The Village Council met in Special Session and was called to order
by Mayor Gordon Erickson at 7 :30 P. M.
Roll Call: ,Mayor Gordon Erickson, Phil Cohen, Howard Heck, Henry
Dorff and john Leary were present.

Motion by Howard Heck and seconded by Henry Dorff to approve the
minutes of August 26, 1963 as recorded. Motion carried.
Member john Leary introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING BID AND INSTRUCTING ATTORNEY
O EMPARZ CONTRACT FORM
WHEREAS, the Village Administrator and the Village Engineer have
reported that on September 3, 1963 at 10 :00 a.m. , they opened and tabulated
bids received for the furnishing of Rock Salt, and that said bids were as
follows:
Hardy Salt Company $15.20 per ton
Cutler Magner Company $11.50 per ton
Cargill Incorporated $13.50 per ton
International Salt Company $11.50 per ton
NOW, THEREFORE, BE IT RESOLVED by the Village Cowwfl of the
Village of Brooklyn Center that the bid of Interuationa l Salt Company for
the furnishing of Rock Salt at a price of $11.50 per ton is deemed to be
the best hid for the furnishing of Rock Salt and said bid is hereby accepted
and that the Village Attorney shall prepare a contract that provides that the
bid price shall be the maximum unit ponce for the furnishing of Rock Salt
and that salt shall be delivered to the Village of Brooklyn Center
at the prevailing price if the prevailing price at the time of ordering salt is
lower than the bid price.
The motion for the adoption of the foregoing resolution was duly seconded
by member Howard Heck and upon vote being taken thereon, the following
voted in favor thereof: Gordon Erickson, Howard Heck, john Leary, Phil
Cohen and Henry Dorff and the following voted against the same: None;
whereupon, said resolution was declared duly passed and adopted.
The Village Council discussed the matter of granting a building permit
for an 8, 000 square foot warehouse addition to Howe Inc. A number of
residents in the residential area abutting Howe Inc. objected to the expansion
of the warehouse buildings. After a lengthy discussion of the matter, member
John Leary offered the following motion.
Motion to approve a building permit for an 8, 000 square foot warehouse
addition to the plant of Howe Inc. to be used for warehouse purposes only.
The motion died for the lack of a second.
The above matter is to be placed on a future agenda of the Village
Council when the Council has received a report from consulting engineers of
Howe Inc. concerning proposed improvements to the processing equipment of
Howe Inca to reduce the air pollution from the fertilizer plant.
The Mayor announced that the meeting was open for the consideration
of proposed Street Surfacing Improvement No. 1963 -24.

The Clerk produced an affidavit of publication of Mice of hearing
on the proposed improvement showing two weeks' publication thereof in
the official newspaper, the last publication being on August 29, 1963,
which affidavit was examined and found satisfactory and ordered placed on
file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement.. After hearing
and considering all objections, and the property owners appearing in favor
of said improvement, member John Leary introduced the following resolution
and moved its adoption;
RESOLUTION ORDERING CONSTRUCTION OF STREET
SURFACING IMPROVEMENT NO. 1963 -24 AND
ORDERING PREPARATION OF PLANS AND SPEGICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows.

Interests of the Village and the owners of property specially benefited
thereby, that the following improvement shall be constructed:
STREET SURFACING IMPROVE&Z14T NO. 1963 -24
2. The plans and specifications for said improvement shall be

3. Said improvement shall be constructed by the Village Street
Department on a force account psis.
The motion for the adoption of the foregoing resolution was duly seconded
by member Phil Cohen, and upon vote being taken thereon, the following
voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Phi 1
Cohen and Howard Heck and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
The Village Council considered a resolution from the Planning Commission
relative to the Village Planners area studies and to the establishing of a
moratorium on special use permits.
Motion by Phil Cohen and seconded by Howard Heck to defer action
on the Planning Commissions request relative to moratorium on special use
Permits and form a committee consisting of the Village Attorney, Village
Administrator, one member from the Planning Commission,, and one member
from the Council and further to direct the committee to delermine a method
for the establishment of moritorium in the Village regarding the issuance
of special use permits for multiple dwellings. The report of the committee
to be submitted to the Council for consideration on September 23, 1963.
Voting for the motion members Phil Cohen, Gordon Erickson, Howard Heck and
Henry Dorff and voting against the motion member John Leary.
Motion by Henry Dorff and seconded by John Leary to direct the
Village Planner, Hodne and Associates, to cease work on special area
studies in favor of proceeding with work on the overall comprehensive
study. Motion carried.
Motion by John Leary and seconded by Howard Heck to authorize the
Administrator and Engineer to proceed with negotiations for the acquiring of
right -of -way for street improvements on the west side of Noble Avenue, as it
exists south of 63rd Avenue, and on the East side of Perry Avenue, as it exists
south of 63rd Avenue.. Motion carried.
Motion by Phil Cohen and seconded by Dorff to adjourn. Motion
carried. The Village Council adjourned at 12; A
