Minutes of the Proceeding& of the Village
Council of the Villag a of Brooklyn Center
in the County of Hennepin and State of
Minnesota
October 14, 1963
The Village Council met in Regular Session and was called to
order by Mayor Gordon Erickson at 7 :35 P. M.
Roll Call: Mayor Gordon Erickson, Phil Cohen, Howard Heck, Henry
Dorff and john Leary were present.
The invocation was given by Rev. Bubna of the Brookdale Alliance
Church.
Motion by Henry Dorff and seconded by john Leary to approve the
minutes of the meeting of October 7, 1963 as recorded. Motion carried.
Motion by Howard Heck and seconded by john Leary to grant a
variance to Paul J. Schwartz to errect a sign 4' x 18' long on tract C
of R. L. S. 838 provided that the south end of the sign is located at the
North line of the building and also to grant a variance to erect a sign
4' x 10' on tract B of R. L. S. 838. These signs are to be permitted for
period of one year. Motion carried.
Member Phil Cohen introduced the following resolution and moved

RESOLUT ON ACggPTING BIDS AND PURCHASING PO CARS
WHEREAS, the Village Administrator and Assistant Administrator
have reported that on October 14, 1963 at 2 :00 P. M. they opened and
tabulated bids received for the furnishing of four (4) police cars and
presented the following tabulation of bids:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that the bid of Osseo Motors in the amount of
$7438.72 for the furnishing of four (4) new police cars with bucket seats
and allowing a deduction of $100 for the elimination of dual exhaust system
and trading in the three (3) Chevrolet police cars is deemed to be the best
bid for the furnishing of police cars according to specifications therefore
now on file in the office of the Village Clerk and said bid is hereby accepted.
BE IT FURTHER RESOLVBO, that $1,438.72 be appropriated from the
contingency fund towards the purchase of three police cars.
The motion for the adoption of the foregoing resolution was duly seconded
by member Henry Dorff and upon vote being taken thereon the following voted
in favor thereof; Gordon Erickson, Henry Dorff, Howard Heck, john Leary
and Phil Cohen and the following voted against the same; None; whereupon
said resolution was duly passed and adopted.
Member john Leary introduced the following resolution and move'•
Its adoption:
RESOLUTION REAPPORTIONING ASSESSMENTS FROM PARCEL
4530, SECTION 33, TO PARCELS 4540 AND 4550, SECTION 33
WHEREAS, prior to August 24, 1963, certain special assessments
had been levied and certain special assessments had been pending against
Parcel 45309 Section 33,, Township 119, Range 21 owned by Martin and
Helen Panayotoff, and
WHEREAS, subsequent to August 24, 1963, Parcel 4530 was subdivided
Into Parcel 4550 which was purchased by Independent School District No. 279,
and Parcel 4540 which was retained by Martin and Helen Panayotoff, and
WHEREAS, the Village Council determines it necessary to equitably
reapportion those special assessments, levied and pending, against Parcel
4530 to Parcel 4550 and Parcel 4540,
NOw, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center to reapportion the special assessments, levied
and pending, from Parcel 4530 to Parcels 4550 and 4540 as follows:

ORDINANCE N®. 63 -3
ORDINANCE A O 19 -205 OFT S
The Village Council of the Village of Brooklyn Center do ordain as
follows:
Section 1: Section 19 -205 is hereby amended to read as follows:
Section IL-20S THEFT. "Every person who commits a theft as
defined in Section 609.52 of the Minnesota Criminal Code (West 1963),
Laws of 1963, Chapter 753 which is not punishable as a felony under state
law upon conviction therefore shall be liable to the same fine or imprisonment
provided for in Section 19 -201 of the Village of Brooklyn Center Ordinances ".
Section 2. This ordinance shall be effective from and after its
publication.

AN ORDINANCE AMENDING SECTIONS 19 -402, 19 -403, AND
19 -404 AND REffALINQ SECTIO TS 19 -405 19 -406 AND 19 -407.
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN
AS FOLLOWS:
Section 1: Section 19 -402 is hereby amended to read as follows:

Section 19 -402 DANGEROUS WEAPONS. Section 609.66 of the
Minnesota Criminal Code (West 1963) Laws of 1963, Chapter 753 is hereby
adopted by reference and shall have the same farce and effect as though set
out at length herein.
Section 2: Section 19 -403 is hereby amended to read as follows:
Section 19- 40,3, SALE OF FIREWORKS PROHIBITED. Section 616.43
of the Minnesota Criminal Code (West, 196 3) Laws of 1963 Chapter 753 is
hereby adopted by reference and shall have the same force and effect as
though fully set forth herein. "
Section 3: Section 19 -404 is hereby amended to read as follows:
Section - 04 Any person convicted of violating any of the sections
19 -401 through 19 -403 may be punished by not more than 90 days imprison-
ment or a fine of not more than $100.00.
Section 4: Sections 19 -405, 19 -406 and 19 -407 are hereby repealed.
Section 5: This ordinance shall be effective from and after its
publication.

ORDINANCE NO, 63 -5
AN ORDNANCE AMENDING SECTIOiV 19 -601 OF THE VILLAGE
ORDINANCES AND REPEALING SECTION 19 -602 OF THE VILLAGE
O RDINANCES
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAM
AS FOLLOWS:
Section 1, Section 19 -601 of the Village Ordinances is hereby amended
to read as follows:
Section 19 -601, ISSUANCE OF WORTHLESS CHECK.
1. Definition . " Credit" means an arrangement or understanding
with the drawee for payment of the check or other order for the
Payment of money to which this section applies.
2. Acts Constituting Whoever issues any check or other order for
the payment of money which, at the time of issuance, he intends
shall not be paid may be sentenced to imprisonment for not more
than 90 days or to payment of a fine of not more than $100,00,
3. Proof of Intent Any of the following is evidence sufficient to
sustain a finding that the person at the time he issued the check
or other order for the payment of money, intended it should not be
paid.
(a) Proof that, at the time of issuance, he did not have an account
with the drawee; or
(b) Proof that, at the time of issuance, he did not have sufficient
funds or credit with the drawee and that he failed within five
days after receiving notice of nonpayment or dishonor to pay
the check or other order: or
(c) Proof that, when presentment was made within a reasonable time,
the issuer did not have sufficient funds or credit with the drawee
and that he failed within five days after receiving notice of
nonpayment or dishonor to pay the check or other order.
4. Proof of lack of funds or credit. If the check or other order for
the payment of money has been protested, the notice of protest
thereof is admissible or proof of presentation, nonpayment and
Protest* and d Is evidence sufficient to sustain a finding that there
was
a lack of funds Or
credit with the drawee,
5. Exceptions. This section does not apply to a postdated check or
to a check given for a post consideration except a payroll check.
Section 2 Section 19 -602 of the Ordinances of the Village is hereby
repealed.
Section 3. This
ordinance shall be effective from and after its
publication..

AN ORDINANCE AMENDING SECTION 27 -101 OF TIC VILLAGE
ORDINANCES
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN
AS FOLLOWS:
Section 1: Section 27 -101 of the Village Ordinances is hereby
amended as follows
29-101 HIGHWAY CODE ADOPTED. The regulatory provisions
Chapter 169 Minnesota Statutes 1961, as amended by the laws of 1963,
are hereby adopted as a traffic ordinance regulating the use of highways,
streets and alleys within the Village of Brooklyn Center, and are hereby
incorporated in and made a part of this Ordinance as though fully set forth,
Section 2: This ordinance shall be effective from and after -its
Publication.
The motion for the adoption of the foregoing ordinance was duly seconded by
member John Leary, and upon vote being taken thereon the following voted
in favor thereof: Gordon Erickson, Henry Dorff, john Leary, Howard Heck
and Phil Cohen and the following voted against the same: None; whereupon

AN ORDINANCE AMENDING SECTION 27 -103 OF THE
RD
THE VILLAGE COUNCIL OF THE VUJAGE OF BROOKLYN CENTER DO ORDAIN AS
FOLLOWS:
` Section 1: Section 27 -103 subsection (2) (3) (4) of the Village Ordinances
Is hereby amended to read as follows:
(2) Section 171.08 of the Minnesota Statutes as amended by Laws of
1963, Chapter 206 (requiring possession of license while driving)
Is hereby adopted by reference and shall have the same force and
effect as though fully set out herein.
(3) Section 171.22 of the Minnesota Statutes (fictitious or altered
drivers licenses prohibited) is hereby adopted by reference and
shall have the same force and effect as though fully set out herein.
(4) Section 171.24 of the Minnesota Statutes (driving after suspension
or revocation) is hereby adopted by reference and shall have the
same force and effect as though fully set out herein.
Section 2: This Ordinance shall be effective from and after its publication.

AN ORDINANCE AMENDING SECTIONS 27 -401 OF THE

THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN
AS FOLLOWS:
Section 1. Section 27 -401 of Village Ordinances is hereby amended to
read as follows:
Section 27 -401, OBSTRUCTION OF OR DAMAGE TO HIGHWAYS.
Section 160.27 Subdivision S of the Minnesota Statutes relating to the
obstruction of or damage to hghways is hereby adopted by reference and shall
have the same force and effect as though set out at length herein and
wherever the term "Highway" appears therein it shall be deemed for
purpose of this Ordinance to include all public streets within the Village of
Brooklyn Center.
Section 2: This Ordinance shall be effective from and after its
publication,

The Bills having been audited, motion was made W Henry Dorff
and seconded by Howard Heck to order paid the bills set forth in the schedule
attached to these minutes and made a part thereof. Motion carried.
Motion by john Leary and seconded by Phil Cohen to authorize Howe
Inc. and Sipe Oil Company to negotiate with the City of Minneapolis for
sewer service on Xerxes Avenue, Motion carried.
The Council discussed the 1964 budget.
Motion by john Leary and seconded by Howard Heck to adjourn.
The Village Council adjourned at 12:15 A. M. Motion carried..
