HomeMy WebLinkAbout1966 04-04 CCM Special Session r 171 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of rr r Minnesota April 4, 1966 The Village Council met in special session and was called to order by mayor Pro -tem Howard Heck at 7:30 P.M. Roll Call: Howard Heck, John Leary, Earl Simons and Theodore Willard. Absent: Mayor Philip Cohen. Also present were: A. J. Lee, D. G. Poss, T. L. Hadd, P. W. Holmlund, Roger Van House, James Johnston, Thomas O'Hehir, Eugene Hagel and Ray Ecklund. Motion by Theodore Willard and seconded by John Leary to approve the minutes of the March 28, 1966 meeting as recorded. Motion carried unanimously. Motion by John Leary and seconded by Theodore Willard to accept the recommendation of the Administrator and appoint Felix Kampa as a temporary Street Department laborer, effective April 4, 1966, at a salary of $2.20 per hour. Motion carried unanimously. Member John Leary introduced the following ordinance amendment, moved to waive a complete second reading, and further moved its adoption: AN ORDINANCE AMENDING CHAPTER 23 OF THE VILLAGE O INANCES - 99NIML LICENSING RE THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Section 23 -010 - LICENSE FEES of the Village Ordinances is hereby amended to read as follows: Section 23 -010 LICENSE FEES. Delete and abolish the following: Electrical 3 -808 April 30 $20.00 Plumbing 3 -507 April 30 $20.00 Section 2. This ordinance shall be effective from and after its legal publication. The motion for the adoption of the foregoing ordinance amendment and waiver of second reading was duly seconded by member Theodore Willard, and upon vote being taken thereon, the following voted in favor thereof: Howard Heck, Earl Simons, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said ordinance amendment was declared duly passed and adopted. Member Earl Simons introduced the following ordinance amendment, moved to waive a complete second reading, and further moved its adoption: AN ORDINANCE AMENDING CHAPTER 3 OF THE VILLAGE ORDINANCES - ELECTRICAL THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Section 3 -804. PERMITS, of the Village Ordinances is hereby amended to read as follows: -1- r - 173 Section 3-804. PERMITS. No person, firm or corporation shall engage in the business of installing, altering or repairing electric wiring or fixtures for any purpose whatsoever in this Village without first having procured a permit therefor as herein provided. Permits shall be issued only to individuals or contractors licensed as master electricians by the State Board of Electricity covering all journeymen and apprentices employed by him. No building shall be wired for the placing of any electric lights, motors, heating devices, or any apparatus requiring the use of electrical current, nor shall any alteration or additions be made in the existing wiring of any building, nor shall any alteration be made in the wiring in any building after inspection and approval without first notifying the electrical inspector and securing a permit therefor. Minor repairs such as the repair or replacement of flush and snap switches, replacement of fuses, changing of lamp sockets and receptacles, taping bare joints, repairing drop cords, replacement or repair of heating elements and replacement motors shall be excepted from the above provision. Section 2. Section 3 -808, 3 -809, 3 -810 3- 810.1 of present ordinances regulating the same subject matter is specifically repealed and shall be deleted and removed from the Official Book of Ordinances of the Village of Brooklyn Center. Section 3. This ordinance shall be effective from and after its legal publication. The motion for the adoption of the foregoing ordinance amendment and waiver of second reading was duly seconded by member John Leary, and upon vote being taken thereon, the following voted in favor thereof: Howard Heck, Earl Simons, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said ordinance amendment was declared duly passed and adopted. Member Theodore Willard introduced the following ordinance amendment, moved to waive a complete second reading, and further moved its adoption: AN ORDINANCE AMENDING CHAPTER 3 OF THE VILLAGE ORDINANCES PLUMBING THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Section 3 -504 - AMENDMENTS TO THE CITY OF MINNEAPOLIS CODE is hereby amended to read as follows: Section 3 -504 AMENDMENTS TO THE CITY OF MINNEAPOLIS CODE. (a) Permits shall be issued only to individuals or contractors licensed as master plumbers by the Minnesota State Board of Health. No permits will be issued to the home owner for sewer and water connections. Anyone not obtaining a permit may do plumbing work which complies with the provisions of the minimum standards herein prescribed on premises or that part of premises owned and actually occupied by him as his home - stead if he shall file with the Inspector an affidavit showing that he performed the actual work himself in such homestead. No journeyman shall install plumbing as herein defined unless he is authorized to do so under the State Plumbing Code. (b) The applicant shall furnish a surety bond of $4, 00 to the Village of Brooklyn Center to compensate the Village for any damages caused to the Village water system and appurtenances and Village sewer system and appurtenances. -2- 177 (c) No permit shall be issued unless and until the applicant shall first file with the Village Clerk certificates of insurance issued by a company or companies duly licensed to do business in the State of Minnesota which shall include manufacturers and contractors liability, independent contractors liability, products and completed operations liability, automobile liability including employers non - ownership liability in not less than the following amounts: Bodily injury liability: $100,000.00 each person $300,000.00 for injuries as the result of any one occurrence. Property damage liability: $ 50,000.00 each accident $100 , 000.00 aggregate Automobile liability: Bodily injury: $100,000.00 each person $300, 000.00 each occurrence Property Damage: $50, 000.00 each occurrence Any such evidence or certificate or certificates shall provide that it may not be cancelled by the insurer except upon ten days written notice to the Village of Brooklyn Center. In case of cancellation of such insurance, such license shall be suspended automatically until such insurance has been replaced. Section 2. This ordinance shall be effective from and after its legal publication. The motion for the adoption of the foregoing ordinance amendment and waiver of second reading was duly seconded by member Earl Simons, and upon vote being taken thereon, the following voted in favor thereof: Howard Heck, Earl Simons, john Leary and Theodore Willard, and the following voted against the same: none, whereupon said ordinance amendment was declared duly passed and adopted. Mayor Philip Cohen entered the meeting at 9 :15 P. M. and assumed the chair. Motion by john Leary and seconded by Theodore Millard to recommend to the Park and Recreation Advisory Commission that an infor- mation hearing be conducted in regard to the proposed Northeast neighbor- hood play lot. Motion carried unanimously. Motion by Earl Simons and seconded by john Leary to a pp rove the following licenses: Food Establishment License Brooklyn Center High School 6500 Humboldt Ave. No. Food Vehicle Ucecen_se: Ewald Bros. Inc. 2919 Golden Valley Road Food Vending License: Mr. Ron's House of Beauty 4300 - 69th Ave. No. Cigarette License: Humboldt Dairy 1500 - 55th Ave. No. Off Sale Malt License: Humboldt Dairy 1500 - 55th Ave. No. Motion carried unanimously. -3- r 179 Motion by Theodore Willard and seconded by Howard Heck to direct the Administrator to prepare a resolution to transfer the $70,000.00 from various surplus accounts to Park Capital improvement Appropriation.
