July 10, 1967 The City Council met in regular session and was called to order by Mayor Philip Cohen at 7 :33 P, M. Roll Call: Philip Cohen, John Leary, Gordon Erickson, Howard Heck and Theodore Willard were present. Also present were D, G. Poss, Charles Van Eeckhout, Paul Holmlund, James Johnston, Thomas O'Hehir, Dale Hamilton, and Richard Cihoski. Civil Defense Director Ed Coleman and his assistant George Heenan, were present to challenge the Council and City Staff to a donkey baseball game to be held September 10, 1967 at 3 :00 P, M, Mr, Heenan issued the challenge to the Council and distributed the rules and regulations for the game. Motion by Theodore Willard and seconded by Gordon Erickson, to approve the minutes of the June 26, 1967 City Council meeting as submitted. Motion p carried uanimously. Mr. Poss discussed with the Council the proposed ordinance amendment to ha t C er 35 rezoning e P t g c rtain parcels at 6500 Osseo Road in conju n uncti n with Application No. 67019 submitted by Bermel -Smaby Realty Co. He noted that, in Ane with the Council's desires, that this property be developed to include the vacant land to its south (to the north of 65th Avenue), the applicant had attempted to purchase this land from its owner, the Osseo School District, but the initial offer had been refused by the Osseo School Board at it's July 5th meeting, He noted that he would contact the Osseo District Superintendent of Schools in regal to this matter in the near future, Motion by john Leary, seconded by Theodore Willard to declare a first reading of the following Ordinance: AN ORDINANCE AMENDING CHAPTER 35 BY THE ADDITION OF CERTAIN PROPERTIES TO THE R -B (RESIDENCE- BUSINESS) ZONING CJMSIFLq&TL0LJ Motion carried unanimously. (Section 5 -201. ADOPTION OF FIRE PREVENTION CODE. There is hereby adopted by the Village of Brooklyn Center for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the Fire Prevention Code recommended by the National Board of Fire Underwriters, being particularly the 1953 edition thereof and the whole thereof together with the 1954 amendments thereto, save and except such portions as are inconsistent with other Village ordinances, of which code not less than three (3) copies have been and now are filed in the office of the Clerk of the Village of Brooklyn Center and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the Village of Brooklyn Center.) Section 2: This ordinance shall be effective after adoption and thirty days following its legal publication. Adopted this 10th day of July, 1967. The motion for the adoption of the foregoing Ordinance was duly seconded by member Theodore Willard, and upon a vote being taken thereon the following voted in favor thereof: Philip Cohen, John Leary, Gordon Erickson, Howard fleck, and Theodore Willard, and the following voted against the same: none, where- upon said Ordinance was declared duly passed and adopted, Member Theodore Willard introduced the following Ordinance, moved to declare a complete second reading and further moved it's adoption; ORDINANCE NO. 67 -11 AN ORDINANCE RELATING TO THE ELIGIBILITY OF CERTAIN PLACES WITH REGARD TO THEIR LICENSING FOR SALES OF UO THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS: Section 1: Chapter 11, Section 11 -107 PLACES INELIGIBLE FOR LICENSE, of the Ordinances of the City of Brooklyn Center are hereby amended by the deletion of the following: (Subdivision 2. No "On Sale" license shall be granted for any place within 600 feet of any public or parochial school or within 600 feet of any church. For the purposes of determining this measurement, the distance shall be measured in a straight line between the nearest points of the two buildings.) Section 2: Subdivision 3 of Section 11 -107 of the ordinances of the City of Brooklyn Center is hereby renumbered to Subdivision 2. The motion for the adoption of the foregoing ordinance was duly seconded by member Gordon Erickson, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Gordon Erickson, Howard Heck, and Theodore Willard, and the following voted against the same: none, whereupon said ordinance was declared duly pas sod and adopted. Councilman Theodore Willard reopened discussion of the proposed amend - ments to the Animal Ordinance relating to the keeping of dogs within the City, which had been tabled at the June 26th meeting. He suggested several possible changes to the Council that would make the Ordinance amendment more acceptable and more workable, suggesting that perhaps the City Staff should pursue these general guidelines and propose the proper amendments to the Council. Motion by Theodore Willard, seconded by john Leary that the proposed Ordinance amendment relating to the keeping of dogs be tabled until after August 21, 1967 to, allow the staff time to prepare proposed changes to the existing ordinance. Motion carried unanimously. The Mayor announced that the meeting was open for the consideration of proposed, Storm Sewer Improvement Project No. 1967 -41. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks publication thereof in the official newspaper, the last publication being on July 6, 1967, which affidavit was examine and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present ar either for or ag � ga net the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Theodore 'Willard introduced the following resolution and moved its adoption: RESOLUTION NO. 67 -209 RESOLUTION ORDERING CONSTRUCTION OF STORM SEWER IMPROVEbZNT PROTECT, NO. 1967 -41 The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon voted being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Howard Heck, Gordon Erickson and Theodore Willard; and the follow voted a the same, none whereupon �g g , said resolution was declared duly passed and adopted. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Gordon Erickson Introduced the following resolution and moved its adoption: -4- L 211 RESOLUTION NO. 67 -210 RESOLUTION ORDERING CONSTRUCTION OF STREET SURFACING, IMPROVEhZN,T PROJECT NO, 1967-40 The motion for the adoption of the foregoing resolution was duly seconded by member Theodore Willard, and upon vote being taken thereon, the following voted In favor thereof: Philip Cohen, John Leary, Gordon Erickson, Howard Heck and Theodore Willard; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. The Council then considered Application No. 67026 and 67027 submitted by Darrel Farr requesting, respectively, approval of a preliminary plat and rezoning to R -3 and R -S, for property to the north and west of June Avenue and County Road 10. Motion by John Leary and seconded by Theodore Willard to reopen the public hearing on Application No. 67026 and 67027 which was closed at the June 12th meeting. Motion carried unanimously. A lengthy discussion ensued between the Council, the applicant, and interested parties in attendance, including representation from the Upper Twin Lake Association. The consensus of the Council was that, due to the numerous factors involved in the development of t1ts property, further time for study would be necessary. Motion by Howard Heck and seconded by John Leary to close the public hearings on Application No. 67026 and No. 67027. Motion carried unanimously. Motion by Theodore Willard and seconded by John Leary to table Applications 67026 and 67027 until the meeting of August 21, 1967. Motion carried unanimously. The applicant noted that the tabling was acceptable to .him, and offered to provide further information on the project to the Council. The meeting recessed at 10 :15 P.M. and resumed at 10 :30 P.M.
