HomeMy WebLinkAbout1963 04-01 CCM Special Session r 100 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center In the County of Hennepin and State of Minnesota April 1, 1963 The Village Council met in Special Session and was called to order by Mayor Gordon Erickson at 7 :3 0 P. M. Roll Call: Mayor Gordon Erickson, Phil Cohen, henry Dorff, Howard Heck and John Leary were present. Motion by John Leary and seconded by Howard Heck to approve the minutes of March 25, 1963 as recorded. Motion carried. Member Phil Cohen, introduced the following resolution and moved its adoption; RESOLUTION DECLARING POLICY OF VILLAGE COUNCIL C NggRNING MAL4DATORY 11OOKUP TO 318M SMEM WHEREAS, the Village of Brooklyn Corder is engaged in the operation of a municipal water system through a Department of Public Utilities, and WHEREAS, a comprehensive expansion of the municipal water system is currently being planned, and WHEREAS, certain Village Council policy determinations are considered as being integral with the planning of the water system expansion, and WHEREAS, citizen concern has been expressed pertaining to a policy determination regarding mandatory hookup to the municipal water system, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: Those dwellings and buildings served by private wells prior to the installation of water mains in abutting streets shall not be required to be connected to the municipal water system; however, no now well permits shall be issued to properties abutting a municipal water main. Motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted. Member Howard Heck introduced the following resolution and moved Its adoption: RESOL ION D£ N APPLI ATION FOR PE IA USE PERM WHEREAS, Richard Fudali has submitted an application for a Special Use Permit for a 15 unit apartment building on a part of Government Lot 3, Section 36, Township 119, Range 21 (6358 Willow Lane), and WHEREAS, the Planning Commission has considered said application and recommends the denial of a Special Use Permit, and WHEREAS, the Village Council has determined that the issuance of the above described Special Use Permit does not meet the standards for a Special Use Permit set forth in Section 35 -231 of Village ordinances in the following instances: -1- 121. 1. The construction of the apartment house would be detrimental to the comfort of near by occupants of single family houses. 2. The construction of the apartment house would be injurious to the use and enjoyment of other property in the immediate vicinity, for the purposes already permitted in that zone. 3, The Special Use would impede the normal and orderly development of abutting property for single family residential use, which is the use permitted in this building district. 4. The access road to the property would become overloaded with the additional traffic generated by the construction of the apartment house. NOW, THEREFORE BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center that the action of the Planning Commission to deny application 63009 submitted by Richard Fudali for a Special Use Permit to construct a 15 unit apartment house at 6358 Willow Lane be upheld and the Special Use Permit be denied. The motion for the adoption of the foregoing resolution was duly seconded by member Phil Cohen and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, John Leary, Phil Cohen, Henry Dorff and Howard Heck and the following voted against the same; None; whereupon said resolution was duly passed and adopted. The Village Council discussed with State Representative John Wingard and representatives of the school districts, legislation which would establish state operated junior colleges and more particularly discussed the desirability of such a junior college being established in Brooklyn Center. 1 Motion by Henry Dorff and seconded by Phil Cohen that the Village Council determines that peat material excavated during the construction of County Road #10 between Highway #100 and Osseo Road, which is the responsibility of the Village of Brooklyn Center to dispose of, is not needed for Village purposes and the Village Council authorizes the sale of 2500 cubic yards of peat to St. Alphonsus Church at a price equal to the highest Price offered by black dirt haulers for the purchase of this material. Members Phil Cohen, John Leary, Gordon Erickson, Henry Dorff voting for the motion. Member Howard Heck abstained from voting. Motion carried. Motion by John Leary and seconded by Phil Cohen to authorize the expenditure of $1, 800 to the firm of Black and Veatch for the additional work to . be performed to complete a feasibility study. (Review of the 1962 operations updating the report to include the 1962 data, and review of the proposed bond ordinance) The $1,,800 fee to be expended from the Public Utilities fund. Motion carried. The motion by Howard Heck and seconded by Henry Dorff to appoint Mary Liapis a secretary in the Engineering Department, as a permanent employee. Motion carried. Member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK (CONTRACTED BY VILLAGE) WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Lee Electric Co. have satisfactorily completed the following improvement in accordance with said contract: Temporary Signal System at T. H. 152 & County Road 10 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Centers -2- r 1. The work completed under said contract is hereby 227 accepted and approved upon the recommendation of the Village Engineer. 2. The value of the work performed is the same as the original contract amount of $1, 000.00. 3. The Village Officials are hereby directed to issue Proper order for final payment on said contract, taking the contractor's receipt in full. The total amount Pa id for said improvement project being $1, 000.00. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote Ding taken thereon the following voted in favor thereof: Cordon Erickson Henry Dorff, john Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Motion by Phil Cohen and seconded by Howard Heck to uphold the action of the Planning Commission and authorize Shopper's City Inc. to operate a garden store in their parking lot from April 1, 1963 to July 15, 1963.
