159 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center In the County of Hennepin and State of A&nesota December 28, 1564 The Village Council met in regular session and was called to order by Mayor Gordon Erickson at 7;35 P. M. Roll Call:- Present were Mayor Gordon Erickson, Phil Cohen, John Leary, Henry Dorff and Howard Heck. Rev. Breitholtz offered the invocation. Motion by John Leary and seconded by Howard Heck to approve the minutes of the December 21, 1964 Council meeting. Motion carried unanimously: Member Howard Heck introduced the following ordinance amendment and moved its adoption; ORDINANCE AMENDING SECTION 35 OF THE VILjagE ORD,2IANC£S THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS • POLL � OVA S. Section 1: Section 35 -220 of the Village Ordinances is hereby amended to read as follows; Section 35 -220. Variances. The procedure for obtaining a variance from the requirements of this ordinance shall be as follows; I. The .petitioner shall fill out and submit to the Building Department a "Zoning Form ", copies of which are available at the Village Hall, together with a fee of $ 00. 2. The Building Department shall refer the petition to the Planning Commis sion, together with its comments therein, 3,. Notice of such hearing shall be mailed at least seven days in advance of the hearing to the petitioner and the property owners or Occupftlt of all property within 150 feet (including streets) Of thw PfOpertY in question. Failure of any property owner or occupants to receive such notice shall not invalidate the proceedings hereunder. 4. The Planning Commission shall consider the petition at its next regular meeting, but not earlier than seven days.. S. The petitioner or his representative shall appear before the Planning Commission at the time and place stated in such notice„ in order to answer questions concerning the proposed variance. 6. The petition and report of the Planning Commission shall be placed on the agenda of the Council at its next regular meeting following referral from the Planning Commission, 7. The Council must take action on the petition within 60 days after receiving the reports of the Planning Commission. If it grants the variance, the Council may impose conditions it considers necessary to protect the public health, safety, and welfare. -1- 157 Sec110„42. This ordinance shall be effective from and after -its publication. The motion fqr the adoption of the foregoing ordinance was duly seconded by member Henry DoarFf and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff,, john Leary,,, Howard Neck and Phil Cohen and the following voted against the same: None; whereupon said ordinance was declared duly passed and adoptd. The Council discussed the proposed person i ordinance, Motion by Howard Heck and seconded by Phil Cohen to instruct the Administrator to draft a statement setting forth the present attitude ,of the Ctayncil pertaining to the residence of department heads in the Village. Motion carried unanimously. Motion by Howard Heck and seconded by Henry Dorff to deny the application of Beacon Bowl Cafe for an - on-sale's non - intoxicating beverage license. Motion by Phial Cohen a nd seconded WlMa Leary to defer consideration of licenses and fees for bowling alleys until the janubry 4, .19 65 Council. meeting. Motion carried ' unanimously. The bills having been audited, motion was maft br Nowy DMff and seconded by Howard Heck to order paid the bills set forth in the schedule attached to these minutes and made a part thereof. Motion carried unanimously. Motion by john Leary and seconded by Howard Heck to appoint Donald Berg to the position of inspector - draftsman at a salary cif $542, 00 Per month effective January 11, 1965 and authorize an increase in salary to $552.00 per month upon successful completion of the six month probationary period. Motion carried unanimously. Motion by Howard Heck and seconded by jam,, Leary to appoint Robert P. Withrow to the Position of police prttrolm eptive January ll., 1965.
