Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
In the County of Hennepin and State of
Minnesota
September 30, 1963
The Village Council met in Special Session and was called to order by
Mayor Gordon Erickson at 7 :30 P. M.
Roll Call: Mayor Gordon Erickson, Phil Cohen, Howard Heck, Henry
Dorff and john Leary were present.
The Rev. Hunter of the Brooklyn Center Methodist Church gave the
Invocation.
Motion by Phil Cohen and seconded by John Leary to approve the minutes
of the Council meeting of September 23, 1963 as recorded. Motion carried.
Motion by ,John Leary and seconded by Howard Heck to appoint as
special police officersAllanC. Burke, 7600 Pleasant Avenue South, Minneapolis
and Walter H. Elkins, 4708 Virginia Lane, Minneapolis, under the conditions
stated in the letter from the Dayton Development Company dated September 5,
1963. Motion carried.
Motion by Howard Heck and seconded by Henry Dorff to approve the
Investment of $15, 000 by the Fire Department Relief Association in Brooklyn
Center State Bank Certificates of Deposit. Motion carried.
Member Henry Dorff introduced the following resolution and moved its
adoption:
RESOLUTION REVOKING MUNICIPAL STATE AID STREETS
WHEREAS, it appears to the Village Council of the Village of Brooklyn
Center that the streets hereinafter described should be revoked as Municipal
State Aid Streets under the provisions of Minnesota Laws:
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that the streets described as follows, to wit:
Control Section 109 Segment 010 - Shingle Creek Parkway
from junction of Trunk Highway No. 152 and Xerxes Avenue
North to County Road No. 10, and
Control Section 110 Segment 010 - Xerxes Avenue North from
Junction of Trunk Highway No. 152 and Xerxes Avenue North
to a point 180 feet south of 59th Avenue North
be, and hereby are, revoked as Municipal State Aid Streets of said Village
subject to the approval of the Commissioner of Highways of the State of
Minnesota.
BE IT FURTHER RESOLVED, that the Village Clerk is hereby authorized
to forward two certified copies of this resolution to the Commissioner of
Highways.
The motion for the adoption of the foregoing resolution was duly seconded by
member John Leary, and upon vote being taken thereon the following voted in
favor thereof: Gordon Erickson, John Leary, Phil Cohen, Howard Heck and
Henry Dorff and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.

Member john Leary introduced the following resolution and moved
its adoption:
RESOLUTION ESTABLISHING MUNICIPAL STATE AID STREETS
WHEREAS, it appears to the Village Council of the Village of Brooklyn
Center that the streets hereinafter described should be designated as
Municipal State Aid Streets and the provisions of Minnesota Laws of 1959
Chapter 500;
NOW, THEREFORE BE IT RESOLVED, by the Village Council of the
Village of Brooklyn Center that the streets described as follows, to wit:

Parkway from Xerxes Avenue North to County Road
No. 10, and
Control Section 110 Segment 010 Xerxes Avenue
North from Trunk Highway No. 100 to a point 180
feet south of 59th Avenue North
be, and hereby are, established, located, and designated as Municipal
State Aid Streets of said Village, subject to the approval of the Commissioner
of Highways of the State of Minnesota.
BE IT FURTHER RESOLVED, that the Village Clerk is hereby authorized
and directed to forward two certified copies of this resolution to the Com -
missioner of Highways for his consideration, and that upon his approval of
the designation of said street, that same be constructed, improved, and
maintained as Municipal State Aid Streets of the Village of Brooklyn Center to
be numbered and known as described above.
The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck, and upon vote being taken thereon the following voted
In favor thereof: Gordon Erickson, Howard Heck, Henry Dorff, john Leary
and Phil Cohen and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
The Mayor announced that the meeting was open for consideration
of objections to any assessments for the following improvements:
Sanitary Sewer Project 1962 -8.
Water Improvement Projects 1963 -6, 1963 -7 1963 -9,
1963 -10, 1962 -25, 1962 -34.
Storm Sewer Projects 1962 -20, 1962 -24, 1962 -28.
Street Surfacing Projects 1962 -31, 1962 -35, 1963 -14,
1963 -15.
Street Improvement Project 1962 -36
Water Hookups
The Clerk produced an Affidavit of Publication of Notice of Hearing
on the Assessments showing one weeks' publication thereof in the official
newspaper, and the publication being on September 12, 1963 which
affidavit was examined and found satisfactory and ordered placed on file.
The Clerk produced an Affidavit of mailing notices for special :.
assessment hearing to benefited property owners which affidavit was examined
and found satisfactory and ordered placed on file.
The Mayor then called upon all owners present to present their
objections to the above assessments. After all persons desiring to speak
thereon had been heard it was determined to act on the hearing on certain
assessments as indicated in the following motions:

Motion by Phil Cohen and seconded by Henry Dorff to declare the
public hearing on special assessment rolls for Sanitary Sewer Lateral Project
#1962 -8 favorable. Motion carried.
Motion by Howard Heck and seconded by John Leary to declare the
public hearing on special assessment rolls for Water Improvement Project
#1963 -6 favorable. Motion carried.
Motion by Henry Dorff and seconded by Phil Cohen to declare the public
hearing on special assessment rolls for Water Improvement Project #1963 -7
favorable. Motion carried..
Motion by John Leary and seconded by Howard Heck to declare the
public hearing on special assessment rolls for Water Improvement Project
#1963- 9 favor. Motion carried.
Motion by Phil Cohen and seconded by john Leary to,.declare• the
public hearing on special assessment rolls for 'N%ater Improvement Project
#1963 -10 favorable. Motion carried.
Motion by Howard Heck and seconded by Henry Dorff to declare the
public hearing on special assessment rolls for Storm Sewer Project #1962 -20
favorable. Motion carried.
Motion by John Leary and seconded by Phil Cohen to declare the public
hearing on special assessment rolls for Storm Sewer Project #1960 -24
favorable. Motion carried.
Motion by Henry Dorff and seconded by Phil Cohen to declare the
public hearing on special assessment rolls for Storm Sewer Improvement #1962 -2.
favorable. Motion carried.
Motion by Howard Heck and seconded by Henry Dorff to declare the
Public Hearing on special assessment rolls for Street Surfacing Project #1962 -31
favorable. Motion carried.
Motion by John Leary and seconded by Phil Cohen to declare the public
hearing on special assessment rolls for Street. Surfacing Project 4 -35
favorable. Motion carried.
Motion by Phil Cohen and seconded by Howard Heck to declare the
public hearing on special assessment rolls for Street improvement Project
#1962-36 favorable. Motion carried.
Motion by Henry Dorff and seconded by Howard Heck to declare the
public hearing on special assessment rolls for Street Surfacing Project
#1963 -14 favorable. Motion carried.
Motion by John Leary and seconded by Howard Heck to declare the
public hearing on special assessment rolls for Street Surfacing project
#1963 -15 favorable. Motion carried.
Motion by Phil Cohen and seconded by Henry Dorff to declare the
public hearing on special assessment rolls for Water Improvement Project
#1962 -25 favorable. Motion carried.
Motion by Henry Dorff and seconded by John Leary to declare the
public hearing on special assessment rolls for Water Improvement Project
#1962 -34 favorable. Motion carried.
Motion by Howard Heck and seconded by John Leary to declare the
public hearing on special assessment rolls for Water Connection hook -ups
favorable. Motion carried.
Mr. Sheridian, an Attorney at Law, arrived at the meeting at this time
represent the DuShane property involved in special assessments for Water
Improvement Project #1963 -10. Mr. Sheridian presented his objections to
the assessments.

The Village Council considered 1964 budget items.
Motion by Henry Dorff and seconded by John Leary to adjourn. The
Village Council adjourned at 11:30 P.M. Motion carried:.
