August 19, 1963 The Village Council met in Special Session and was called to order by Mayor Gordon Erickson at 7 :30 P. M. Roll Call: Mayor Gordon Erickson, Trustees John Leary, Phil Cohen and Howard Heck were present. Clerk Henry Dorff was absent. In the absence of Clerk Henry Dorff, A. J. Lee, Administrator recorded the minutes. Motion by John Leary and seconded by Howard Heck to approve the minutes as corrected. Motion carried. Member Phil Cohen introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED STREET SURFACING IMPROVEMENT NO „ 1963 -24„ WHEREAS, it is proposed that there be constructed an improvement consist- ing of a 2 -inch bituminous sand stabilised mat on Drew Avenue North from 52nd to 53rd Avenues. WHEREAS, The Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $1, 518.00. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota as follows: 1. The Council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Tuesday the 3rd day of September, 1963, at 8: 00 O'clock P. M. , and the Clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the Village. 3. The area proposed to be assessed for said improvement is as follows: ALL LOTS AND PARCELS ABUTTING THE ABOVE NAMED STREETS. 4. This proposed improvement shall be designated Street Surfacing Improvement No. 1963 -24. The motion for the adoption of the foregoing resolution was seconded by member John Leary, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of the proposed Street Surfacing Improvement No. 1963 -17. The�rk produced an affidavit of publication of notice of hearing on the proposet improvement showing two weeks' publication thereof in the offical newspaper, the last publication being on August 15, 1963 which affidavit was examined and found satisfactory and ordered placed on file. -1- The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections and it being determined that there may be less than 506 of the property owners in favor of the improvement the following motion was Introduced. Motion by Phil Cohen and seconded by Howard Heck to continue the public hearing on Street Improveme Project No. 1963 -11 til August 26 1963. Motion �Iried . �aw� e 3 . The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by Member john Leary, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, john Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said Improvement, member John Leary introduced the following resolution and moved. Its adoption. CONSTRUCTION OF GRADING AND STREET SURFACING IMPROVEMENT NO. 1963 - 19 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: -2- 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefited thereby, that the following improvement shall be constructed: Grading and Street Surfacing Improvement No. 1963 -19 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The Plans and Specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon, the following voted In favor thereof: Gordon Erickson, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution . was declared duly passed and adopted. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION A APPROVAL CO TRACT UTIO ACCEPTING BID AND N FORM WHEREAS, the Village Administrator, Assistant Administrator and the Village Engineer have reported that on August 19, 1963, at 10 :00 A. M. , they opened and tabulated bids received for Grading and Street Surfacing Improvement No's 1963 -17, 18, 19, 20, and 21 and that said bids were as follows: C. S. McCrossan, Inc. $ 44, 441.38 Donovan Contracting, Inc. 45, 529.23 Alexander Construction Co. Inc. 49, 436.20 Barton Contracting Co. 71, 827.95 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the bid of C. S. McCrossan, Inc. in the amount of $ 37, 929.70 as to furnishing of all work, labor and material in connection with Grading and Street Surfacing Improvement No's 1963 -18, 19, 20, and 21 according to the plans and specifications therefor now on file in the office of the Village Clerk is deemed to be the lowest and best bid submitted for said work by a responsible bidder, and said bid is hereby accepted, and BE IT FURTHER RESOLVED, to table action concerning the contract award for Street Improvement Project 1963 -17 until August 26, 1963. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by John Leary and seconded by Howard Heck to approve the follow- ing licenses: House Moving Licenses Francis Carey 3306 Edgewood Ave. North Motion carried. Motion by John Leary and seconded by Phil Cohen to authorize the Administrator to take bids for the furnishing of Salt for ice control for the coming winter season. Bids to be opened at 10 :00 A. M. on September 3 , 1963. Motion carried. Motion by Howard Heck and seconded by Phil Cohen to adjourn. The Village Council adjourned at 11:45 P.M.
