Adjournment MINUTES OF THE PROCEEDINGS OF THE HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA SPECIAL SESSION OCTOBER 21, 1985 CITY HALL CALL TO ORDER The Brooklyn Center Housing and Redevelopment Authority met in special session and was called to order by Chairman Dean Nyquist at 9:09 p.m. ROLL CALL Chairman Dean Nyquist, Commissioners Gene Lhotka, Celia Scott, Bill Hawes, and Rich Theis. Also present were HRA Director Gerald Splinter, Director of Public Works Sy Knapp, Director of Planning & Inspection Ron Warren, Finance Director Paul Holmlund, City Attorney Richard Schieffer, Housing Coordinator Brad Hoffman, and Deputy City Clerk Geralyn Barone. APPROVAL OF MINUTES - OCTOBER 7, 1985 There was a motion by Commissioner Scott and seconded by Commissioner Theis to approve the minutes of the October 7, 1985 Brooklyn Center Housing and Redevelopment Authority meeting as submitted. Voting in favor: Chairman Nyquist, Commissioners Scott, Hawes, and Theis. Voting against: none. The motion passed. Commissioner Lhotka abstained from the vote as he was not present at the October 7, 1985 meeting. RESOLUTION The HRA Director introduced a Resolution Awarding Contract for Market Analysis of Earle Brown Farm Property. He stated that feasibility of public and private uses will be included in the study. Commissioner Theis asked if more than just Brooklyn Center will be included in the study, and the HRA Director responded that a large service area surrounding Brooklyn Center will be included. Commissioner Scott asked for further information on Quality Decisions, Inc., and the Housing Coordinator explained that the firm has been around for several years and is a reputable firm. Commissioner Scott requested that a firm that can handle the study be employed because of the large scope of the study. Commissioner Theis also expressed hope that the City employ a company that will be able to handle the project, and the Housing Coordinator and HRA Director conveyed their confidence in the company recommended by the City. RESOLUTION NO. 85 -15 Member Rich Theis introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING THE CHAIRMAN AND EXECUTIVE DIRECTOR TO ENTER INTO AN AGREEMENT WITH QUALITY DECISIONS, INC. TO CONDUCT A MARKET SURVEY RELATING TO THE DEVELOPMENT OF THE EARLE BROWN FARM The motion for the adoption of the foregoing resolution was duly seconded by member Gene Lhotka, and upon vote being taken thereon, the following voted in favor thereof: Dean Nyquist, Gene Lhotka, Celia Scott, Bill Hawes, and Rich Theis; and 10 -21 -85 -1- the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. ADJOURNMENT There was a motion by Commissioner Lhotka and seconded by Commissioner Hawes to adjourn the meeting. Voting in favor: Chairman Nyquist, Commissioners Lhotka, Scott, Hawes, and Theis. Voting against: none. The motion passed unanimously. The Brooklyn Center Housing and Redevelopment Authority adjourned at 9:15 P.M. Chairman i 10 -21 -85 -2- Member introduced the following resolution and moved its adoption: / HRA RESOLUTION NO. RESOLUTION AUTHORIZING CERTAIN TECHNICAL ADJUSTMENTS AND REVISIONS TO EARLE BROWN FARM REDEVELOPMENT PLAN EARLE BROWN FARM TAX INCREMENT DISTRICT PLAN BE IT RESOLVED by the Housing and Redevelopment Authority in and for the City of Brooklyn Center (Authority) as follows: Section 1. Background 1.01. The Authority has approved the Redevelopment Plan and Tax increment Financing Plan for the Earle Brown Farm Redevelopment Project (The Plan) and has recommended to the Brooklyn Center City Council that it conduct public hearings thereon and approve the Plans. 1.02. The City Council did hold such public hearing and did approve The Plan. 1.03. The Plan is contained in a document entitled "Earle Brown Farm Redevelopment Plan and Tax Increment District Plan" dated July 22 if 1985, now on file with the Authority. Section 2. Technical Adjustments and Revisions 2.01. The Authority has been notified by the office of the County Auditor that a certain property described in The Plan by Property Identification Numbers is not contained in the boundary description of the Project Area, to wit: 02- 118 -21 -11 -0002 That upon examination it has been determined that such parcel is not located within the district boundaries; and that reference to such parcel should be removed from The - Plan. 2.02. The Authority has been notified by the office of the County Auditor that certain properties which should be f included within the boundary of The Plan were not in the listing of Property Identification Numbers contained in The Plan;, to wit: 35- 119 -21 -43 -0008 44- 119 -21 -44 -0006 That upon examination it has been determined, that such parcels are located within the district boundaries; and that reference to such parcels should be added. HRA RESOLUTION NO. 2.03. The Redevelopment Plan includes as a stated objective to make land available within the Earle Brown site for use as high density residential development. Such statement, however, should not be interpreted to preclude the use of such lands for an appropriately structured commercial development such as office buildings. Section 3. Approval and Referral 3.01. The Authority hereby approves a revision of The Plan by deleting from pages 1 and 10 thereof, the references to Property Identification Number 02- 118 -21 -11 -0002. 3.02. The Authority hereby approves a revision of The Plan by adding to pages 1 and 10 a reference to Property Identification Numbers 35- 119 -21 -43 -0008 and 44- 119- 21 -44- 0006. 3.03. The Authority hereby qualifies all references in The Plan to making land within the Earle Brown Farm site available for high density residential development with the further proviso that appropriate commercial uses of such site should also be considered. 3.04. The Executive Director of the Authority is instructed to provide a certified copy of this resolution to the City Council with a request that it, by resolution, take similar action. Splinter, City Manager FROM: Brad Hoffman, Administrative Assistant �► f} DATE: October 30, 1985 SUBJECT Tax Increment Amendment The resolution that will be before the HRA and the City Council makes two (2) changes in the plan, both of which are house keeping in nature. Because there is no significant change in the 'plan, a public hearing is not required. First, prior to issuing our bonds, it is necessary that the current zoning be correct The plan contemplates residential development which will require a future rezoning. The amendment lAould allow for office or residential thus the current zoning is correct and we can issue the bonds for the project. Second, the meets and bounds description of the district is correct and estab- lishes the boundary for the district. However, PID number 02 118 - 21 - 11 - 0002 is listed as being in the district and it is not therefore it needs to be eliminated. PID numbers 35- 119 -21 -43 -0008 and 35- 119 -21 -44 -0006 are not listed but should be because they are in the district. The resolution will correct these items The district as certified to Hennepin County, reflects these changes: Member introduced the following resolution and moved its adoption: ` HRA RESOLUTION NO. RESOLUTION ACCEPTING THE QUOTATION OF M.J. MOSER CONSTRUCTION COMPANY TO ROOF TWO (2) OF THE HOUSES ON THE EARLE BROWN FARM WHEREAS; the condition of the roofs on two (2) of the housing units of the Earle Brown Farm are in serious and immediate need of repair in order to prevent additional damages to the homes; and WHEREAS, the Housing and Redevelopment Authority has received quotations from the following: M.J. Moser Construction $8,920 LeRoy H. Erickson $8,725 NOW, THEREFORE, be approved by the Housing and Redevelopment Authority in and for the City of Brooklyn Center that the quotation of M.J. RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE HOUSING AND REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF BROOKLYN CENTER AND WESTWOOD PLANNING AND ENGINEERING COMPANY FOR PLANNING AND DESIGNING A STREETSCAPE PLAN FOR THE EARLE BROWN FARM TAX INCREMENT DISTRICT WHEREAS, the Brooklyn Center HRA has adopted a Tax Increment Plan for the restoration of the Earle Brown Farm; and WHEREAS, the adopted plan calls for a streetscape plan throughout the district; and WHEREAS, a formal plan must be developed and accepted. Streetscape Planning Dear Mr. Splinter: In response to your inquiry with regard to Westwood Planning &'Engineering Company providing Professional Services to the City of Brooklyn` Center for the proposed streetscape nodes site planning in the Earl Brown Farm Tax Increment District, we present the following: PLANNING AND ENGINEERING SERVICES We propose to provide the following services at the listed estimated prices: - Collect base maps, review previous concept plans $ 500.00 and examine existing node sites - Meet with developers on proposed project within - hourly as incurred project area - Prepare preliminary site plan for each node - hourly as incurred (5 nodes and 3 private entries) - Materials selection for improvements $ 1,000.00 (Specific materials or fixture selection) - Coordinate semaphore hardware locations $ 750.00 within nodes (box, controls, conduits, etc.) Develop preliminary lighting plan $ 1,500.00 - Provide preliminary landscape plan $ 1,500.00 - Advise on easements and developer proposals hourly as incurred Provide construction estimate for public improvements $ 500.00 7415 WAYZATA BOULEVARD, MINNEAPOLIS, MINNESOTA 55426 (612) 5460155 October 21, 1985 Jerry Splinter Page 2 All fees shall be billed as incurred based on the attached fee schedule. Prices stated above are estimates.. The total services are estimated at having a cost of approximately $8,000.00. The City should anticipate additional services to prepare the construction documents for bidding. Once the initial design /planning phase is complete a second proposal shall be issued for construction, design of lighting, paving, planting, sodding and retaining walls. The extent of this service can be more accurately defined at the time the construction estimate is reviewed and approved by the City (since revisions may be needed to meet budget or development goals). All work will be billed monthly, based on the pro -rata amount of work performed during the previous month. All invoices are due and payable thirty days from date of invoice. All invoices outstanding sixty days or more from date of invoice will be charged a finance (interest) charge at the rate of 1.25 percent per month. Any additional reports, studies or other work ordered by the Owner shall be performed on a per diem basis in accordance with the attached fee schedule. MATERIALS DOCUMENTS AND SERVICES PROVIDED BY OWNER The Owner shall provide the Consultant with the following: - Plat map or-Boundary survey of project area. - Plan for streets, curbs, sidewalks, etc. in public R.O.W. - Copies of developer plans in project area. - Copies of current engineering plans for proposed improvements in project area. TERMINATION OF AGREEMENT This agreement may be terminated by either party upon fourteen days written notice to the other party. In the event of such termination, Westwood shall be paid compensation for services performed to the termination date. Upon - payment, any and all obligations and liabilities of the parties hereto shall terminate. ARBITRATION All claims, disputes and other matters in question arising out of, or relating to, this Agreement or the breach thereof shall be decided by arbitration in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association then obtaining unless the parties October 21, 1985 Jerry Splinter Page 3 mutually agree otherwise. This agreement to arbitrate shall be specifically enforceable under the prevailing arbitration law. Notice of the demand for arbitration shall be filed in writing with the other party to this agreement and with the American Arbitration Association. The demand shall be made within a reasonable time after the claim, dispute or other matter in question has arisen. In no event, shall the demand for arbitration be made after the date when institution of legal or equitable proceedings based on such.c aim 1 dispute or other matter in question would be barred b the applicable pplicable statute of limitations. The award rendered by the arbitrators shall be final and judgement may be entered upon it in accordance with applicable law in any court having jurisdiction thereof. EXTENT OF AGREEMENT This Agreement represents the entire and integrated Agreement between the Owner and the Consultant and supersedes all prior negotiations, repre- sentations or agreements, either written or oral. This Agreement may be amended only by written instrument signed by both the Owner and Consultant. It is mutually agreed that this Agreement dated October 21, 1985 shall be extended to include the work herein described through December 31, 1986. • GOVERNING LAW This Agreement shall be governed by the laws of the State of Minnesota.
