitted to Hennepin County since they are identified as program income. Hennepin County shall allocate the funds for reuse in the city's most currently funded Community Development Block Grant Housing Rehabilitation Program. 6. If; as to any grant disbursed by the city, any of the warranties con- tained in Section II is in fact untrue in any respect, then the County may, at its option, take whatever action it deems necessary, including legal action, to recover from the recipient and /or the city, the grant funds so disbursed in violation of such warranties. G. Expediency of Grant Processing Grants shall be processed in a reasonable length of time in an efficient and accurate manner. Normally, a grant shall be completed, with the repay- ment agreement filed within six (6) months. 4 III. RESPONSIBILITIES OF THE CITY A. Outreach and Public Information The 'city will be primarily responsible for the promotion of the housing rehabilitation grant program at the local level. The city must exercise care in avoiding any advertising or outreach method which may be deemed to systematically exclude potentially eligible applicants. Access to program materials may not be denied to any person for any reason. The program should include efforts to reach those persons who traditional - ly would not have been expected to apply for housing programs. In order to develop an affirmative marketing program, the city should review its nor- mal outreach methods to determine how the methods currently in use can be. improved to reach out to persons who otherwise might not apply for assis- tance under the grant program. B. Inspection of Properties 1. The city shall be responsible for carrying out a* minimum of two inspections of each approved property. a. One inspection shall be accomplished prior to the submission of the grant package to determine the following: 1.) that all necessary improvements are listed in a Property Inspection Report, as described in Section VII. 2.) that the Scope of Improvements shall be developed by the city from the inspection report. The work shall be bid in accordance with the technical specifications; and 3.) that the structure, upon completion of necessary repairs, will be reasonably livable, safe, habitable and energy efficient; and 4.) that the structure upon completion of necessary repairs, will be economically viable, such that the amount of the housing rehabilitation grant may be amortized over the expected remaining life of the property in an economically prudent manner. Generally, the amount of the grant should not exceed 50% of the market value of the property as indicated on the property tax statement. b. After all work is finished, the second mandatory inspection shall take place to determine that all work has been completed and completed in a satisfactory manner-consistent with these guides. 2. The city may conduct interim inspections of the property as it deems necessary. Partial disbursement of funds may be authorized by the city after: a. an interim inspection is conducted by the and 5 b. the city determines that the specific work for which payment is r requested has been completed in a satisfactory manner; and C. a Completion Certificate is executed by all parties for the work completed. C. Applicant Selection Criteria The city is strongly encouraged to implement a first come, first served basis for applicant selection. Such a selection process will govern the selection of applicants for rants in the event that the e number of applicants exceeds the number of rants that g t t can feasibly be awarded, either within one or more target groups (if a targeting plan has been established) or within the entire population to be served by the city (if no targeting plan has been established). It is imperative that each inquiry and application be dated. This dating will be the only device available to the city for recording the priority ranking of the applicants. In applying the first come, first served process, the grant administrator must adhere to the following guidelines: 1. The first come, first served process must be uniformally applied during the entire funding year. 2. No eligible applicant shall be rejected on the basis of judgments as to personal character or life -style as outlined in Section XI. 3. Where no funds are available for assistance to eligible homeowners, the following procedure shall be used: a. Explain to the homeowner that the funding for the current year has been either depleted or allocated. b. Make the homeowner aware of the other possibilities which include the MHFA Rehabilitation Loan Program, the MHFA Low Interest Loan Program, and other local, state and federal programs. C. Send the homeowner a letter of rejection again outlining other possible avenues of obtaining home improvement funds. Any city wanting to implement an objective criteria system, including -a priority ranking of applicants and /or a grant review committee must submit, in writing, an explanation of tfie system, the objectives intended to be accomplished by the use of such a system and an explanation of the selection and function of the grant review committee to Hennepin County for review prior to the start of the funding cycle. ' r D. Preparation of Scope of Improvements /Work Proposal The Scope of Improvements is based on the Property Inspection report. The city must provide the homeowner with a copy of the Scope of Improvements as described in Section VII of these guides. The Scope of Improvements will list all eligible improvements on which to obtain contractor bids. E. Preparation of Grant Package The grant administrator shall be responsible for the thorough and accurate completion of all program documents, as specified in Section VII of these Procedural Guides. The grant administrator will assist the applicant with the preparation of the grant package, upon request, in certain situations. Such assistance shall include a personal visit by the grant administrator to the home of the applicant, or to any reasonable location which is' accessible to the applicant. Assistance will also be given, when needed, to complete necessary tasks required to complete the grant package, i.e., soliciting bids for grant improvements, when absolutely necessary. F. Requests for Changes in Grant Amount At the discretion of the grant administrator, an expenditure of funds in excess of the approved grant amount (never to exceed the grant limit out- lined in Section VII) may be approved by the city in the event of justifiable over -runs in the cost of improvements: The grant administrator must document increases or decreases in the grant amount (NEVER to exceed the grant limit outlined in Section VII) according to the following procedures: 1. All requests for increases or decreases must be submitted on an Amend - ment Request Certificate, signed by the homeowner and contractor, and receive city approval; and 2. The city shall inspect the property to determine that the increase or decrease is justified; and 3. The grant administrator shall obtain a written request for the in- crease or decrease, accompanied by an itemized estimate of costs and, where a new contractor is chosen, a Work Contract signed by the contractor and homeowner. 4. The city will issue authorization for those grant amount increases or decreases which meet the eligibility criteria set forth in Section VII of these Procedural Guides. Such authorization will be given on the Amendment Request Certificate and not valid until signed by the grant administrator. 5. In no case shall the amount of the grant exceed the maximum grant amount as stated in Section VII, except in the cases of accessibility grants as discussed in Section XI of these Procedural Guides. 7 r G. Disbursement of Funds The city shall bear the responsibility of disbursing funds to contractors who have performed work as described in the Improvements Certificate. The city shall.make no disbursement for any work completed until the pro -. petty has been inspected and a Completion Certificate has been signed, according to the procedures set forth in Section IX of these Procedural Guides. H. Regulations. IV. ELIGIBLE PROPERTIES Grant funds shall be used to enable Recipients to improve properties which meet the following criteria: A. The property to be improved must not be in violation of.applicable zoning ordinances. Properties being improved must constitute a permitted use or be subject to a conditional or special use permit under the applicable zoning ordinances including municipal, urban renewal, and development district plans, which use or permit must not be impaired by the contemplated improvements. B. The property must be located within the city must be used primarily for residential purposes, and must contain no more than two dwelling units, one of them owner - occupied. Improvements can only be made to the owner- occupied section unless the improvement serves both units such as a roof. C. Grants funds must be used to finance improvements upon or in connection with existing structures. D. The property to be improved must be a permanent structure. That includes owner- occupied mobile homes located on land owned by the applicant. Trailers are not eligible. E. No property shall be eligible for a housing rehabilitation grant if it has been improved by such a grant within the five -year period next preceding the date on which application for such a grant is made, except in extra- ordinary circumstances relating to damage to the property as a result of events beyond the control of the applicant or improvements directly related to health and safety concerns such as failure of plumbing, heating or electrical systems as determined by the city. Thus, should a previous recipient have a need for additional improvements and no other qualified persons apply, the previous recipient would be considered for a .F. Urban Hennepin County CDBG rehab monies can only be used when federal flood insurance is effect. The city will comply with the flood insurance purchase requirements of Section 102 (a) of the Flood Disaster Protection Act of 1973. Pub. L. 93 -234, 87 Stat. 975, approved December 31, 1973. Section 103 (a) required, on and after March 2, 1974, the purchase of flood insurance in communities where such insurance is available as a condition for the receipt of any federal financial assistance for construction or acquisition purposes for use in any area, that has been identified by the Secretary of the Department of Housing and Urban Development as an area having special flood hazards. The phrase "federal financial assistance" includes any form of loan, grant, guaranty, insurance payments, rebate, subsidy, disaster assistance loan or grant, of any other form of direct or indirect federal assistance. G. Goals for housing rehabilitation assistance have been established for each city included in the Urban Hennepin County Housing Assistance Plan (HAP). For the property to be counted toward meeting housing rehabilitation goals in the HAP, it must be determined to be substandard and upon completion o rehabilitation must meet minimum Section 8 existing housing quality standards pursuant to 24 CFR, as follows: 9 V. ELIGIBLE IMPROVEMENTS A. Each improvement must be a permanent general improvement. Permanent general improvements shall include such alterations, renovations, or repairs upon or in connection with existing structures, which correct defects or deficiencies in the property affecting directly the safety, habitability or energy consumption of the property. A permanent general improvement must be economically viable in terms of a determination that after the improvement is made: 1. The structure will have remaining useful life such that the total amount of the repairs required to bring the house up to Section 8 quality standards may be amortized over such life in an economically prudent manner. Generally, the total amount of the required repairs should not exceed 50% of the market value of the property as indicated on the property tax statement. 2. For the term of the repayment agreement, the lien must be collectable. Thus all existing mortgages, contract for deeds,'and other encum- brances, including the repayment agreement, must not exceed the value of the property as stated in the County Recorder's office. 3. The structure will be reasonably liveable, safe and habitable. Permanent general improvements shall not include materials, fixtures, or landscaping of a type or quality exceeding that customarily used in the locality for properties of the same general type as the property improved. B. Each improvement must be made in compliance with all applicable health, fire prevention, building and housing codes and standards. However, no application for a grant shall be denied solely because the improvements will not bring the property into full compliance with all such codes and standards. Further, when work is done on any system within the house, upon completion of the work, that entire system must meet applicable codes and standards; however, the entire structure may still contain others systems, ys s, on which no work was done, which are not up to applicable codes and standards. C. Grant funds may be used for the portion of improvements located on the pro- perty which will bring an individual water supply system or an individual sewage disposal system (including septic systems) into compliance with local', state or federal environmental and sanitary standards provided no public utility service is available. Payment of applicable SAC charges are an eligible grant expense. D. No grant funds shall be used in whole or in part for the purpose of re- financing or paying off an existing indebtedness. All such funds must be used to finance improvements begun after application for such funds. No improvements are eligible if begun before the issuance of a Proceed to Work Order by the grant administrator. E. All contracts covering all or any portion of an improvement must contain a city approved warranty of workmanship and materials. 10 F. The, city may approve special improvements only in the described circumstances indicated below: 1. Bedroom additions may be allowed in cases of severe overcrowding. For the purpose of this program; a dwelling will generally be considered "overcrowded" if there is an average of more than one person per room (excluding bathroom) in the dwelling, or as otherwise approved by the city. 2. Bathroom additions may be allowed in cases of inadequate indoor bath- room facilities only if no other space in the structure is appro- priate for such facilities. NOTE: In cases of applicants with impaired.mobility, requests for room additions will be reviewed in compliance with procedures for grants including accessibility improvements. as outlined in Section XI. G. Demolition of out - buildings is allowed only when such clearance is required by the local building code. H. Reconstruction of sidewalks and driveways is allowed only on private property and only if existing conditions are a clear and imminent safety hazard. I. Water drawn from a valid well must be potable (safe for drinking) and must be free of sand rit r 0 other materials which might - or 9 ht dama a the um 9 9 P P plumbing. Water need not - be free from minerals which may make it cloudy nor must it be free from odor. NO FUNDS WILL BE DISBURSED BY THE CITY UNTIL AND WHEN WATER IS STRUCK. It is an eligible improvement to connect a house to city water and /or sewer when conditions affecting the health of the are present or when required by local law. J. Exterior finishing (painting or siding) is allowed only to the extent that there is severe deterioration of current exterior finishing. Exterior finishing requested solely for cosmetic purposes will not be approved. K. Where property is not reasonably energy efficient, grant funds must be used to the extent necessary, to increase such efficiency. Energy saving features shall be consistent with the energy standards promulgated as part of the State building code, but such improvements need not bring the housing into compliance with such energy standards. L. Smoke detectors must be installed in all dwellings being improved with grant funds,,unless detectors are already properly installed. At least one detector is required for each dwelling unit. In two -story houses, when only one detector is to be installed, it must be placed at the top of the second floor stairwell. If a smoke detector is already properly installed, that must be reported on the inspection report. All properties being improved must contain adequate smoke alarms following completion of the rehabilitation work. M. Where the house numbers are not present or are not installed to applicabl i city codes and ordinances, they shall be installed properly. 11 N. The city must inspect or test to identify the existence of immediate lead- based paint hazards on all residential structures to be rehabilitated. Section 570.611 of the CDBG Regulations: 1) prohibits the use of lead -based paint whenever CDBG assistance is used for construction, rehabilitation or modernization of residential structures; 2) requires the elimination of immediate lead -based paint hazards in residential structures assisted with CDBG funds; and 3) requires notification of lead -based paint poisoning hazards to purchasers and tenants of residential structures constructed prior to 1950. The city will be monitored by the Department of Housing and Urban Develop - ment'(HUD) to determine compliance with Section 570.611. ELIGIBLE RECIPIENTS Only those applicants who meet all the requirements set forth in these Procedural Guides including the requirements of income; assets, eligible properties; and eligible improvements will be approved. A. Ownership 1. The recipients must individually or in the aggregate have at least: a. A life- estate; b. A one -third interest in the fee title; c. A one -third interest as purchaser in a contract for deed with respect to the structure to be improved and must occupy such property as their principal place of residence. 2. All individuals occupying the structure to be improved as their principal place of residence and having an ownership interest in such structure must join in the application. 3. For the purpose of this program, ownership shall be based on-the :information recorded in Hennepin County Recorder's Office, or the Recorder's Office of the pertinent county should the applicant's house and /or land be in a portion of a participating Urban Hennepin County community which is outside of Hennepin County. 4. To be eligible to receive a grant, the applicant must be current on contract for deed payments, mortgage payments and property taxes on the property to be improved. If any of these payments are in arrears, they must be made current before the application can be approved for funding. If the applicant is delinquent on any of these above mentioned payments or taxes, the grant may only be given if the appli- cant is current on a payment schedule with the appropriate agency. B. Household Gross Annual Income I. Recipients must have a household gross annual income at or below the amounts shown for their family size on the following chart. Gross annual income is defined as the gross annual income, from all sources before taxes'or withholding, of all family members living in the housing unit (including individual non- related adults). Include all persons living in the housing unit for at least nine (9) months of the year and who do not pay rent. 4 13 GROSS ANNUAL INCOME LIMITS 1 Person $13;500.00 5 Persons $17,500.00 2 Persons 14 6 Persons 18 3 Persons 15,500.00 7 Persons 19,500.00 4 Persons 16,500.00 8 Persons 20,500.00 For each additional person, add $1,000.00. The grant administrator should be aware that non - recurring types income should be included as assets rather than as income. Items for inclusion under this category may include: cash sales of property, receipt of one -time survivor benefits, etc. A one -time sale of stock does not count as income, but rather the proceeds are counted as assets. Any city wanting to implement the grant program with a gross'annual income limit deviating from the above chart, must submit in writing, an explanation of the reasons for the deviation to Hennepin County for review, prior to the start of the funding cycle. 2. Gross annual income includes: a. Any public assistance, including; but not limited to: welfare, ±\ AFDC, SSI, and unemployment compensation. b. Salaries (including commissions, bonuses, overtime pay and tips). c. Alimony and /or child support. d. Interest and dividends. e. Pensions and annuities, include P.E.R.A. and social security. f. Rental income, farm rental income. g. Estate or trust income. h. Business profit - -for self employed individuals, including farmers and child care /babysitting. i. Gains from the sale of property. j. Interest payment received from properties being sold on contracts for deed. k. Partnership. 1. Personal and /or business loans m. Miscellaneous income. Gross annual income is the income derived from all sources before tax or withholding, of all members of the family living in a housing unit (including individual non - related adults) for at least nine (9) months of the year and who do not pay rent. 3. Gross annual income shall be based upon annualized weekly or monthly income as of date of verification. 4. In cases where the gross income of the applicant's household is extremely low the applicant must produce written verification of the monthly expenditures clearly itemizing the amount of money and its source spent on all of; but not necessarily only; the 14 applicable items: mortgage, contract for deed, insurance, loans, income and property taxes, transportation expenses, charge accounts, health costs, food, utilities, clothing and entertainment. These expenses shall determine the household maintenance income. 5. Any income determination which results in a net LOSS of , income must be considered as $0 income. That is, an income loss from one source may not be subtracted from a separate source of income for the purpose of total household gross annual income. 6. Any educational grants, including VA benefits, which are paid directly to the individual must be included as income. Grants or scholarships which are paid directTy to an educational institution are not included as income, nor are educational loans. 7. Projected bonus and /or overtime will be determined by the grant administrator through contacting an employer. The amount may be based on prior years figures or average amounts awarded to other employees with the same status. The most recent IRS tax return may also be used for these purposes. 8. Self- employed persons must submit signed copies of IRS tax returns, as sent, for the previous two years. The grant administrator will determine gross annual income by averaging the income of the last two years. _Normal out -of- pocket business expenses such as office rent, telephone, etc., are generally deductible items. Property or equipment depreciation and entertainment are not deductible. 9. Income from rental properties, including rents from the property to be improved, sha11 be included in 9 ross income. Expenses allowable for deduction for rental purposes include mortgage interest payment, utilities, taxes, insurance, and maintenance. In no event shall such deductions exceed gross rental income. .C. Asset Determination 1. "Gross assets" for purposes of the Housing Rehabilitation Grant Pro- gram shall be defined as the current market value of an item listed minus existing indebtedness on that item. For purposes of the lTousin Rehabilitation ran r set d h e Grant Program, ram assets shall include t 9 9 , following items: a. Cash on hand. b. Cash in checking accounts. C. Cash in savings accounts, including accounts held intrust. d. The cash value of life insurance policies. _ e. The cash value of securities or U.S. savings bonds. f. The current market value of all interest in real estate, not including the structure to be improved and a parcel of real pro - perty of not more than two (2) acres on which the structure is 15 located. Included in this determination is any land in'which any resident of the household holds title or is selling on contract for deed. The value of the contract for deed property shall be 0 defined as 100% of the outstanding balance on the contract. g. All other property, exclusive of household furnishings, clothing, and one vehicle. This section includes but is not limited to: farm equipment, boats, snowmobiles, motorcycles, farm stock and additional vehicles. h. If the applicant owns a business, in full or in part,- and that business is incorporated, then the business equipment is not a personal asset. If the business is not incorporated, the business equipment is then considered a personal asset. The value of the ownership of the business by the applicant is a personal asset. If the applicant owns less than 100% of the business, written notarized proof of the per -cent of ownership must be provided by the applicant to the grant administrator. 2. Recipient's asset limit: The gross assets of the recipient, excluding the residential property to be improved, shall not exceed $25,000. i - 16 VII. GRANT APPLICATIONS The grant administrator shall obtain the following documents to be included in the grant package for review and approval: A. Homeowner Application for Grant. This application shall be completed in ull and signed and dated by the Applicant. The Homeowner Application for Grant provides: 1. Household information. 2. Income information. 3. Assets determination. 4. Property information. B. Property Inspection Report 1. A copy of the initial inspection report must be included in the grant package. Report forms must include the following items: a. General condition of the structure. b. Structural'Soundness. c. Plumbing systems including: water supply, waste disposal, fixtures and piping system. d. Heating systems. e. Roof. f. Energy efficiency including: insulation, infiltration, windows, doors and ventilation. g. General exterior conditions. h. General Interior Conditions. An explanation should be provided for any deficiency which appears on the inspection report but does not appear on the Improvements Certi- ficate for correction. The inspection report must be signed and dated by the inspector per- " forming the inspection. 2. It is not the intent of the rehabilitation grant program to conduct inspections to find violations of the city building codes. However, major infractions that constitute a health and /or safety hazard or seriously diminish the habitability of the residence will be noted 17 and explained to homeowner. If the homeowner is determined to be eligible for a grant, serious infractions will be remedied at that for a grant, serious infractions will be remedied at that time. Should the homeowner not be eligible for grant monies, the homeowner will be informed of the infraction by the city building department and a period of time will be established during which the infraction would be remedied. C. Contractor- Homeowner Procedures An explanation of the bidding procedures, amendment procedures, and com- pletion procedures are outlined. Both the contractor and the homeowner shall sign and date the form indicating an understanding of the proce- dures. A copy shall be given-to the contractor and the homeowner and a copy kept in the applicant file. D. Scope of Improvements /Work Proposal This listing of all eligible improvements, prioritized by the city from which bids shall be prepared, must be given'to the homeowner. E. Contractor Bids Bids must be obtained from each contractor performing work on the resi- dence. All bids must conform to the minimum standards of the technical specifications. ( The homeowner must obtain a minimum of two bids for each of the authorizece improvements. Work shall be completed within the time frame specified on the Work Contract. The city may grant an extension under unusual circumstances. This extension must be in writing with a copy given to the homeowner and contractor. F. Income Verification All sources of income listed on the Homeowner Application for Grant must be verified by the Grant Administrator. EVIDENCE OF SUCH VERIFICATION - MUST BE INCLUDED IN THE GRANT PACKAGE. The following is a list of acceptable forms of income verification evidence: 1. Written verification from employers or other income providers. 2. Copies of current checks or check stubs. 3. IRS forms only in the case of self- employed individuals. (See Section IV) 4. Statements of deposit from bank. 5. Copies of deposit slips indicating the deposits of a particular check 18 6. Income derived from rent must be verified by the renter in writing or by examining copies of checks or rent receipts. The date of document used in verifying income may not be more than 90 days previous to the date of approval. G. Asset Verification All assets listed on the Homeowner Application for Grant must be verified by the grant administrator. EVIDENCE OF SUCH VERIFICATION MUST BE INCLUDED IN THE GRANT PACKAGE. The following is the only acceptable form of asset verification evidence: 1. Written verification from banks, insurance companies or other asset holders. 2. Copies of bank statements, insurance policies, premium notices and the like. . The date of document used in verifying assets may not be more than 90 days previous to the date of approval. H. Individual Data Confidentiality The applicant's rights as a subject of data are fully described in this form'. This form is given to the applicant and not retained for the grant package. I. Title Verification Form 1. The -grant administrator must obtain the following information from the Registrar of Deeds regarding each property: a. The full name of all owners of record; including first name, last name, middle name or initial and additional names which may appear in the records, such as maiden names. b. A determination of the system under which the property is recorded -- either Torrens or Abstract. 2. Upon obtaining this information, the grant administrator must deter - mine that the applicant's individually or in the aggregate have a qualifying interest in the property consisting of at least: 19 a. A valid life estate. Such life estate must be recorded and must appear in the records of the County; or b. A 1/3 interest in the fee title. Such interest may be subject to a mortgage; or c. A 1/3 interest as a purchaser in a contract for deed with respect to the structure being improved. 3. In addition, the applicants must occupy the property as their principal place of residence. To consider a property as one's principal place of residence an individual must: a. Reside in the property at the time of application (except where extraordinary circumstances have made the property temporarily uninhabitable). b. Occupy the property for at least 9 months of,the year. 4. For the purpose of complying with ownership requirements, the recipient may aggregate his interest in such property with the ownership interest of other individuals occupying the property as their principal place of residence. J. Mortgage Status Verification ( The grant administrator must ensure that the mortgage(s) and /or contract for deed(s) on the property to be improved are current. The date of the document used in verifying the mortgage and /or contract for deed may not be more than 90 days previous to the date of approv- al. .K. Repayment Agreement The Repayment Agreement must be included in the grant package. As specified in the provisions of the Repayment Agreement, the recipient shall be required to notify the city immediately upon the sale, transfer, conveyance or cessation of residency of the property. 1. Each grant shall be subject to an agreement for repayment which pro- vides that in the event that the property upon which the improvement is located is sold, transferred, or otherwise conveyed by the grant recipient within five (5) years from the date upon which the grant application was approved, or in the event that such property ceases to be the recipient's principal place of residence within five (5) years from the date upon which the grant package was approved, then the reci- pient shall repay (and the city shall have a lien to the extent per - mitted by law on the property as security for such repayment) all or a portion of such grant funds in accordance with the following schedule 20 Period of Time After Grant Within Which Sale, Transfer, Conveyance, or Cessation of Residency Occurs Percent Repayment Prior to end of 12th full month 100% After end of 12th full month until end of 24th full month 80% After end of 24th full month until end of 36th full month 60% After end of 36th full month until end of 48th full month 40% After end of 48th full month until end of 60th full month 20% After end of 60th full month No Repayment 2. Execution of the Repayment Agreement. In order to create a valid lien on the property which has been improved by grant funds, the city must exercise extreme care in the execution of the Repayment Agreement document. Any inaccuracy or omission may have a negative effect on the validity of the lien. Prior to the approval of the grant package the city should ensure the completion of the following sections of the Repayment Agreement only: a. Property Description. The property description must be clear, legible, accurate and complete. Care must be taken to ensure that the description is exactly as it appears in the property records. If the applicant owns property other than on which the structure to be improved is located, only the description of the property on which 'the struc- ture is located should be included. b. Signatures. The record names (the names exactly as they appear in the property records) must be used by all whose signatures are required. The following is a brief discussion of the signatures required under particular property ownership situations: 1.) Any JOINT TENANCY -- signatures of all joint tenants are required. 2.) Property held by ONE SPOUSE -- signatures of BOTH spouses are required. 21 3.) Property held in LIFE ESTATE -- signatures of the applicant (life estate holder) and signature of sufficient remaindermen to comprise at least 1/3 interest. (Example: if there are remaindermen in title, the signatures of 4 of them are required to comprise 1/3 interest, assuming equal interest for all). 4.) Property being purchased on CONTRACT FOR DEED -- signatures of the applicant and all individuals who are aggregating their interest to meet the ownership requirement; and the fee title holder (and spouse or others, as applicable) of the property; and the signatures of any intervening vendees of the contract for deed. c. Notarization of Signatures. 1.) All required signatures must be notarized, including the "mark" of a signator -who is unable to write (such a mark must be witnessed by at least two persons other than the notary). Additional acknowledgements may be added to the Repayment Agreement form to accommodate any necessary notarizations. 2.) All dates (except those in the notary's acknowledgements) in the Repayment Agreement shall be left blank until the grant is approved The city has three options with regard to obtaining the signature of the homeowner on the Repayment Agreement. 0 It is recommended that the grant amount in the Repayment Agreement be left blank at the time the grant package is submitted. This allows the city flexibility with regard to amendment requests by not requiring a new agreement to be signed should the grant amount change upon completion of the work. The city may accept the document with the maximum grant amount in place, recognizing that upon completion of the grant should the total of the work not equal the maximum grant amount exactly, a new document must be executed. If the homeowner refuses to sign a blank repayment agreement and also refuses to sign a repayment agreement indicating the maximum grant amount, the grant administrator shall require that the home- owner sign the repayment agreement which has the total of the selected bids inserted as the grant amount. The grant administra- tor shall, in writing, inform the homeowner and all selected con - tractors that no amendments to the grant amount will be approved without first obtaining a signed repayment agreement indicating the altered grant amount. The Repayment Agreement shall be filed with the proper recording office in such a manner as to create a valid lien against the property, on all properties improved with grant funds provided 0 22 • that the creation of such a lien is permitted by law. It is the responsibility of the city to record this agreement with the proper recording office after the improvements are completed. If any grant funds are used for purposes other than an eligible improvement upon eligible property or if the recipient's applica- tion is found to contain a material misstatement of fact, the recipient shall be liable for repayment of all or part of the originally approved grant funds. In addition, any fraudulent use of funds may subject the recipient to fines and /or imprisonment under the Minnesota Criminal Code. L. Improvements Certificate. All improvements approved to be done to the residence shall be listed with contractor performing the work indicated and the associated costs. 1. This form lists the work to be done by item and contractor performing and a breakdown of costs by item and contractor. 2. The total of the cost for work to be performed shall be listed where indicated. The maximum grant amount shall not exceed the lesser of: $8,250; or -the actual cost of the work performed EXCEPT in the case of accessibility improvements for handicapped Y P PP individuals, where a grant may exceed the maximum grant amount by an amount, up to $2,500, for improvements which increase the accessibi- lity of the property to handicapped individuals. An applicant's willingness or ability to apply for a grant from any source, regard- less of terms and conditions, to be used in conjunction with or to supplement grant funds shall not be a condition to a grant, except when the house cannot be brought up to Section 8 Quality Standards with available grant funds. The amount of funds received from other sources shall not reduce the permissible amount of the grant. M. Data on Individual Grants and Loans The grant administrator is required to complete this form for each grant package which provides information pertaining to environmental assessment, historical preservation, Section 8 quality housing standards, census tract data and household size and annual income. N. Work Contract Each',contractor selected to carry out improvements must sign a Work Contract provided by the Grant Administrator listing general conditions for the protection of the homeowner. A copy of each bid or estimate for all work to be performed by each contractor must be attached to the Work Contract. Such bids or estimates must be based on the items set forth in the Scope of Improvements /Work Proposal. 23 • - The Proceed to Work Order is part of the,.Work Contract. 0. Amendment Request Certificate The form outlines all changes in the approved grant amount; either additions or subtractions, by each contractor. It must be signed by the contractor and the homeowner and approved by the grant administrator. A revised bid must be attached. P. Contractor Bills Bills must be obtained from each contractor performing work on the residence. Q. Completion Certificate This form should be signed by the homeowner and the contractor when the grant work undertaken by the contractor is completed. If the work requires a building permit, or if.code work is involved, then the relevant inspector should sign in the space provided. If the approval of more than one inspector is required, then copies,of the Inspection Notice(s) should be attached. The Completion Certificate must always be accompanied by a bill for the work done. For procedures in the event of a homeowner refusing to sign a Completion Certificate see Section IX. R. Complaint Record This form should be used to document complaints, by homeowners and /or con- tractors, which are not resolvable by the grant administrator to the satis- faction of all three parties, or when the resolution will require a lengthy process. 24 VIII. ACCEPTANCE PROCEDURES A. Review of Grant Packages 1. The city will process applications using the first come, first served selection criteria unless an alternative method has been approved by Hennepin County as established by the city and required in Section III of these Procedural Guides. The city objectives are to encourage necessary improvements whereby the structure will be reasonably livable, safe, habitable and energy efficient. 2. Applications will be accepted as follows: a. Applicants must submit their request for a Rehabilitation Grant on a Hennepin County Grant Application form. It should be sub- mitted to the city. b. The city will review the individual packages using the qualifi- cations as outlined in Section VI. Grant packages shall contain all of the documents listed in Section VII of these Procedural Guides. The city may reject unacceptable packages and hold them until the necessary information is provided after notification of same to homeowner. C. The decision of the city will.be final; however, appeals may be made in those -cases where applicants believe they were not treated equitably. Appeals shall be in written form submitted to the grant administrator in the city outlining the applicant's con - cerns. The city should review the concerns and relay in written form to the applicant within 15 days. If after this review, disagreement is still evident, the city should contact Hennepin County to mediate the situation so as to eliminate potential confrontations between the City and the applicant. Q. Notification of Approval 1. If the applicant is determined to be ineligible, the city must notify the applicant of that•denial, in writing, within five days of denial indicating the reason(s) for denial and outlining the appeal process as stated above. 2. ,Upon approval of a grant package, the city must notify the applicant of that approval. Each approved grant will appear on a Proceed to Work Order indicating the name of the recipient and indicating the approved dollar amount of the grant. 25 a. Receipt of such notification will signify authorization for the immediate commencement of work on the properties represented by the specified grants. b. The Repayment Agreement for each - approved grant will be temporarily held by the grant administrator. The Repayment Agreement will have been executed by the city and dated according to the date on which the grant package was approved. 26 IX. COMPLETION AND DISBURSEMENT PROCEDURES A. Completion Procedures No grant will be considered complete until the following steps have been accomplished: I. Inspection of the Property - All improvement work, as specified in'the Improvements Certificate -must be inspected for completeness, con- formity to specification and quality of workmanship. The city must require completion or correction of any item found lacking. Failure of a contractor to comply with such a request for completion or correction of work may be considered grounds for the city to withhold all or part of the payment due to the contractor. 2. Completion Certificate - Following the final inspection and successful completion of work, the Completion Certificate must be signed by the recipient, all of the contractors who performed work on the property, and by the inspector of the property, and the grant administrator. In the event that the homeowner will not sign the Completion Certificate, payment can be issued to the contractor provided that the contractor, the inspector, and the grant administrator all sign the Completion Certificate indicating that the work was done properly and a letter written by the grant administrator is attached outlining in detail the situation resulting in the recipient refusing to.sign the Completion Certificate. 3. Recording of the Repayment Agreement - The grant administrator must insert the final amount of the grant in the Repayment Agreement and check the document for completeness and accuracy. The Repayment Agreement must then be recorded by the grant administrator with the Registrar of Deeds or the Registrar of Titles of the applicable County. NOTE: For property registered according to the Torrens system, the Repayment Agreement must be accompanied by Owner's Duplicate Certificate of Title at the time of recording. Also, documents recorded on Torrens property are not returned to the person re- questing the recording. Therefore, the grant administrator must either retain a copy of the agreement prior to recording and obtain the recording information (document number) from the recorder, or must obtain a certified copy of the document after recording. Following recording, the grant administrator shall provide a copy of the recorded Repayment Agreement to the recipient B. Disbursement Procedures 1. No'',disbursement of funds shall be made to a contractor until the city is in ,receipt of: a. a completion certificate signed b the contractor homeowner and 9 Y , inspector; and 27 b. a bill.from the contractor for the amount of the work performed; and 0 C. lien waivers provided by the contractor the amount of the work performed. Upon receipt of the above items; payment may be made to_the contractor using funds from the city's general revenue fund. Payment will normally be made within three weeks of receipt by the grant administrator of the bill, the signed completion certificate and the lien waivers. 2. To be reimbursed by Hennepin County; the city must forward to the County the following: a. Signed Completion Certificates and all Amendment Requests b. Data on Individual Grants and Loans (need to submit only one per client) c. Contractor's Invoice'(bill) d. City's proof of payment to contractor (city check) e. Summary of Project Disbursement Sheet f. Signed Warrant Request Submit only copies of items a through e. The originals must remain in 0 the applicant files at the city. 3. Administration costs for housing rehabilitation should be billed directly to the project, not general administration. 4. Housing rehabilitation funds must be drawn down from the earliest program year with remaining funds regardless of which grant expenses are being reimbursed. 5. Hennepin County will then issue a check to the city to be deposited into the city's general fund. 6. All program income generated from housing rehabilitation (i.e. grant repayments) must be returned to Hennepin County. 28 X. PROCEDURES FOR ACCESSIBILITY IMPROVEMENT GRANTS A. Accessibility Improvements 1. Accessibility Improvements may include: a. Structural Improvements: Construction, installation or modification of ramps, handrails, kickplates and door widths; repair or replacement of doors; reloca- tion of doorways; installation of lever- action hardware; construc- tion or expansion of rooms. b. Exterior Improvements: Construction of exterior ramps, railing, walkways, landings and porch extensions; site grading and other site improvements. c. Bathroom Improvements: Installation of elevated water closets, grab bars, shower stalls, tub seats, hand -held showers, accessible sinks, electrical outlets, medicine cabinets and other accessories; modification or expansion of bathroom area to allow a five foot turning radius. d. Kitchen Improvements: Construction, modification or replacement of cupboards or shelves to provide access to sinks, cook tops, ovens or storage areas; installation of accessible electrical outlets and switches, lever - action hardware, garbage disposals; insulation of hot water pipes; modification or expansion of kitchen area to allow for a five -foot turning radius in the workspace; installation of "lazy susans" in cupboards; replacement of floor covering in order to improve wheeling surface. e. Other Improvements: In exceptional circumstances, installation of central air-condi- tioning and /or stair glides or electric lifts when the need for these improvements is verified by the handicapped person's doctor in writing. 2. Improvements which are not determined by the grant administrator to be eligible as accessibility improvements may be funded under the other provisions of these procedural guides. B. Requirements for Participation Grants may be made to handicapped persons for accessibility improvements only if the conditions of Section VI (except the portion thereof relating to Eligibility of Improvements) of these procedural guides have been fully satisfied. 29 C. Amount of Grant for Accessibility Improvements In no event may a grant for accessibility improvements exceed $2,500 over the city's maximum grant amount as stated in Section VII. If a grant is made both for accessibility improvements and for other eligible improvements pursuant to these procedural guides, then under no circumstances should the amount for the non- handicap improvements exceed the maximum grant amount as stated in Section VII. D. Responsibilities of the City With respect to grant for accessibility improvements, the city shall: 1. Be governed by the general conditions set forth in Section II of these procedural guides. 2. Assist the handicapped person with the preparation of the Application form, upon request. Such assistance shall include a personal visit by the grant administrator to the home of the handicapped person, or to any other reasonable location which is accessible to the handicapped person when the offices housing the grant administrator are not deemed accessible in accordance with Chapter 751 Laws of Minnesota, 1978. 3. Carry out the duties required of the city pursuant to Section III, except Section III of these procedural guides, including the duty to complete the grant package for accessibility improvements. A complete grant package for accessibility shall include all required materials. E. Standard Procedure for Compiling Accessibility Portion of Grant. In addition to all the documents described in Section VII, a grant package including handicapped improvements must include the following: 1. Accessibility improvements inventory -- containing a description of the accessibility improvements to be made shall be included with the inspection report. 2. A letter describing: s g. a. the level and specific type of disability experienced by the handicapped person signed by a licensed physician; and b. the specific accessibility improvements requested by the p hysician; sician• 3. Plastering - New plastering work shall be installed in compliance with the State Building Codes. 3• Wall Board - shall be installed in compliance with the State Building codes. 4. Perforated Tape Mix - shall comply with the recommendations of the manufacturer. A minimum temperature of 55 degrees Fahrenheit shall be maintained in the room where work is done until the cement is completely dry. 5. Perforated Tape Application - Follow manufacturer's directions. a. Over Joints the tape shall be embedded in cement and covered with a thin layer of cement. A second and third coat shall be applied. Each coat shall be dry before applying the next coat. Each coat shall be featheredged and extended beyond the previous coat (approximately 2 The finish coat shall be sanded lightly and any imperfections filled in prior to any painting and decorating. b. Check to see that all nails have been driven so that their heads are below the surface of the board leaving a dimple in the surface without breaking the paper. Cover the nails dimple with three applications of cement allowing time to dry between each coat. The final coat shall be sanded lightly before application of paint or other decoration. C. Inside corners shall be reinforced with tape embedded in cement finished as specified "Over Joints ". d. Outside corners shall be protected by wood moulding, metal moulding or metal corner reinforcement. Metal corner reinforcement shall be finished with two coats of cement as specified. 6. ' Waterproof gypsum board shall be used in areas specified in the State Building Code. Install water resistant wall board base in the bath and shower enclosure, and apply wall board with long edge horizontally over the tub, allowing 1/4" space between the board and tub. 7. Adhesive is an acceptable bonding material. Adhesive shall be specified according to usage and location and applied in strict compliance with the manufacturer's specifications. -9- WALLS continued 8. Paneling installation shall be 3/16" prefinished paneling of a medium quality installed as per manufacturer's recommendations. Owner shall have choice of paneling color and style. 9. Novelty - Cover indicated sections of structure with new wood novelty siding, or other specified material. All joints shall be tight and adjacent end joints shall be staggered. Siding shall be installed over vapor barrier, blend and conform with existing structure. All horizontally applied siding shall be staggered with minimum of two stud spaces. ❑ Cover soffit and fascia with .019 gauge baked enamel aluminum using solid or perforated soffit material. Color selection by owner. Soffit panels shall be secured in channels to eliminate looseness and rattling. Materials shall be lapped for proper drainage and applied in full sections. Caulk joints. PAINTING ❑ 'Repaint exterior siding, cornice, window and door trim including doors and windows as follows: Wood surfaces to be painted shall be cleaned by best means possible to remove loose and scaley paint and rough spots any any obvious oil and /or grease that may be covering existing wood or paint. Where previous coats have chipped and peeled, the edge shall be feathered to the maximum extent feasible and spot primed with a high quality oil base paint before finish coats are applied. No paint shall be applied until all nail holes have been filled and sanded and all defects in wood work have been eliminated. !Paint shall be medium grade and applied according to the manufacturer's specifications and applied to secure full coverage. Use primer where required. Owner to select color from readily available selection. Spray application is not acceptable, unless authorized by the Grant Administrator. 24. GUTTERS AND DOWN SPOUTS ❑ 'Provide gutters and downspouts as follows: a) New gutters shall be minimum 5" wide .032 gauge aluminum with hangers placed under roofing. b) New downspouts shall be minimum 2 x 3 rectangular .020 gauge aluminum. C) Finish of gutters and downspouts shall be a baked on enamel finish. Owner to select color from readily available selection. d) Gutters shall be installed with slight pitch to the downspout. The type and weight of the materials used for the roofing shall be in compliance with the State Building Codes. Application - Surfaces to which roofing is to be applied shall be even, sound, thoroughly clean, dry and free from all defects that might affect the quality of application. a) Asphalt Shingles - No more than one overlay of asphalt shingles shall be applied over an existing asphalt shingle roof. PAINTING • 0 Repaint exterior siding, cornice, window and door trim including doors and windows as follows: Wood surfaces to be painted shall be cleaned by best means possible to remove loose and scaley paint and rough spots any any obvious oil and /or grease that may be covering existing wood or paint. Where previous coats have chipped and peeled, the edge shall be feathered to the maximum extent feasible and spot primed with a high quality oil base paint before finish coats are applied. No paint shall be applied until all nail holes have been filled and sanded and all defects in wood work have been eliminated. Paint shall be medium grade and applied according to the manufacturer's specifications and applied to secure full coverage. Use primer where required. Flashing, plumbing jacks and roof vents shall be checked and replaced with new when damaged, rusted or missing. Drip edge shall be installed along eave edge. All damaged or rotted sheathing boards shall be replaced with new. End joints shall be made over a rafter and all sagging portions of roof shall be corrected. Materials - New roofing shall carry the Class C label of wind resistance from the Underwriter's Laboratories and be applied according to the manufacturer's specifications. The type and weight of the materials used for the roofing shall be in compliance with the State Building Codes. Application - Surfaces to which roofing is to be applied shall be even, sound, thoroughly clean, dry and free from all defects that might affect the quality of application. a) Asphalt Shingles - No more than one overlay of asphalt shingles shall be applied over an existing asphalt shingle roof. They have provided a preliminary operational budget (enclosed) with the qualification that they represent a very rough estimate only and that as the development progresses, they will be in a better position to provide more accurate assessments. I have provided an estimate for those areas not included in Heskin's costs. A total annual operations budget for the farm will be an estimated $460,000. Based upon an annual income of $155,000 per year from the hippodrome, the rest of the farm will need to generate $305,000 to break even. The break even point is approximately $11.50 per square foot for all of the remaining farm space. October 12, 1987 Preliminary Operational Budget Earl Brown Farm For purposes of this preliminary budget, no rental income was projected to offset the operating expenses. Typically, many of these expenses are a direct pass through to tenants. Operational costs associated with comparable office projects were used as a basis for this preliminary report. Projected expenses were based on approximately 21,500 sq. ft. of general use office space and 24,500 sq. ft. of Hippodrome /Meeting space. No costs associated with the use of the Hippodrome as a meeting center were considered, at this time. The Property Manager detailed in the preliminary budget would assume the onsite function of coordinator and scheduler of all events and meetings, in addition to handling the day to day needs of the 'office tenants. Supply ordering, supervision of contract service's and general decision making functions would also be handled by this person. The Earle Brown Farm Committee with staff concurrence has finalized its recommendation. The hippodrome will be developed as a multipurpose facility. We envision using this facility for banquets, seating as many as 1200 if possible, to a trade show arena. I would estimate the facility would accommodate approximately 100 booths. Other activities contemplated for the hippodrome would include weddings, dances, musical entertainment, perhaps like the Carlton, exercise classes, and so forth. Design of the hippodrome should anticipate dividing the room up to accommodate several smaller groups on a given occasion. The stable which is physically connected to the hippodrome, would encompass kitchen facilities for banquets and quite possibly a restaurant in the main entryway to the stable. The northern most wing would most likely be office space. Most likely, we will have only one tenant for the office space in the stable. The loft areas of the stable would function as storage space for the hippodrome. The G and H barns located to the north end of the project would be office space. We anticipate the design ign would connect the two buildings, but that would be subject to tenant needs and the architects review and suggestions. The housing, complex which includes the main house, the farm house, and the guest house will be •� g developed as a bed and breakfast facility. Special attention to this will be of primary concern to the Brooklyn Historical Society. Consideration should be given to incorporation historical artifacts and possibly the restoration of a room to be roped off from the public. Note, the design of the "bed and breakfast" must take priority, however. The D barn will function as an office building dependent upon certain budget considerations. The blacksmith's shop, located outside of the property, would be moved onto the site and used as a senior drop -in center, . budget allowing. g If not, the D barn would function as an artist's loft and senior drop -in center. The bunk house will be used in conjunction with the "bed and breakfast" or the senior drop -in center. Along with the cooks shed and the pump house, uses of the buildings should be supportive of the other uses. For example, the cook's shed could provide storage space etc. I have presented you with a broad outline of intended uses for the buildings on the farm. Obviously, as we start the design process and tenants are identified some modifications can be anticipated; however, I do not foresee any significant changes in this program.
