MEMORANDUM

SUBJECT: Gambling License Exemption Certificates for
St. Alphonsus
We previously notified you that St. Alphonsus had filed for
Charitable Gambling Exemption Certificates for the Church of
St. Alphonsus, The Rosary Altar Society and the Men's Club. We
were notified by church representatives today that the State
Charitable Gambling Board has dissallowed the applications for
the Rosary Altar Society and the Men's Club. In discussions
with the State Board they felt these were not all separate
organizations from the church. They did, however, decide that
the school would qualify as an exempt organization. The Board
also arbitrarily decided to merely change the name on the Men's
Club application to St. Alphonsus School. Therefore at this
time it appears we only have two exemption applications filed
for the Corporate Church of St. Alphonsus and St. Alphonsus
School.

SUBJECT: Lawful Gambling
The new State Statute regarding lawful gambling in the state
allows charitable organizations to have gambling events without
getting a license if they use five or fewer days per year for
their events and if they give less than $50,000.00 in prizes
during the year. They are required to file a Lawful Gambling
Exemption form in order to qualify. This form is similar to a
license application form in that the City must sign the form and
receive a copy. The City is also allowed the thirty days to
disallow the activity. If the City elects to disallow it must
pass a resolution and send a copy to the Charitable Gambling
Control Board. Also on the exemption form they must list the
dates of activity and specifically which of the five games
(bingo, raffles paddlewheels, tipboards, and pull -tabs) they
will or will not be having. The new Statute also allows the City
to charge an investigation fee of up to $250.00 if they desire.
The advantage to the organization for filing the exemption, if
they qualify, instead of a license is the record keeping. Under
the exemption they have a one -time filing within thirty days
after the event. With a license they must file monthly reports
for the entire year.
On May 21, 1986 the City received three exemption certificates.
The first is for the St. Alphonsus Rosary Altar Society for bingo
and raffles at the Fun Fair July 25, 26 and 27 and again at their
fall bazaar November 8 and 9. The second is for the Corporation
of the Church of St. Alphonsus for paddlewheels and pull -tabs at
the Fun Fair July 25, 26 and 27. The third is for the St.
Alphonsus Men's Club for paddlewheels and pull -tabs at the Fun
Fair July 25, 26 and 27. If no action is taken by the City
Council within 30 days, they will automatically become effective.
