HomeMy WebLinkAbout1963 11-12 CCM Regular Session -257 Minutes of the Proceedings of the Villag e Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota November 12, 1963 The Village Council met in Regular Session and was called to order by Mayor Gordon Erickson at 7 :35 P. M. Roll Call: Mayor Gordon Erickson, Henry Dorff, Phil Cohen, Howard Heck and john Leary were present. Motion by Phil Cohen and seconded by john Leary to approve the minutes of the meeting of November 4, 1963 as recorded. Motion carried unanimously. Motion by john Leary and seconded by Phil Cohen to approve the minutes of a Special Meeting of the Village Council on November 5, 1963 as recorded after inserting the adjournment time of 10 :05 P. M. Motion carried unanimously. Member john Leary introduced the following resolution and moved its adoption: RESOLUTION REGARDING SPECIAL ASSESSIV ENTS ON IAND SUBSEQUENTLY DIVIDED OR SUIDED WHEREAS, Section 429.071 of the Minnesota Statutes provides as follows: "When a tract of Land against which a special assessment has been levied is thereafter divided or subdivided by plat or otherwise, the council may, on application of the owner or any part of the tract or on its own motion equitably apportion among the various lots or parcels in the tract an the installments of the assessment against the tract remaining unpaid and not then due, and WHEREAS, The Village Council has occasion frequently to reapportion special assessments; and WHEREAS, the Council believes that the assessment methods adopted by the Village are equitable; NOW, THEREFORE, BE IT RESOLVED, That the Village Council of the Village of Brooklyn Center directs the Village Engineer to re- apportion special assessments against divided or subdivided property within the Village by applying the same assessment method which was used to make the original assessment against that property. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff, john Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by john Leary and seconded by Henry Dorff that a first read be given to an ordinance setting the speed limits on alleys in Brooklyn Center and that the second reading be scheduled for November 25, 1963. Motion carried unanimously. -1- 255 Motion by john Leary and seconded by Howard Heck to authorize the purchase of a thermofax copier from Thermofax Sales Inc. at a cost of $199.00. The funds to be expended from the capitaloutlay account of the clerks office. Motion carried unanimously. Motion by Howard Heck and seconded by Phil Cohen to uphold the action of the Planning Commission and deny the Special Use Permit application of Murray C. Peterson to allow a two family dwelling in an R -1 district because it is not a permitted use under Village Ordinance Section 35 -310 and further that the tenant be given notice to vacate by January 1, 1964. Motion carried unanimously. Motion by Henry Dorff and seconded by Phil Cohen to table action on application #63075 submitted by Richard H. Fudali so that further study can be made of the traffic problems created by the construction of additional multiple dwelling units in the neighborhood in which the property is located, and to further study the impairment of property values of adjacent property. Motion carried unanimously. Motion by Phil Cohen and seconded by Howard Heck to uphold the action of the Planning Commission and approve application #73079 submitted by R. R. McChesney & Sons for a preliminary plat approval. Motion carried unanimously. Motion by john Leary and seconded by Phil Cohen to approve the following licenses: Electrical License Globe Electric Company 5720 Excelsior Blvd. Motion carried unanimously. The Village Council discussed with the Government Study Committee their report which had been submitted to the Village Council on November 4, 1963. It was determined to place the matter on the agenda of the Council meeting for November 25, 1963 for further discussion. The bills having been audited, motion was made by Henry Dorff and seconded by Howard Heck to order paid the bills set forth in the schedule attached to these minutes and made a part thereof. Motion carried unanimously, Motion by Henry Dorff and seconded by Phil Cohen that the Council determines that a one way wedged snow plow is no longer needed for Village purposes and to authorize the sale of the snow plow to the Village of St. Anthony for $100. Motion carried unanimously. Motion by Howard Heck and seconded by Henry Dorff to adjourn. The Village Council adjourned at 12 :05 A. M. Motion carried unanimously. Mayor 2 rk -2-
