HomeMy WebLinkAbout1963 10-07 CCM Special Session nn r 9/ 5 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center In the County of Hennepin and State of Minnesota October 7, 1963 The Village Council met in Special Session and was called to order by Mayor Gordon Erickson at 7:30 P. M. Roll Call: Mayor Gordon Erickson, Phil Cohen, Howard Heck, Remy Dorff and John Leary were present. The Rev. Clemmet Peterson of Harron Methodist Church gave the Invocation. Motion by Phil Cohen and seconded by John Leary to approve the minutes of e Council on carried. th C unc 1 meeting of September 30, 1963 as recorded. Mori Motion by John Leary and seconded by Howard Heck to uphold the action of the Planning Commission and approve application #63067 and #63068 submitted by the Berean Free Church and grant permission to erect and maintain directional signs at 69th and Humboldt Avenue and at Hwy #100 and Humboldt Avenue, until six months after the adoption of the proposed sign ordinance, after which time the size and location of the sign shall be made to conform to the sign regulations. Motion carried. Motion by Henry Dorff and seconded by Phil Cohen to table action on applications #63070 and #63071 submitted by Paul J. Schwartz for one week so that the Village Engineer can determine whether or not a 4' x 24' sign is required for visibility from Osseo Road. Motion carried. i Motion by Henry Dorff to deny application #63047 submitted by American Legion Post #630 for rezoning that part of Lot 10 Auditor Subdivision #57 Lying West of a line parallel to and 183' West of the center line of the Osseo Road to R - B from R - 1. The motion died for a lack of a second. Lotion by Phil Cohen and seconded by John Leary to reconsider application #63047 on November 4, 1963 and to instruct the administrator to gather infor- mation pertinent to the location of Clubs and Lodges in a residential district. Voting for the motion, Phil Cohen, John Leary, Gordon Erickson, Howard Heck and voting against the motion; Henry Dorff. Motion carried. Motion by Phil Cohen and seconded by Howard Heck to uphold the action of the Planning Commission and deny application #63032 submitted by Hipp Construction Company for the rezoning, from R - 1 to B - 1, the East 1/4 of the southeast 1/4 of the southeast 1/4 of Section 26, Twp 119; because all the information presently available indicates that the proposed rezoning and development is not compatible with the guide plans of this area and would not be in the best interest of the Village. Motion carried:. Motion by John Leary and seconded by Howard Heck to uphold the action of the Planning Commission and deny application #63003 submitted by Village Builders for a special use permit to construct 7 - 4 unit apartment buildings on the 'Vest 1/4 of Lot 6 Mendenhalr s Outlots; because the requested change of land use would interfer with uses that are now permitted in this surrounding area. Motion carried. Motion by Howard Heck and seconded by John Leary to uphold the action of the Planning Commission and approve application #63069 submitted by Rudolph Peterson for renewal of the Special Use permit granted July 9, 1962 to construct and operate a Par 3 Golf Course, and further to approve the use of an additional 20 Meares of land for this purpose. Motion carried. a1w r 171 Motion by Henry Dorff and seconded by Phil Cohen to uphold the recommendation of the Planning Commission and approve application #63051 submitted by the Futterman Corp. and approve the parking layout for the Northbrook Shopping Center. Motion carried. The Mayor announced that the meeting was open for consideration of objections to any of the assessments for the following improvements: Sanitary Sewer Projects 1963 -5, 1963 -8 Street Surfacing Project 1963 -24 Sanitary Sewer Connections to Interceptors. The Clerk produced an Affidavit of Publication of notice of hearing on the assessments showing one weeks' publication thereof in the official newspaper, and the publication being on September 12, 1963 which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all owners present to present their objections to the above assessments. After all persons desiring to speak thereon had been heard it was determined to act on the hearing on certain assessments as indicated in the following motions: Motion by Howard Heck and seconded by john Leary to declare the Public hearing on special assessment rolls for Sanitary Sewer Lateral Improvement #1963 -5 favorable. Motion carried. Motion by Phil Cohen and seconded by Henry Dorff to declare the public hearing on special assessment rolls for Sanitary Sewer Lateral Project #1963 -8 favorable. Motion carried. Motion by john Leary and seconded by Howard Heck to declare the public hearing on special assessment rolls for Street Surfacing Improvement #1963 -24 favorable. Motion carried. Motion by Henry Dorff and seconded by Phil Cohen to declare the public hearings on special assessment rolls for Sanitary Sewer Connections to the Sanitary Sewer Interceptor favorable. Motion carried. Member fohn`ieary introduced the following resolution and moved its adoption: RESOLUTION CONFIRMING ASSESSMENTS FOR SANITARY SEWER LATERAL NO'S. 1962 -8, 1963 -5, AND 1963 -8, AND WATER IMPROVEMENT NO'S. 1963 -6, 1963 -7, 1963 -9, AND 1963 -10, AND STORM SEWER NO'S. 1962- 20, 1962 -24 AND 1962 -28, A14D STREET IMPROVEMENT NO'S. 1962 -31 AND 1962 -36, AND STREET SURFACING NO'S 1962 -35, 1963 -14, 1963 -15, AND 1963 -24, AND PUBLIC UTILITIES WATER NO'S 1962 -25, AND 1962 -34 AND WA R HOOKUM AND SEMXR CONNECTIONS, BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The Village Clerk has, with the assistance of the Engineer hereW fore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the improvements known as the improvements listed above of said Village against every assessable lot, piece or parcel of land in accordance with the provisions of law, and has prepared and filed with the Village Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same: r 173 2.. Notice has been duly published as required by law that Council would meet in regular session on Monday, September 30, 1963 and Monday, October 7, 1963, to pass on the proposed assessments. 3. Said proposed assessments have at all times been open to inspection and copying by all persons interested, and opportunity has been given to all Interested persons to present their objections, if any, to such proposed assessments, or to any item thereof. 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessments was and is specially benefitted by said improvements in the amount of said proposed assessment set opposite the description of each such lot, piece or parcel of land, and that amount so set out is hereby levied against each of the respective lots, Pieces or parcels of land therein described. S. Such proposed assessments are adopted and confirmed, and the sums fixed and named in said proposed assessments are affirmed, adopted and confirmed as the proper special assessments for each of said lots, pieces or parcels of land respectively. 6. Said assessments as adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereon be and constitute the special assessments for the payment of the above listed improvements, 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of 6 per cent per annum. 8. Such assessments shall be payable in equal installments beginning In the year 1964, payable on the 1st day of January in each year and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor. s A. Sanitary Sewer Laterals No's. 1962 -8, 1963 -5, and 1963 -8 in twenty equal annual installments. B. Water Improvement No's. 1963 -6, 1963 -7 1963 -9 and 1963 -10, In twenty equal annual installments except parcels 5194 and 5200, Auditors Subdivision #309, project 1963 -10 shall be in 3 equal annual installments. C. Storm Sewer No's 1962 -20, 1962 -24, and 1962.28, in twenty i equal annual installments. D. Street Improvement No. 1962 -31 in seven equal annual installments, E. Street Improvement No's 1962 -36 in five equal annual installments. F. Street Surfacing No's. 1962 -35, 1963 -14, 1963 -15, and 1963 -24 In three equal annual installments. G. Public Utilities Water No's 1962 -25 and 1962 -34, in twenty equal annual installments. H. Water Hookups and Sewer Connections in twenty equal annual Installments. 9. The Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of the amount which will be due thereon the 1st day of January in each year. The motion for the adoption of the foregoing resolution was duly seconded by member Phil Cohen and upon vote being taken thereon, the following voted in favor thereof; Gordon Erickson, Phil Cohen, Henry Dorff, John Leary and Howard Heck and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. -3- 47 Member Phil Cohen introduced the following resolution and moved Its adoption: RESOLUTION CERTIFYING DELINQUENT SEWER SERVICE ACCOUNTS FOR 1962 TO HENNEPIN WHEREAS, the records of the Public Utilities Billing Department list certain accounts as delinquent for the year 1962, and WHEREAS, the consumers have been notified of the delinquency according to legal requirements, and WHEREAS, State Statute 443.16 authorizes certification of the delinquent accounts to the County tax rolls for collection, THEREFORE , BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center to order the County Auditor of Hennepin County to place the following delinquent accounts on the 1963 payable in 1964 tax rolls: LEGAL DESCRIPTION AMOUNT Section 1, Plat 89001, Parcel 900 6.50 Section 1, Plat 89001, Parcel 1410 5.50 Section 1, Plat 89001, 10 0 Parcel 2720 0 Section !,, Plat 89e6i,, Pareal 2767 7. Member Howard Heck introduced the following resolution and moved its adoption; RESOLUTION CERTIFYING COST OF CERTAIN SEWER INSTALLATIONS TO THE HENNEPIN COUNTY TAX ROLLS WHEREAS, certain sewer facilities on certain properties constituted a health hazard and the hardship applications for installation of certain sewer connections have been approved, and WHEREAS, Village Ordinance 7 -309, and State Statute 412.221, Section 31, authorize the certification of the cost of said sewer installations to the County Tax Rolls for collection as a special assessment, and WHEREAS, the Village Council has established the policy that the special assessment for sewer installation shall be spread over a period of five years, at 6 per cent interest, with the first year bearing 1S months' Interest. THEREFORE, BE IT RESOLVED by the Council of the Village of Brooklyn Center as follows: _S_ 251 1. The Village Clerk, with the assistance of the Village Administrator, selected by the Council for such purpose, has determined the proper amounts to to be specially assessed and has prepared and filed with the Village Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same as follows: Legal Description Amount Lot 2, Block 2, Camden Acres $359.00 2. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessments was and is specially benefitted by said improvements in the amount of said proposed assessment set opposite the description of each such lot, piece, or parcel of land, and that amount so set out is hereby levied against each of the respective lots, pieces or parcels of land therein described, 3. Such proposed assessments are adopted and confirmed and the sums fixed and named in said proposed assessments are adopted and confirmed as the proper special assessments for each of said lots, pieces or parcels of land respectively. 4. Said assessments as adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereon be and- -- -constitute the Special assessments for the payment of the above listed improvements. S. The amounts assessed against each lot, piece or parcel "�of - land shall bear interest from the date hereof until the same have been paid- at:the rate of 6 per cent per annum. 6. Such assessments shall be payable in five equal installments beginning in the year 1963, payable on the 1st day of January in each year and continuing until all of said installments shall have been paid, each installment to be collected with taxes callectihie during said year by the County Auditor. 7. The Village Clerk is hereby directed to make up and file in the 'Office of the County Auditor of Hennepin County, a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon the 1 st day of January in eagh year. The motion for the adoption of the foregoiW resoludm was duly seconded by member John Leary, and upon vote beig taken thereon, the following voted in favor thereof: Gordon Erickson., Henry Dorff, John Leary Howard Heck and Phil Cohen and the following voted against the same; None; whereupon said resolution was deatared duly passed and wed. Ordinance No. 63 -1 titled "AN ORDINANCE AMENDING SECTION 19-401 OF THE VILLAGE ORDINANCES" was given a first reading. Motion by John Leary and seconded by Howard Heck to place-Ordinance No. 63 -1 titled "AN ORDINANCE AMENDING SECTION 19 -401" on the- agenda Of the Council meeting for October 21, 1963 for a second reading.- Motion carried. Ordinance No. 63 -2 titled "AN ORDINANCE RELATING TO A MORATORIUM ON ISSUANCE OF SPECIAL USE PERMITS FOR DUPLEX AND MULTIPLE DWELLING USES IN RESIDENTIAL R -1 DISTRICT" was given a first reading. Motion by Phil Cohen and seconded by.. Hemy Dorff that Ordinance No. 63 -2 titled "AN ORDINANCE RELATING TO A MORATORIUM UPON THE ISSUANCE OF SPECIAL USE PERMITS FOR DUPLEX AND MULTIPLE DWELLING USES IN RESIDENTIAL. R -1 DISTRICTS" be placed on the Agenda of the Council meeting of October 21 for a second reading.
