Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
September 23, 1963
The Village Council met in Regular Session and was called to order
by Mayor Gordon Erickson at 7 :30 P. M.
Roll Call: Mayor Gordon Erickson, Phil Cohen, Howard Heck,
Henry Dorff and john Leary were present.
Rev. Paul Vlestberg of the Brookdale Covanent Church gave the
Invocation.
Motion by john Leary and seconded by Henry Dorff to approve the
minutes of the Village Council meeting of September 16, 1963 as recorded.
Motion carried.
Motion by Phil Cohen and seconded by john Leary to authorize reduction
of the subdivision bond for Wangstad's 4th addition from $12,300.00 to
$950.00 . Motion carried.
Member Howard Heck introduced the following resolution and
moved its adoption:
RESOLUTION CANCELLING SPECIAL ASSESSMENTS ON PARK
PROPERTY DESCRIBED AS COMMENCING AT THE NE COR OF
BLK 3 BALFANY'S NORTHPORT 2ND ADDITION THENCE E
ALONG N LINE OF RLS #409 A DISTANCE OF 235 FEET THENCE
S 111.98 FEET THENCE AT AN ANGLE TO THE LEFT OF 26
DEG 23 MIN TO THE MOST NLY CORNER OF SAILOR LA NE
AS PLATTED IN BALFANY' S NORTHPORT 2nd ADDN THENCE
WLY ALONG NLY LINE OF BLOCK 1 SAID ADDN TO NW
CORNER OF SAID BLOCK 1 THENCE N TO SW CORNER OF
BLOCK 3 SAID ADDN THENCE NELY TO SE CORNER OF

TRACT B. R L. S. #409, PARCEL 6015
WHEREAS, the Village Council of the Village of Brooklyn Center
'has established the policy of accounting for payment of special assess -
ments on Park property through the Village Finance office; and
WHEREAS, said property acquired for Park purposes in 1956
and
WHEREAS, the Council action of 11/14/60 cancelling the special
assessments on said property did not include the installments from Ix56
to 1958, and
WHEREAS, the Village is obligated for the special assessments from
the initial: date of acquisition
NOW, THEREFORE, BE IT RESOLVED, by the Village Council of
the Village of Brooklyn Center to cancel from the Hennepin County tax
rolls the special assessments for Sewer Interceptor 55 -1, Area Interceptor
56 -A and Storm Sewer 58 -A improvements, together with all interest and
penalties on the afore mentioned properly, and
BE IT FURTHER RESOLVED, that the County Auditor is authorized
and directed to cancel the amounts of the special assessments including

penalties on parcel 6015, R, L. S. #409, as follows:

The motion for the adoption of the foregoing resolution was duly
seconded by member Phil Cohen, and upon vote being taken thereon the
following voted in favor thereof: Gordon Erickson, Phil Cohen , Howard
Heck, Henry Dorff and John Leary and the following voted against the same:
None; whereupon said resolution was declared duly passed and adopted.
Member Henry Dorff introduced the following resolution and moved
its adoption:
RESOLUTION ENDORSING ACTION OF MINNESOTA
WATER POLLMON CONTROL COMMISSION
WHEREAS, at the request of the Village of Brooklyn Park, the
Village of Brooklyn Center did on October 16, 1961, enter into an agreement
with the Village of Brooklyn Park to provide a limited sanitary sewer outlet,
and
WHEREAS, the agreement stipulates the amounts of sewage capacity
available to Brooklyn Park in Brooklyn Center's sewer system, and
WHEREAS,, calculations performed by the Minnesota Water Pollution
Control Commission and the Brooklyn Center Engineering Department indicate
that the potential Brooklyn Park sewage flow has reached the stipulated
limits of Brooklyn Center "excess" sewer capacity, and
WHEREAS, the Minnesota Water Pollution Control Commission has
notified the Village of Brooklyn Park that "Before this Department can
recommend approval of further extensions to the sanitary sewers in the
village, it will be necessary that information be submitted on precisely what
plans are being made or will be made for future increases in sewage flows
which are expected to exceed the amount permitted by present contract
provisions.'
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center to endorse that action of the Minnesota Water
Pollution Control Commission referring to Brooklyn Center's "excess" sewer
capacity,
AND BE IT FURTHER RESOLVED to convey to Brooklyn Park that in
view of existing information, Brooklyn Center is not prepared to approve
sewer plans which are potentially in conflict with the provisions of the
October 16, 1961 agreement.
The motion for the adoption of the foregoing resolution was duly
seconded by member John Leary, and upon vote being taken thereon the
following voted in favor thereof: Gordon Erickson, John Leary, Howard Heck,
Phil Cohen and Henry Dorff and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Motion by John Leary and seconded by Howard Heck to correct the
resolution "Accepting Bid and Approving Contract Form" concerning Sweet
Improvement Project #1963 -17 , in the minutes of August 26, 1963 , by
striking the figure $7,,748.90 and inserting the figure $6..511.68, which
Is the correct amount of the contract award. Motion carried,

Motion by Phil Cohen and seconded by Henry Dorff to approve the
following licenses:

Belden Portor Co. 315 Royalston Ave.
Motion carried.
Motion by John Leary and seconded by Howard Heck to authorize
the Village Engineer to proceed with negotiations with the Minnesota
Highway Department for an agreement for participation, in the cost of the
construction of Storm Sewer drainage from W illow Lane at Highway #100.
Motion carried.
Motion by Howard Heck and seconded by John Leary to authorize the
taking of bids for four (4) squad cars on October 14th 1963 at 2 :00 P. M.
Four cars are to be traded in for new cars. Motion carried.
The bills having been audited, motion was made by Henry Dorff and
seconded by Howard Heck to order paid the bills set forth in the schedule

Recreation Commission and the Park Board.
