HomeMy WebLinkAbout1966 02-07 CCM Special Session 281 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota February 7, 1966 The Village Council met in special session and was called to order by Mayor Philip Cohen at 8 :10 P. M. Roll Call: Mayor Philip Cohen, Earl Simons, John Leary, Howard Heck and Theodore Willard. Also present were: A. J. Lee, D. G. Poss, T. L. Hadd, P.W. Holmlund, Roger Van House and James Johnston. Motion by Theodore Willard and seconded by Howard Heck to approve the minutes of the January 31, 1966 meeting as, recorded. Motion carried unanimously. Motion by Theodore Willard and seconded by John Leary to correct Resolution No. 66 -17 by substituting "B -3" for "R -3" wherever it appears in the resolution. Motion carried unanimously. Member John Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -20 RESOLUTION REGARDING APPLICATION NO. 65065 FOR REZONING FROM R -1 TO B -3 The motion for the adoption of the foregoing resolution was duly seconded by member Earl Simons and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, John Leary, Howard Heck and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -21 RESOLUTION ACKNOWLEDGING RECEIPT OF CHRYSLER MOTORS CORPORATION AGREEMENT AS TO USE OF PROPERTY AND AUTHORIZING MAYOR MD Cj&RK TO EXECUTE IN ACCEPTANCE The motion for the adoption of the foregoing resolution was duly seconded by member Theodore Willard and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore A'illard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Member Earl Simons introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -22 RESOLUTION ACKNOWLEDGING RECEIPT OF CHRYSLER MOTORS AGREE MENT AS TO PROPOSED ZONING ORDINANCE AND &UTHORIZINg MAYOR AND CLERK TO EXECM IN ACCEPTANCE The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck and upon vote being taken thereon, the following_ voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. -1 r 233 Member john Leary introduced the following Ordinance Amendment, moved to waive the requirement for two readings and further moved the adoption of the ordinance amendment: AN ORDINANCE AMENDING SECTION 35 -840 OF THE VILLAGE OB21HANCES, RY ADD111ON TBERE TO Section 1. Section 35 -840 is hereby amended by the addition thereto of the following: Tract "A" Registered Land Survey No. 910, office of the Registrar of Titles, Hennepin County, Minnesota, and also that part of Lot 23, Auditors Subdivision No. 25, Hennepin County, Minnesota, described as follows: Commencing in the center line of State Highway No. 152, distant 85 feet Southeasterly along said center line from the North line of said Lot 23; thence Southeasterly along said center line 80 feet; thence south 69 West 180 feet; thence Northwesterly parallel with the road 100 feet; thence Northeasterly to the point of beginning. Also that part of Lot 23, Auditor's Subdivision No. 25, Hennepin County, Minnesota, described as follows: Commencing 1508.85 feet East and 182 feet North from the Southwest corner of said Lot 23; thence East 334 feet; thence North 69 East 119 feet; thence Northwesterly parallel with the road 100 feet; thence Northeasterly to a point in the center line of State Highway No. 152, distant 85 feet Southeasterly from its intersection with the North line of said Lot 23; thence Northwesterly along said center line 85 feet to said North line; thence West 543 feet; thence South 258.25 feet to the point of beginning; except that part of the above parcels for State Trunk Highway No. 152, which lies Northeasterly of a line run parallel with and distant 42 feet Southwesterly of the following described line: From a point on the North line of Section 3 , Town - ship 118 North, Range 21 West, distant 1741.08 feet West of the Northeast corner thereof, run Southeasterly at an angle of 68 01 minutes, 52.3 seconds with said North section line for 104.54 feet; thence deflect to the right at an angle of 17 20 minutes, 35.2 seconds, for 536.92 feet to the point of beginning of the line to be described; thence run Northwesterly along the last des- cribed course for 100 feet; thence deflect to the left on a 2 00 minute curve (delta angle 17 0 , 20 minutes, 35.2 seconds) for 867.16 feet; thence deflect to the left on a 0 15 minute curve (delta angle 1 0 29 minutes, 54.8 seconds) for 599.42 feet and there terminating. Section 2. This ordinance shall be effective from and after its legal publication. The motion for the adoption of the foregoing ordinance amendment was duly seconded by member Earl Simons, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, john Leary and Theodore Willard; and the following voted against the same: none, whereupon said ordinance amendment was declared duly passed and adopted. - 2- r 235 Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -23 RESOLUTION ACCEPTING PROPOSAL OF NORTHERN STATES POWER COMPANY FOR THE PROVISION OF STREET LMHIING S SFRVI!M The motion for the adoption of the foregoing resolution was duly seconded by member Theodore Willard and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, John Leary, Howard Heck and Theodore Willard, and the following voted against the same; none, whereupon said resolution was declared duly passed and adopted. Motion by Theodore Willard and seconded by Howard Heck to direct the zoning official to issue a temporary Certificate of Occupancy to the O.B. Thompson Electric Company at 6822 Osseo Road North, upon meeting by the petitioner of the following requirements: 1. The petitioner shall post a performance bond in the amount of $2, 000 to guarantee the grading and surfacing of the parking area in accordance with a plan to be approved by the Village Engineer. 2. No parking shall be permitted in front of the building. 3. The petitioner shall install and maintain a green strip in front of the building. Motion carried unanimously. Motion by John Leary and seconded by Howard Heck to accept the resignations from the Industrial Development Commission of: Robert Sidlo - effective November 9, 1965. Robert Oslund - effective January 11, 1966. Motion carried unanimously. Motion by John Leary and seconded by Theodore Willard to establish a committee to review the function and activities of the Industrial Develop- ment Commission, the membership of said committee to be as follows: 2 members of the Village Council, 2 members of the Industrial Development Commission, 1 member of the Planning Commission, 1 member of the Chamber of Commerce, and the Village Administrator. Motion carried unanimously. Motion by John Leary and seconded by Howard Heck to accept the recommendation of the Administrator and appoint Floyd Entner as part time Liquor Store Clerk at a salary of $1.50 per hour effective 2 -7 -66. Motion carried unanimously.
