HomeMy WebLinkAbout1963 07-01 CCM Special Session Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota July 1, 1963 The Village Council met in Special Session and was called to order by Mayor Gordon Erickson at 7 :30 P. , M. Roll Call: Mayor Gordon Erickson, Phil Cohen, John Leary, Henry Dorff and Howard Heck were present. The Rev. Bubna of Northbrook Alliance Church gave the invocation for the Council Meeting. Motion by Howard Heck and seconded by Phil Cohen to approve the minutes of the Council Meeting of June 24, 1963 as recorded. Motion carried. Motion by John Leary and seconded by Henry Dorff to uphold the action of the Planning Commission and approve application #63048 submitted by Harry Jensen and grant permission to construct a 12 unit apartment building at 4819 Azelia Avenue North provided that access to the parking lot shall be from Azelia Avenue. Motion carried. Motion by Phil Cohen and seconded by Howard Heck to uphold the action of the Planning Commission and approve application 63051 submitted by Futterman Corp. on the following condition: A bond in the amount of $3,500 shall be posted to guarantee submission of a site plan showing parking arrangement and all required site improvements, the plan shall be presented to the Planning Commission not later than September 1, 1963, and all construction shall be completed by July 1, 1964. Motion carried. The Mayor announced that the meeting was open for the consideration of proposed. Water Main Improvement No. 1963 -6. The Clerk produced an affidavit of publication of notice 'of hearing on the proposed improvement showing two weeks' publication thereof in the official` newspaper, the last publication being on June 27, 1963, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION ORDERING-: CONSTRUCTION OF WATER MAIN IMPROVEMENT NO. 1963 -6 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. It is. hereby determined that it is necessary and for the best Interests of the Village and the owners of property specially benefited thereby, that the following improvement shall be constructed: ' WATER MAIN IMPROVEMENT NO. 1963 -10 2. The plans and specifications for said improvement shall be prepared by Suburban Engineering Co. The motion for the adoption of the foregoing resolution was duly seconded by member Phil Cohen, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by John Leary and seconded by Howard Heck to uphold the action of the Planning Commission and approve application #63043 submitted by Marvin H. Nelson for a Special Use Permit for the Construction of 24 lane addition to the Lynbrook Bowl and to grant a variance on the front yard setback equal to the setback at the South East corner of the existing building. Motion carried. Motion by Howard Heck and seconded by Henry Dorff to uphold the action of the Planning Commission and approve application #63044 approving the parking lot layout for the expanded Lynbrook Bowl. Motion carried. -3- C, Member Phil Cohen introduced the following ordinance and moved its adoption: AN ORDINANCE AMENDING CHAPTER 35 or THE ORDINANCES OF THE VILLAGE OF BROOKLYN CENTER TO AMEND THE DEFINITION OF THE TERM "SETBACK" AND TO PROVIDE FOR GAP AGE SETBACKS THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN: Section 1. Section 35 -880 is hereby amended by amending the paragraph commencing with the word "Setback" to read as follows: Setback. The minimum horizontal distance between a building, hedge, fence, wall or structure and the street or lot line, dis- regarding, with respect to buildings, steps, unroofed porches, and overhangs. Section 2. Section 35 -401 is hereby amended by striking therefrom the first sentence in Footnote 3 and adding thereto a Footnote 4 to read as follows: *4. A garage must be set back at least 5 feet from the rear or side lot line, except that a garage may be set back 3 feet from the side lot line if the garage is located 20 feet or more to the rear of the house. Section 3. This ordinance shall be in full force and effect from and after its legal publication. The motion for the adopticmLof the foregoing ordinance was duly seconded by member John Leary and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Motion by John Leary and seconded by Howard Heck to approve the final plat of Kelly Estates and authorize the Mayor and Clerk to sign said plat. Motion carried. Motion by Howard Heck and seconded by John Leary to appoint Jerome Rath and Gerald Hudson as temporary laborers in the Street Department at a salary of $2.20 per hour. Motion carried. Motion by Phil Cohen and seconded by Howard Heck to increase the salary of Assistant Engineer Leroy Jaeger to $700 per month effective July 1. 1963. Motion carried. Motion by John Leary and seconded by Howard Heck to adjourn. Motion carried. The Village Council adjourned at 12 :30 A. M.
