Extract of Minutes of Yleeting of the
Village Council of the Village of Brooklyn Center,
Hennepin County, Minn.
Pursuant to due call and notice thereof, a, special meeting of the
Village Council of the Village of Brooklyn Center, Minnesota., was duly held at
the Village Hall in said village on Wednesday, the 30th day of July, 1952, at
8:00 o'clock P.M.

The Mayor announced that this was the time and place for receipt of bids
i
for the purchase of $304,OW Storm Sever Improvement Bonds.
The clerk presented affidavits showing publication of notice of sale
in the North Hennepin Post, the official newspaper, ancz in Commercial West, a
financial paper published in Minneapolis, Minnesota, which affidavits were examined

and found satisfactory and ordered placed on file.

The clerk then presented the sealed bids which had been received.
These were opened and examined and found to be as follows:

4 After due consideration of the foregoing bid, Trustee Merr Stodghil
introduced the following resolution and moved its adoption:

BE 1T RESOLVED by the Village Council of the Village of Brooklyn Center,
Minnesota, that it is hereby determined that it is for the best interest of the
village to issue bonds without optian of prior payment, and that the bid of
Kalman & Company and Allison-Williams Co. & Associates to purchase 304
Storm Sewer Improvement Bonds bearing interest at the rate of three and one -half
per cent ( 32�) at a price of $3o4..226.uo is hereby found, determined and d eclared 1
to be the most favorable bid and is hereby accepted. The clerk is directed
to retain the check of the purchaser.
The motion for the adoption of the foregoing resolution was duly seconded
by Trustee Fatal H. Weekly, and upon vote being. taken thereon the following
voted in favor thereof

and the following voted against the same:
None
whereupon said resolution was declared duly passed and adopted.
Trustee Merrill :'3todghill introduced the following resolution and moved
its adoptions
BE IT RESOLTED by the Village Council of the Village of Brooklyn Center,
Minnesota, as fellows
1. The village shall forthwith issue its negotiable Storm Sewer
Improvement Bonds in the aggregate principal amount of $304,000, dated August 1,
1 5 , in the denomination of $1,,000 each, numbered I to 304, both inclusive,,
bearing interest at to rate of three and one - half per cent (3j%) payable
January 1, 1953, and semiannually thereafter on January 1 and July 1 in each
year, and maturing serially on January 1 in the years and amounts as follows.
1 .0oo in 1954 to 1972, both inclusive, all without option of prior payment.

. Both principal and interest on said bands shall be payable at the
main of'f'ice of the Fir National Bank of Minneapolis and the village will pay
the reasonable charges of said bank for its services as paying; agent.
3. The bonds and the interest coupons to be thereto attached shall
be in substantially the following form:

4. 11, is hereby determined that the estimated collection of special
assessments for Storm Sever 1*4rov ment No. 1 will provide the principal uum of
$304,000. and five per coot in excess thereof, and no ad valorem levy will be
required. All such special, asses Mme =t s are hereby lrrevo oally appropriated to
Storm Sever prove grit Rio. l w'und.. which shall be the .inking fund for said
bands
a. The village clerk is hereby authorized and directed '60 o — fain from
the county auditor his certificate that the bonds have 'been entered upo;x his
band register.
Via. The said bonds 41ften fully executed shall be delivered by the treaourer
to the purchaser thereof upon receipt or the purchase price, and the said purchaser
shall not be obligated to see to thc: proper application thereof.

6. It is heri by determined that the assessable cost of 3torra Sewe:<

9. The village; clerk with the assistance of the village eaxgineer shall
forthwith calculate the proper amount to be specs ll:r assessed fo?' the 14rolrement
against even assessable lot, piece or parcel of land within the district
affected in accordance with the previsions of Section bl_2. Minnesota Statutes,

KNOW ALL MEN BY THESE PREMTS That the Village of Brooklyn Center.,
Hennepin County, Minnesota, acknowledges itself to be indebted and for value
received hereby promises to pay to bearer the sum of ONE THOUSAND W AR','3 can
the 1st day of January,. 19 , without, olati of prier payment, arzd to pay
interest thereon from the date hereof until the principal amount is paid, at
the rate of three and one -half" per cent (3.5) per annum, interest to maturity
Payable January 1, 19`: 3, and semiannually thereafter on the 1st day of
January and the 1st day of Jul; in each year in accordance 4th and upon
presentation and surrender of the attached interest coupons as they severally
become due. Both principal tut` and interest on this bond are payable at the
main office of the First National Bank of Minneapolis in any coin or currency
of the United States of America which at the time of payment is legal - tender
for public and private debts.
This bond is one of an issue of bonds in the total princ amount of
3C 4jow all of like date and tenor except as to maturity, a1a. issued pursuant
to and in full conformity with the Constitution and Lags of the State of
Minnesota, i.ncl.kdin �c tion 412.:71, Minnesota ;statutes, and acts azaendatory
thereof and supplemental thereto, and is issued for the purpose of defraying
the expenses incurred and to be incurred, in a storm sewer improvement on certain
streets in said village, and is payable primarily from special assessments to
be levied against property specially benefitted thereby but constitutes a.
general obligation of the villa;e, and to provide moneys for the prompt and full
pay of said principal and interest as the same become due the full faith
and credit of the villages is hereby irrevocably pl--dg d, and the village will
levy taxes if requires,, for such purpose without limitation as to rate or amo unt.,
IT IS ffi2MY WRTIFM knD PMITEB That all acts, conditions and things
required by the Constitution and Lags of the State of Minnesota to be done, to
happen, and to be performed precedent to and in the issuance of this brand have
been done, have happened and &aye been performed in rea and due form, time
and manner as required by law and that this bond together with all other
indebtedness of the village outstanding on the date thereof and the date of its
actual issuance aznd Delivery, does not exceed tuay constitutional or statutory
r limitation thereon.
IN WITNESS WHEREOF, the Village of Brooklyn Center„ Hennepin County.,
Minnesota, by its `pillage Council., has caused this bond to be signed by the
Mayor and attested by the Vi.l.lage Clerk and sealed with the corporate seal of
the village., and the interest coupons hereto attached to be executed and
authenticated by the facsimile signatures of said officers, all as of the lst
