HomeMy WebLinkAbout1963 07-22 CCM Regular Session 45 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota July V. 1963 The Village Council met in regular session and was called to order by Mayor Gordon Erickson at 7 :30 P. M. Roll Call: Mayor Gordon Erickson, Phil Cohen, john Leary, Howard Heck and Henry Dorff were present. Motion by John Leary and seconded by Phil Cohen to approve the minutes of the meeting of July 1S, 1963 as corrected. Motion carried. Motion by Phil Cohen and seconded by Henry Dorff to refer the request of the Futterman Corporation, as to the vacation of Lilac Drive, to the Planning Commission for their recommendation. Motion carried. Motion by Howard Heck, seconded by John Leary to approve the following licenses: Cesspool Cleaninghicense Northern Cesspool Cleaning Service Osseo, Minnesota Heating cense Anderson Sheet Metal Works 3328 East Lake Street Plumbing JAce __nsee Eastman Plumbing Inc. 561 -36 Ave. N.E. Motion Carried. Motion by Henry Dorff and seconded by Phil Cohen to accept the recommendation of the Fire Department and approve a permit for a fireworks display at St. Alphonsus Church on August 2, 3, and 4 in connection with their Fun Fair. Motion carried. Motion by Phil Cohen and seconded by Henry Dorff to appoint John Leary as the Council's representative on a Sewer Rate Study Committee and appoint Mr. Dorff as his alternate. Motion carried. Motion by john Leary and seconded by Howard Heck to continue the public hearing on Street Improvement Project No. 1963 - 14 until July 29 and to notify the property owners of the increased estimated cost of the project. Motion carried. The Mayor announced that the meeting was open for the consideration of proposed Street Surfacing Improvement No. 1963 - 15. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the Official newspaper, the last publication being on July 18, 1963, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Phil Cohen introduced the following resolution and moved its adoption. -1- 43 RESOLUTION ORDERING CONSTRUCTION OF STREET SURFACING IMPROVEMENT NO. 1963 -15 AND ORDERING P OF PLANS AND BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: I. It is hereby determined that it is necessary and for the best interests of the Village and the ow, of property 'gpecY benefited theceby,_that the following improvement small be con- structed: STREET SURFACING IMPROVEMENT NO, 1963 -15 2. The plans and specifications for said improvement shall be Prepared by the Village Engineer. 3. Said improvement shall be constructed by the Village Street Department on a force account basis. The motion for the adoption of the foregoing resolution was seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorff, Howard Heck, John Leary and Phil Cohen.and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Howard Heck introduced the following resolution and moved it's adoption: RESOLUTION DENYING APPROVAL OF STRUT SLFACM IMPROVNT NO, 1963 -16 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota as follows: 1. It is hereby determined that owners of more than 50% of the assessable footage do not favor the improvement. 2. The petition for the improvement is hereby denied. The motion for the adoption of the foregoing resolution was duly seconded by member Phil Cohen, and upon vote being taken thereon, the following voted In favor thereof: Gordon Erickson, Henry Dorff, Howard Heck, Phil Cohen, and John Leary and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. -2- �ALI 195- The Village Council held a discussion with Mr. Hodne, the Village Planner and the Planning Commission regarding the "701" Planning Program. The Village Council requested an opinion from the Village Attorney as to what course of action the Village Council can take to effectively control the construction of multiple dwellings in residential areas. The Village Administrator reported to the Village Council progress on securing compliance with the Village ordinance requiring hook -up to the Village sewer system. The Administrator was directed to prepare a list of the sewer connections according to the length of time that sewer has been available to the properties not now connected to the sewer system. Motion by Henry Dorff and seconded by john Leary to authorize an increase in the petty cash fund to $100.00. xv otion carried. " The bills having been audited, motion was made by Henry Dorff and 'r seconded by Phil Cohen to order payment of the bills set forth in the schedule attached to these minutes and made a part thereof. Motion carried. Motion by Howard Heck and seconded by John Leary to order inserted in the Village Council minutes the following statement by the Village Treasurer: I I The Village Treasurer informed the Council that he has been requested by the Finance Director to sign a receipt, in quadruplicate, for full payment of the receipt of the one million dollar bond issue for the water system prior to actual receipt of the money. At the request of the Council, and with the concurrence of the Village Attorney, the Treasurer agreed to sign said receipt. It was further agreed that the signed receipt will be kept in the possession of the Village Clerk until such time as a check for the bonds has been received by the Clerk. Motion by John Leary, seconded by Henry Dorff that the Mayor and the Clerk be authorized to execute a "Performance Agreement" with the Futterman Corporation regarding site improvements for Northbrook Shopping Center. Motion carried, Motion by Phil Cohen and seconded by john Leary to adjourn. The Village Council adjourned at 12:10 A. M.
