HomeMy WebLinkAbout1966 04-11 CCM Regular Session 5 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of ,___Minnesota April 11, 1966 The Village Council met in regular session and was called to order by Mayor Philip Cohen at 7 :30 P.M. Roll Call: Mayor Philip Cohen, Howard Heck, john Leary, Earl Simons and Theodore Willard. Also present were: A. J. Lee, D. G. Poss, T. L. Hadd, P. W. Holmlund, Roger Van House, James Johnston, Thomas O'Hehir and jean Murphey. Reverend Henry Ramus of the Brook Park Baptist Church offered the invocation. Motion by Howard Heck and seconded by john Leary to approve the minutes of the April 4, 1966 meeting as recorded. Motion carried unanimously. Motion by john Leary and seconded by Theodore Willard to rescind the Council action of April 4, 1966 amending portions of Chapter 3 of the Village Ordinances concerning electrical licenses. Motion carried unanimously. Motion by john Leary and seconded by Theodore Willard to rescind the Council action of April 4, 1966 amending portions of Chapter 3 of the Village Ordinances concerning plumbing licenses. Motion carried unanimously. Member Howard Heck introduced the following ordinance amendment, moved to waive a complete second reading, nd further moved its adoption: 9, p AN ORDINANCE AMENDING CHAPTER 3 OF THE VILLAGE THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Section 3 -504 - AMENDMENTS TO THE CITY OF MINNEAPOLIS CODE IS hereby amended to read as follows: Section 3 -504, AMENDMENTS TO THE CITY OF MINNEAPOLIS CODE. (a) Permits shall be issued only to individuals or contractors licensed as master plumbers by the Minnesota State Board of Health, except an individual may obtain a permit and may do plumbing work which complies with the provisions of the minimum standards herein prescribed on premises or that part of premises owned and actually occupied by him as his home- stead if he shall file with the Inspector an affidavit showing that he is performing the actual work himself in such homestead. No permits will be issued to the home owner for sewer and water connections. No journeyman shall install plumbing as herein defined unless he is authorized to do so under the State Plumbing Code. (b) The applicant, except an individual doing work on his own homestead, shall first file a surety bond of $4, 000.00 running to the Village of Brooklyn Center to compensate the Village for any damages caused to the Village water system and appurtenances and Village sewer system and appurtenances. -1- 519 (c) The applicant, except an individual doing work on his own homestead, shall first file with the Village Clerk certificates of insurance issued by a company or companies duly licensed to do business in the State of Minnesota which shall be written on the comprehensive liability form and shall include manufacturers and contractors liability, independent contractors liability, products and completed operations liability, automobile liability including employers non- ownership liability in not less than the following amounts: Bodily injury liability: $100,000.00 each person $300, 000.00 for injuries as a result of any one occurrence. Property damage liability: $ 50, 000.00 each accident $100,000.00 aggregate Automobile liability: Bodily injury: $100,000.00 each person $300,000.00 each occurrence Property Damage: $ 50, 000.00 each occurrence Any such evidence or certificate or certificates shall provide that it may not be cancelled by the insurer except upon ten days written notice to the Village of Brooklyn Center. In case of can- cellation of such insurance, such license shall be suspended automatically until such insurance has been replaced. Section 2. This ordinance shall be effective from and after its legal publication. The motion for the adoption of the foregoing ordinance amendment was duly seconded by member Earl Simons, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, john Leary and Theodore Willard, and the following voted against the same: none, whereupon said ordinance amendment was declared duly passed and adopted. Member Theodore Willard introduced the following ordinance amendment, moved to waive a complete second reading, and further moved its adoption: AN ORDINANCE AMENDING CHAPTER 3 OF THE VILLAGE ORDINANCES - ELECTRICAL THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Section 3 -804 PERMITS, of the Village Ordinances is hereby amended to read as follows: Section 3 -804. PERMITS. (a) No person, firm or corporation shall engage in the business of installing, altering or repairing electric wiring or fixtures for any purpose whatsoever in this Village without first having pro - cured a permit therefor as herein provided. Permits shall be issued only to individuals or contractors licensed as master electricians by the State Board of Electricity covering all journeymen and apprentices employed by him, except an individual may obtain a permit and may do electrical work which complies with the provisions of the minimum standards herein prescribed on premises or that part of premises owned and actually occupied by him as his homestead if he shall file with the inspector an affidavit showing that he is performing the actual work himself in such homestead. -2- 61 No building shall be wired for the placing of any electric lights, motors, heating devices, or any apparatus requiring the use of electrical current, nor shall any alteration or additions be made in the existing wiring of any building, nor shall any alteration be made in the wiring in any building after inspection and approval without first notifying the electrical inspector and securing a permit therefor. Minor repairs such as the repair or replacement of flush and snap switches, replacement of fuses, changing lamp sockets and receptacles, taping bare joints, repairing drop cords, replacement or repair of heating elements and replacement motors shall be excepted from the above provision. Member Theodore Willard introduced the following resolution and moved its adoption: . RESOLUTION NO. 66 -69 RESOLUTION AMENDING THE 1966 PARK GENERAL FUND BUDGET -3- 65 The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Member Earl Simons introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -70 RESOLUTION ACCEPTING BID FOR RNIS N BITUMINORS O The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -71 RESOLUTION ACCEPTING BID FOR PUNT -MIXED BITUMINOUS ,�.IA-L _ The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Member Theodore Willard introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -72 RESOLUTION ACCEPTING BID FOR STABILIZED GRAVEL AND FINE AQGREQ= FOR SEA The motion for the adoption of the foregoing resolution was duly seconded by member Earl Simons, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Member John Leary introduced the following resolution and moved its adoption; RESOLUTION NO. 66-73 RE SOLUTION E BID FOR O NZTA PIPE The motion for the adoption of the foregoing resolution was duly seconded by member Theodore Willard, and upon vote being taken thereon the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -74 RESOLUTION ACCEPTING BID FOR FURNISHING OF WATER TREATMENT Q F-IE M ICALS -4- r The motion for the adoption of the foregoing resolution was duly seconded by 67 member Earl Simons, and upon vote being taken thereon the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, john Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Member John Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -75 RESOLUTION ACCEPTING BIDS FOR GASOLINE, FUEL OIL FOR HEATING AND DIESEL FUEL OIL The motion for the adoption of the foregoing resolution was duly seconded by member Theodore Willard and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for consideration of the following proposed improvement projects: Water Main Improvement Project No. 1966 -6, Street Surfacing Improvement Project No. 1966 -7 and Storm Sewer Improvement Project No. 1966 -3A. The Clerk produced affidavits of publication of notice of hearing on the proposed improvements showing two weeks' publication thereof in the official newspaper, the last publication being on April 6, 1966, which affidavits were examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvements. Motion by Howard Heck and seconded by Theodore Willard to temporarily adjourn the public hearing on Water Main Improvement Project No. 1966 -6. Motion carried unanimously. Motion by John Leary and seconded by Earl Simons to temporarily adjourn the public hearing on Street Surfacing Improvement Project No. 1966 -7. Motion carried unanimously. Motion by John Leary and seconded by Theodore Willard to temporarily adjourn the public hearing on Storm Sewer Improvement Project No. 1966 -3A. Motion carried unanimously. The Mayor announced that the meeting was open for the consideration of proposed Grading, Base and Surfacing Improvement Project No. 1966 -1. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks publication thereof in the official newspaper, the last publication being on April 6, 1966, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Earl Simons introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -76 RESOLUTION ORDERING CONSTRUCTION OF GRADING, BASE AND SURFACING IMPROVEMENT PROJECT NO, 1966 -1 The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. _5 - r 69 The Mayor announced that the meeting was open for the consideration of proposed Curb and Gutter Improvement Project No. 1966 -2. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 6, 1966, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Theodore Willard introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -77 RESOLUTION ORDERING CONSTRUCTION OF CURB & GUTTER IMPROUMENT PROJECT NO, 1966 -2 The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, ,john Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Howard Heck introduced the following resolution and moved its adoption; RESOLUTION NO. 66 -78 RESOLUTION ORDERING CONSTRUCTION OF STORM SEWER IMPROVEMEN'li PROJECT NO, 1966 -3 The motion for the adoption of the foregoing resolution was duly seconded by member john Leary, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, john Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Motion by Howard Heck and seconded by Theodore Willard to recon- vene the public hearings on Improvement Project Nos. 1966 -6, 1966 -7 and 1966 -3A. Motion carried unanimously. The Council then heard additional arguments for and against the proposed improvement projects. Motion by Howard Heck and seconded by john Leary to adjourn the hearings on Improvement Project Nos. 1966 -6, 1966 -7 and 1966 -3A, said hearings to be reconvened at 8 :00 P.M. on April 25, 1966 at the Village Hall. Motion carried unanimously. Motion by Earl Simons and seconded by john Leary to order paid the bills set forth in the schedule dated April 11, 1966. Member Earl Simons introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -79 RESOLUTION APPROVING PLANS, SPECIAL PROVISIONS AND SPECIFICATIONS FOR GRADING, BASE & SURFACING AND BRIDGE ON T. H. 100 FROM 1000 FEET WEST OF SHINGLE CREEK TO 1 C ON OFT H. 94 The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, John Leary, Howard Heck and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Member John Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 66-80 RESOLUTION APPROVING PLANS, SPECIAL PROVISIONS AND SPECIFICATIONS FOR ELECTRICAL LIGHTING SYSTEM AT T 100 AM QOUNTY B= 10 The motion for the adoption of the foregoing resolution was duly seconded by member Theodore Willard, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, John Lary, Howard Heck and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Member john Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -81 RESOLUTION REJECTING BIDS FOR FURNISHING OF COLD WATER hgTERS The motion for the adoption of the foregoing resolution was duly seconded by member Earl Simons, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck, John Leary and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. 7- 3 Motion by Howard Heck and seconded by john Leary to adjourn.
