HomeMy WebLinkAbout1963 03-11 CCM Regular Session Minutes of the Proceedings of the Village 285 Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota March 11, 1963 The Village Council met in Regular session and was called to order by Mayor Gordon Erickson at 7 :35 P. M. Roll Call: Mayor Gordon Erickson, Phil Cohen, Henry Dorff and Howard Heck were present. John Leary was absent. Motion by Howard Heck and seconded by Phil Cohen to approve the minutes of March 4, 1963 as recorded. Motion carried. Member John Leary arrived at the Council meeting at 7 :38 P. M. Member Phil Cohen introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING LOAD LIMITS ON THE STREETS OF BROOKLYN CENTER BE IT RESOLVED by the Village of Brooklyn Center that the legal load limit on the streets of the Village of Brooklyn Center shall be (4) tons per axel, beginning on March 18, 1963 and continuing until such time as Hennepin County shall remove load restrictions from county roads. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted. i i Member John Leary introduced the following resolution and moved its adoption: i RESOLUTION ACCEPTING WORK (CONTRACTED BY VILLAGE) WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Lee Electric Co. has satisfactorily completed the following improvement in accordance with said contract: Time totalizers and alarm systems for Sanitary Sewer Lift Station No's. 1, 2, 3 , and 4 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved upon the recommendation of the Village Engineer. 2. The value of work performed exceeded the original amount by $27.53 because the location of two time totalizers in Lift Station No. 3 were revised after partial installation. 3. The Village Officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for such improvement project being $1,377.53. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon the following voted in favor thereof: Gordon Er ckson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the fol ing voted against the same: None; whereupon said resolution was du y passed and adopted. 1- 287 Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING MAYOR AND CLERK TO EXECUTE AGREEMENT WITH DE PART ME NT OF BUSINESS DEVELOPMENT, STATE OF MINNESOTA The Village _ of Brooklyn Center (Village, Township or City) (Name) BE IT RESOLVED THAT: The Village Council (Village or City Council or Town Board) of Brooklyn, Center, Minnesota, hereafter known as the community, hereby requests that the Department of Business Development, State of Minnesota, make application for an urban planning assistance grant in the amount of $18, 280.00 from the Federal Housing and Home .Finance Agency, as authorized under Section 701 of the Housing Act of 1954, as amended, for the purpose of providing planning assistance to the community. The governing body of the community hereby agrees to contribute $6, In cash and $2, 250.00 in the services of employees of the community to the Department of Business Development, when it is required, for the planning purposes as herein - after set forth. The Mayor and clerk are hereby authorized and directed on behalf of the community to enter into an agreement with the Department of Business Development, State of Minnesota in furtherance of its request for federal matching funds for planning purposes and to deposit in the State treasury, when there is needed, up to $6, 890.00 in cash and to pledge the services of official employees of the community to a value of $2,250.00 for planning services. The money so deposited and the services so pledged shall be available for expenditure and use by the Department of Business Development, State of Minnesota, when they have secured a matching federal grant. The money so deposited shall bear no interest and shall be returned to , the community if federal matching funds are not secured, and, in any event, after 2 years from the date of this resolution, if any balance remains unexpended or unobligated. The motion for the adoption of the foregoing resolution was duly seconded by member Phil Cohen, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Phil Cohen, Henry Dorff, John Leary and Howard Heck and the following voted against the same; None, whereupon said resolution was declared duly passed and adopted. Motion by John Leary and seconded by Howard Heck to determine that a 3 gang hydraulic lift vAbrthington mower is no longer needed by the Village of Brooklyn Center and to authorize the sale of the mower to the highest offer after advertising the mower for sale. Motion carried. Motion by Howard Heck and seconded by John Leary to authorize the Village Administrator, A. J. Lee, to attend the Advance Management Training Program in Chicago from May 5 to May 10, 1963. Member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION CONFIRMING SUPPLEMENTAL ASSESS - MENTS FOR SANITARY SEWER INTERCEPTOR AND LIFT STATIONS IMPROVEhIaENT NUMBER 1959 -19A, 1959 -19B, 1960 -2, 1960 -3, 1960 -4, 1960 -5, 1960 -6, AND PORTIONS OF SANITARY SEWER LATERALS 1960 -10, 1960 -12, 1960 -14, 1960 -20, 1960 -22, 1960 -41, 1960- 42, 1960 -45, and 1960 -51 and ;LIFT STATION 1960 -39, AND STORM SEWER INTERCEPTOR IMPROVEMENT NUMBER 1960 -7. -2- 989 BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center, as follows: 1. The Village Clerk has, with the assistance of the Engineer here- tofore selected by this council for such purpose, calculated the proper amounts to be specially supplementally assessed for the improvements, known as the improvements listed above of said Village against Parcel 2515, Aud. Sub. 309 described as commencing at SW corner of N 1/2 of Lot 21 thence E 267.2 feet thence No at right angles to So line of No 15 feet of Lot 21 thence E to a point 215.41 feet West from E line of Lot 21 thence N to N line thereof thence W to N W corner thereof thence S E ly to begin- ning and Parcel 2520, Aud. Sub. 309, described as that part of N 1/2 of Lot 21 lying S of N 15 feet thereof and E of a line running at right angles from a point in S line of N 1/2 of said lot distance 267.2 feet East from SW corner thereof, in accordance with the provisions of law, and has prepared and filed with the Village Clerk tabulated statements in duplicate showing the proper description of the above parcels of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published that this Council would meet in regular session on Monday Larch 11, 1963, to pass on the proposed supplemental assessments. 3. Said proposed supplemental assessments have at all times been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, If any, to such proposed supplemental assessments. 4. This Council finds that each of the parcels of land enumerated in said proposed supplemental assessments was and is specially benefitted by said improvements in the amount of said proposed supplemental assessments set opposite the description of each such parcel of land, and that amount so set out is hereby levied against each of the respective parcels of land therein described. S. Such proposed assessments are adopted and confirmed, and the sums fixed and named in said proposed assessments are affirmed, adopted and confirmed as the proper special supplemental assessments for each of said parcels of land respectively. 6. Said assessments as adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereon be and constitute the special assessments for the payment of the above listed improvements. 7. The amounts assessed against each parcel of land shall beat Interest from October 1, 1963 until the same have been paid at the rate of 6% per annum. 8. Such assessments shall be payable in equal installments beginning in the year 1964, payable on the 1st day of January in each year and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor, A. Supplemental assessment for Sanitary Sewer Interceptor Improvement numbers listed above, in seventeen equal annual installments. B. Supplemental assessment for Storm Sewer 1960 -7, in seventeen equal annual installments. 9. The Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon the 1st day of January in each year. -3- 291 The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck and upon vote being taken thereon, the - following voted in favor thereof! Motion by Phil Cohen and seconded by john Leary to approve the following licenses. Motion by John Leary and seconded by Howard Heck to appoint Charlotte Roe at the position of Coordinator - Instructor of the Teen Charm Clinic at a fee of $15 per session for five sessions. Motion carried. Member Phil Cohen introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING THE ACQUISITION OF TAX - FORFEITED LANDS WHEREAS, the Village of Brooklyn Center has received notice that certain properties, hereinafter more fully described, have been forfeited to the State of Minnesota for non- payment of taxes, and WHEREAS, said properties are needed for street purposes within the Village of Brooklyn Center and the acquisition of said properties will further the interests of the Village of Brooklyn Center, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the Mayor and Clerk are authorized and directed to initiate the necessary proceedings and execute the necessary documents to acquire the following described land for street purposes The West 30 feet of that part of Lot 49, Garcelon's Addition, lying South of the North 150 feet thereof. CIA& Mayor The motion for the adoption of the foregoing resolution was duly seconded by member John Leary and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. Motion by Phil Cohen and seconded by Howard Heck to authorize the Clerk to sign the necessary documents to abate delinquent taxes and secure tax exempt status for the following parcels of land: Plat 89103 Parcel 3020 Plat 89225 Parcel 4710 Plat 89104 Parcel 5710 Plat 89225 Parcel 3210. Motion carried. Member Phil Cohen introduced the following resolution and moved its adoption: RESOLUTION RELATING TO HENNEPIN COUNTY REDISTRICTING WHEREAS, the Board of Hennepin County Commissioners has on November 27,1962, by vote of four to one redistricted itself in a manner which ignores the views of a majority of Municipal Officials and Municipal Councils in Hennepin County, and, WHEREAS, the Hennepin County Commissioner Districts are drawn in a manner which will deprive the citizens outside the City of Minneapolis realistic representation on the County Board, and, WHEREAS, present legislation is inadequate to accomplish desirable representation on the County Board, -5- r - - 299 NOW THEREFORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that This Council urges the Legislature of the State of Minnesota at its 1963 Session to enact legislation which will provide for more adequate representation of all the citizens of Hennepin County on the Board of Hennepin County Commissioners. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary and upon vote being taken thereon the following voted In favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None, whereupon said resolution was declared duly eed and y pa adopted. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION RELATING TO PERA -OADSI QOVERAGE FOR EMPLOYEES WHEREAS, the Hennepin County League of Municipalities and League Of Minnesota Municipalities have adopted resolutions asking i'br legislation that would allow each present member of PERA the right to ehoos6 between continuing the present PERA retirement plan, or a plan combining full social security coverage with a modified PERA plan, and WHEREAS, this coverage will permit each Individual employee of the Village of Brooklyn Center to elect that form of retiremenf benefits which would be most beneficial to him, and i WHEREAS, the use of combined PERA and OADSI coverage for Village employees wo ld u not be likely o Increase Y rea the cost of retirement benefits paid by the Village, over what such cost would be if PERA coverage alone were continued, NOW THEREFORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that This Counc it favors legislation that would allow each member of PERA to elect to continue in the present PERA retirement plan or to elect to become a member of a retirement plan which combines full social security coverage with a modified i PERA plan. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, John Leary, Howard Heck, Henry Dorff and Phil Cohen and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted. Member Phil Cohen introduced the following resolution and moved its adoption: RESOLUTION OBJECTING TO SENATE FILE 243 AND TO HOUSE FILE 481 - A BILL FOR AN ACT RELATING TO WATER POLLUTION WHEREAS, the Village Council of the Village of Brooklyn Center is opposed to the passage of the above noted bill in its present form in that passage of the bill would make it difficult to defend the citizens of Brooklyn Center from excessive charges for sewage disposal service by the City of Minneapolis for the following reasons. 1. This bill will cancel the rate provisions of the present contract by allow#W the City of Minneapolis to fix new rates Immediately and then 5 years hence. - 6- 2. The Village of Brooklyn Center objects to the new rates going into 297 effect before hearing and litigation is complete. 3. The Village of Brooklyn Center objects to the contracting city being the agency holding the hearing under sections 15.0418 to 15.0422. The agency holding the hearing should be an impartial party. 4. In order to avoid endless. and expensive litgation, the legislation should state the basis of rates and charges in detail. a. The burden of proof concerning cost to be passed on should lie with the municipality owning the plant. b. Original cost, including any interest on bonds sold to finance a project, amortized over the useful life of the facility should be the basis for capital charges. The pro rata share of capital cost devoted to handling of sewage of connecting municipality, based upon the flow of sewage would be proper and fair. c. Operating cost passed on to the connecting municipality should Include only the operating cost up to that portion of the interceptor and trunk system devoted substantially to inter - municipal use anda. the portion of these costs passed on should be pro-rata on the basis of total sewage flow. d. In any event charges to the connecting municipality should not be more than the additional cost that the owning municipality incurs by virture of the connection of another municipality to its system. AND WHEREAS the Village of Brooklyn Center supports the Metropolitan District concept of sewage disposal and that engineering studies have proven that millions of taxpayers dollars will be saved throughout the metropolitan area through a unified approach. The contract system is inheritly weak in that it fails to recognize the need for construction of sewage treatment and collection facilities designed to meet the overall needs of an area rather than immediate interestsof two contracting parties, and in that the contract system fails to recognize the financial inability of fringe areas to finance sewer costs until substantial construction has taken place, with resulting assessed valuation, and pollution has already occurred. Since this is a State wide bill and since it is questionable when a metropolitan sewage bill will be passed, provisions should be built into a state wide bill requiring the develop- ment of an overall master plan of sewage disposal and collection for each contracting area which is subject to the approval of the State Water Pollution Control Board. BE IT HEREBY RESOLVED that the Village Council of the Village of Brooklyn Center does hereby oppose the adoption of Senate File 243 and House File 481 in its present form and BE IT FURTHER RESOLVED that the Village of Brooklyn Center supports legislation which would provide for the metropolitan district concept of sewage disposal. The motion for the adoption of foregoing resolution was duly seconded by member John Leary and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The bills having been audited motion was made by Henry Dorff and seconded by Howard Heck to order paid the hills set forth in the schedule attached to the minutes and made a part thereof. Motion carried. Motion by John Leary and seconded by Phil Cohen to adjourn. Motion carried.
