HomeMy WebLinkAbout1966 11-21 CCM Special Session r 299 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota November 21, 1966 The Village Council met in special session and was called to order by Mayor Philip Cohen at 7 :35 P.M. Roll Call: Mayor Philip Cohen, Earl Simons, Jahn Leary,, Howard Heck and Theodore Willard were present. Also present were: D.G. Poss, Ro9w Van House, James Johnston, Charles Van Eeckhout, Dale Hamilton, Thomas O'Hehir and Richard Cihoski. Motion by Theodore Willard and seconded by John Lea to approve the minutes of the November 8, 1966 Council meeting at which th Council sat as Canvass Board for the November 8, 1966 election, with co ctions as noted. Voting in favor of the motion: Philip Cohen, Earl Simons, Joh Leary and Theodore Willard, Not voting: Howard Heck. Motion carried, Motion by John Leary and seconded by Theodore Willa d to approve the minutes of the November 14, 1966 Council meeting as recorded. Motion carried unanimously. Motion by Howard Heck and seconded by John Leary t authorize the Administrator to advertise for bids on a material spreader, a dump truck, a station wagon and three (3) police patrol cars, such bids as are forthcoming to be opened on December 12, 1966. Motion carried unanimously. Member Theodore Willard introduced the following ordinance amendment In conjunction with Application No. 66066, and moved its adoption: AN ORDINANCE AMENDING SECTION 35 -815 OF THE VILLAGE O INANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTS t DO ORDAIN AS FOLLOWS: Sect,, ion 1. Section 35 -815 RESIDENCE- BUSINESS (RB) shall be amended by the addition of the following: "That part of Lot 4, Block 5, Wangstad's Brooklyn Terrace Addition, lying north of a line drawn parallel with and 138 feet north of the south line of Lot 4, measured at right angles, except State highway." Section 2 . This ordinance shall become effective from and after its passage and legal publication. The motion for the adoption of the foregoing ordinance amendment was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons,, Howard Heck, John Leary and Theodore Willard and the following voted agai st the same: none, whereupon said ordinance amendment was declared duly passed and adopted. Motion by John Leary and seconded by Earl Simons to pprove the purchase of the Brooklyn Center Fire Department Relief Associ tion of an $8, 200.00 Certificate of Deposit at the Camden Northwestern State Bank at the interest rate if 5 %. Motion carried unanimously. Motion by Howard Heck and seconded by Theodore WI lard to accept the recommendation of the Administrator and appoint Mr. Donald G. Bleichner of 172 Crown Road, Fridley, as a part -time Liquor Store Clerk at a salary of $1.50 per hour, effective November 17, 1966. Motion carried unanimously. -1- Motion by John Leary and seconded by Earl Simons to acdept the recommendation of the Administrator and appoint John Alan Berg of 1348 Buchanan Place, Columbia Heights, to the position of Clerk-Dispatcher in the Police Department beginning Wednesday, November 23, 1 66, at a salary of $431.00 per month. Motion carried unanimously. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -315 RESOLUTION ACCEPTING BID FOR THE CONSTRUCTIO OF HOCKEY RINK FLOODLIGHTING AT KYLAWN AND GRAND VIEW PARKS The motion for the adoption of the foregoing resolution was du y seconded by member Theodore Willard, and upon vote being taken therec n, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore Willard, and the following voted agai ist the same: none, whereupon said resolution was declared duly passed an adopted. Mr. Cohen left the meeting at 8 :00 P. M. and turned the chair over to Mayor Pro -tem Howard Heck. At 8:05 P.M. Mr. Cohen returned and assumed the chair. The next item to be considered was Application No. 6 073 submitted by Smestad and Engquist Construction Company. The application, requesting special use permission to allow the construction of two duplex dwellings at the properties at 3907 and 3913 - 52nd Avenue North, had been tabled by the Council at its October 14th meeting, as the applicant was not present. Following discussion of the application and consideration of c mments from those persons notified, and the recommendation of the Planning Commission, the following action was taken: Motion by Howard Heck and seconded by Theodore Willard that approval be granted to the special use request contained in Application No. 66073 to Permit two (2) duplex dwellings on the property at 3907 and 3913 - 52nd Avenue North (one duplex dwelling on each lot), inasmuch as the request meets the criteria specified in the zoning ordinance for special uses; provided further, however, that the following conditions be met: 1. That the rear (south) portion of the property not be filled to an elevation greater than that of the abutting properties to the east and west, and that the property be landscaped with sod; 2. That a performance bond be submitted to the Villag to cover the cost of such landscaping. Motion carried unanimously. The Council discussed the zoning map proposed by the Planning Commission, in conjunction with the proposed comprehensive zoning of the Village. Mr. John Leary, Chairman of an Appeals Committee consisting of himself, Mr. Theodore Willard and Mr. Lee Hart, Associated irector of Civil Service Personnel at the University of Minnesota, which committee was set up to hear the appeal of Lieutenant Lindgren of the Brooklyn Center Police Force, reported to the Council the recommendation of the Committee on this issue. Motion by John Leary and seconded by Howard Heck th at the Village Council accept the recommendation of the Appeals Committee set up to hear the appeal of Lieutenant Lindgren and hereby uphold the disciplinary action imposed by D.G. Poss, Village Administrator, and direct that the 2 -day suspension imposed by Mr. Poss be imposed upon Lieutenant I indgren. Motion carried unanimously ... -2- Mr. Miller, attorney for Lt. Lindgren and the Brooklyn Center Police Association, appeared before the Council and commented on the appeals procedure used in Mr. Lindgren's case, and requested that a 0 -day stay of imposition of the 2 -day suspension be allowed to allow time for he and Mr. Lindgren to determine if an appeal to the district cou should be made. Motion by Earl Simons and seconded by Theodore Willard to stay the imposition of the 2 -day suspension of Lt. Lindgren for a period of 10 days from this date, at the request of the appellant and his attorney. Motion carried unanimously. The Council returned to its discussion of the proposed zoning map. Mr. Willard left the meeting at 11:10 P.M. Motion by John Leary and seconded by Earl Simons to table action on Application No. 66069 submitted by John D. Sheehan. Motion carried unanimously. Motion by John Leary and seconded by Howard Heck t adjourn. Motion carried unanimously. The Village Council adjourned a 11:25 P.M. Mayor Clerk -3-
