HomeMy WebLinkAbout1966 10-17 CCM Special Session 255 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center In the County of Hennepin and State of NlM soLa October 17, 1966 The Village Council met in special session and was called to order by Mayor Philip Cohen at 8:10 P. M. Roll Call: Mayor Philip Cohen, Earl Simons, Howard Heck, john Leary and Theodore Willard were present. Also present were: D. G. Poss, James ,Johnston, Roger Van House, Richard Cihoski and Thomas O'Hehir. Motion by Theodore Willard and seconded by ,John Leary to approve the minutes of the October 10, 1966 Council meeting as recorded. Motion carried unanimously. Motion by Howard Heck and seconded by Theodore Willard to approve the minutes of the October 13, 1966 Council meeting as recorded. Voting In favor of the motion: Philip Cohen, Earl Simons, Howard Heck and Theodore Willard. Not voting: John Leary. Motion carried. Mayor Philip Cohen advised the members of the Council relative to a meeting conducted at 11:00 o'clock a.m. on October 17, 1966 at the Golden Valley office of the Minnesota Highway Department pertaining to the France Avenue - Trunk Highway No. 100 intersection. Specifically, the meeting was convened as a consequence of a fatal accident which occurred at the intersection on October l5, 1966. Mayor Cohen advised the members of the Council that the Minnesota Highway Department accepted the recommendation of the Village representatives to construct a barrier within the subject intersection which would prevent Cross traffic and left - hand turn movements through the intersection onto France Avenue, until such time the intersection is signalised. The Village Council then considered Application No. 66070 submitted by Donald Mortenson, said application requesting a variance from Section 35 -401 of the Village Ordinances, to allow construction of a carport/tool storage area three feet from the side property line at 4612 - 65th Avenue North. Following a review of the Planning Commission's recommendations on the subject application, the Mayor called upon all interested parties in attendance for their comments, After due consideration of all comments relative to the subject application, member john Leary moved and member Theodore Willard seconded that, on the basis of the Council's evaluation of all facts and on the basis of the Council's resulting determination that the application meets the standards for a variance, and that a hardship does in fact exist because of the converging side lot lines, that Application No. 66070 as submitted by Donald Mortenson be approved and that a variance be granted from Section 35 -401 to allow construction of the proposed structure three feet from the side property line. Motion carried unanimously. The Village Council next considered Application No. 66072 wherein approval was requested of the site plans for a proposed Red Owl food store operation at approximately 5425 Xerxes Avenue North. After a review of the Planning Commission's recommendations on the subject application,, and after due consideration of all comments offered by interested parties, member Howard Heck moved and member Earl Simons seconded that Application No. 66072 be approved as submitted. Motion carried unanimously. The Village Council next considered Application No. 66074 submitted by Frank Conlon, said application requesting a variance from Section 35 -401 to permit the erection of an addition to his existing home at 7001 Regent Avenue North, said addition to be located five feet from the west property line. Following a review of the Planning Commission's recommendations on the subject application, the Mayor called upon all interested parties in attendance for their comments. After due consideration of all comments and .. 1 ., 2 115)7 after examining the evidence submitted, member Theodore Willard moved and member Howard Heck seconded that it be the determination of the Village Councils after an evaluation of all the evidence, that the standards for variance as set out in Section 35 -221 have been met and that the subject property was platted in an irregular shape which reduced the buildable east - west dimension of the property at the building line to substantially less than the 90 -foot width required for corner lots and that a particular hardship would result due to this unique circumstance if the strict letter of the ordinance were to be carried out, and that therefore, Application No. 66074 be approved as submitted, and a variance be granted to allow construction of the proposed structure five feet from the west property line at 7001 Regent Avenue North. Motion carried unanimously. Motion carried unanimously. Motion by Howard Heck and seconded by Theodore Willard to amend the minutes of the Village Council Meeting of October 3, 1966 to reflect a salary for Recreation Department employee, Ted Haugen at the rate of $1.50 per hour, rather than $2.50 per hour. Motion carried unanimously. Motion by John Leary and seconded by Howard Heck to authorize release of a $5,,250. 00 subdivision bond for Smilden's Addition, and further to accept a Certificate of Deposit in the amount of $2,500.00 in lieu of a subdivision bond for said Smilden's Addition. Motion carried unanimously. Motion by Theodore Willard and seconded by Earl Simons to reduce the subdivision bond for 8obendrises 9th Addition from $1300.00 to $500.00. Motion carried unanimously. The Village Administrator advised the Village Council that James and John Sheehan, as owners of the Earle Brown Farm property, had filed an appeal with the State Tax Commissioner for an abatement of taxes payable in 1966, based upon their contention that they had not acquired title to the Property prior to the January 2, 1966 assessment date. Upon the Village Administrator's recommendation that the case is similar and related to an appeal by the University of Minnesota with respect to the same property, and since the Village of Brooklyn Center is presently represented by the legal firm of Lindquist, Magnuson & Glennon in its legal contest with the University of Minnesota, member John Leary moved and member Theodore Willard seconded that the firm of Lindquist, Magnuson & Glennon be retained to represent the Village of Brooklyn Center in the matter of the Sheehan tax appeal. Voting for the motion: Philip Cohen, John Teary, Earl Simons and Theodore Willard. Not voting: Howard Heck. Motion carried. Motion by Earl Simons and seconded by Howard Heck to adjourn.
