HomeMy WebLinkAbout1963 12-09 CCM Regular Session Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center In the County of Hennepin and State of Minnesota December 9, 1963 The Village Council met in Regular Session and was called to order by Mayor Gordon Erickson at 7 :35 P. M. Roll Call: Mayor Gordon Erickson, Phil Cohen and Henry D Members john Leary and Howard Heck were absent. The invocation was given by Rev. Ernest Vick. Motion by Phil Cohen and seconded by Henry Dorff to approve the minutes of the Council meeting of December 2, 1963 as recorded. Motion carried unanimously. Member Howard Heck arrived at the meeting at 7 :40 P. M. Member john Leary arrived at the meeting at 7 :45 P. M. Motion by Phil Cohen and seconded by john Leary to uphold the action of the Planning Commission Richard Sybrant and a and approve application #630$1 submitted, by approve the plot plan to construct a 4 unit apartment building on Lot 12, Block 7, Lakebreeze Addition and to grant a variance on a side yard set back on a corner lot of 18.29' instead of 25 Motion carried unanimously. Motion by Howard Heck and seconded by Phil Cohen to table action on application #63089 submitted by Tri -State Land Company pending further Investigation by Tri State Land Company. Motion carried unanimously. Motion by Phil Cohen and seconded by John Leary to uphold the action of the Planning Commission and approve application #63084 submitted by Dallas Lawrence and grant permission to divide Lot 1, Block 2, Lawrence Addition into two lots as set forth in the petition. Motion carried unanimously. Motion by john Leary and seconded by Howard Heck to uphold the action of the Planning Commission and approve application #63085 submitted by Dale Sizer and grant permission to construct a garage and family room addition with a side yard set back.. on a corner .lot of 19 feet instead of 25 feet. Motion carried unanimously. Motion by Henry Dorff and seconded by Phil Cohen to uphold the action of the Planning Commission and deny the request of U. C. Knutson submitted In application #63088 to create a lot 25 feet in width but permit the petitioner to divide his property and transfer title to that part of Lot 2 Auditiors Subdivision #310 lying East of Willow Lane in a single undivided parcel. Motion carried unanimously. Motion by Howard Heck and seconded by john Leary to uphold the action of the Planning Commission and approve application #63076 submitted by Paul H+almlund and grant permission to construct a 22" x 22' attached gars e with a side yard set back of 17 feet. Motion carried unanimously. 9 Motion by Henry Dorff and seconded by Phil Cohen to uphold the action of the Planning Commission and grant application #63083 submitted by Mpls. Star Tribune for a Special Use Permit to locate and maintain a 12' x 16' metal building on Shoppers City property and use it as a distribution branch for newspapers. Motion carried unanimously. Motion by Phil Cohen and seconded by Howard Heck to table application #63087 submitted by R. C. Ernst for the approval of a preliminary plat of "Richlands Peninsula Park" and instruct the administrator to contact the Park Board to receive their recommendation concerning the acquisition of the Property for park purposes. Motion carried unanimously. -1- 09 Motion by Howard Heck and seconded by Phil Cohen to approve appl- ication #63082 submitted by Russell Smith and grant a variance on building setback on the East and North sides of the property and to grant a variance on the parking plan to provide 13 spaces instead of 27 spaces. Motion carried unanimously. Motion by John Leary and seconded by Howard Heck to uphold the action of the Planning Commission and approve application #63091 submitted by James Bowman and grant permission to divide a 150' x 135' lot to create two lots each 75' 135'. Motion carried unanimously. Motion by Phil Cohen and seconded by Henry Dorff to uphold the action of the Planning Commission and approve application #63090 submitted by Miag North America and grant permission to construct a 56' x 60' addition to the existing warehouse located at 3515 - 48th Avenue North. Motion carried unanimously. Motion by Howard Heck and seconded by Phil Cohen that the Village Council determines that the cost of the construction of the sanitary sewer lateral for the proposed Greenlawn Addition may be assessed for a period of 20 years providing that the developer posts a $1600.00 bond or cash escrow to guarantee the engineering cost for plans and specifications to supply information for public hearings, and that after public hearings have been held and if the public hearings are declared favorable that the developer will post a bond. or cash escrow for the total amount of improvements in Greenlawn addition exclusiv( of the cost of sanitary sewer lateral (water improvement, street improvement, storm sewer improvement). Motion carried unanimously. Motion by Howard Heck and seconded by Henry Dorff to authorize the dumping of fl as P 9 Y h from Northern States Power Company in the Lions .Park providing the contractor dumping the material covers it immediately. Motion carried unanimously. Motion by Henry Dorff and seconded by John Leary to authorize the Park Board o rd to expend monies from the 1964 Park Capital Improvements Budget to furnish cover material for Fly Ash to be dumped in Lions Park. Motion carried unanimously. Motion by John Leary and seconded by Phil Cohen to offer the lot, owned by the Village, at 5347 Osseo Road for sale by advertising it for sale and receiving sealed bids, with the condition that the Village Council can reject any or all bids and further to employ an apraiser to apdaise the property f6r the council's guidance in evaluating the bids. Voting for the motion; Members Phil Cohen, John Leary, Henry Dorff and Gordon Erickson. Voting against the motion, Member Howard Heck. Motion carried. The bills having been audited motion was made by Henry Dorff and seconded by Howard Heck to order paid the bills set forth in the schedule attached in these minutes and made a part thereof. Motion carried unanimously. Motion by John Leary and seconded by Henry Dorff to authorize the taking f bids for one -2 1 2 9 / truck with dump box on January 6, 1963 at 2.00 P. M. Motion carried unanimously. Member Phil Cohen announced the appointment of Authur Gustafson, 4935 Abbott Avenue North to the Industrial Commission for a term to expire April 1, 1964, Member John Leary announced the , appointment of Wilbert Hanson, 6324 Orchard Avenue to the Industrial Commission for a term to expire April 1, 1965. Member John Leary introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING AND DIRECTING APPEAL TO DISTRICT COURT IN THE MATTER OF GENERAL HOSPITAL BUDGET AND TAX LEVY FOR 1964 WHEREAS pursuant to the Minnesota Laws of 1963, Chapter 738, several villages and other towns and municipalities in Hennepin County requested the Board of Commissioners of Hennepin County to conduct a hearing to review the determination previously made by it in the 1964 Budget for General Hospital, and WHEREAS, such hearing was duly held on November 18, 1963, and WHEREAS, on November 26, 1963, the Board of Commissioners of Hennepin County adopted a resolution taking final action on the 1964 Budget for General Hospital, thereby making a determination of the issues raised at such hearing, and WHEREAS, it appears necessary and desirable for the Village of Brooklyn Center to intervene in the appeal to the District Court from such final resolution, NOW, THEREFORE, BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center as follows: 1. It is hereby determined to appeal or intervene in the appeal from the final resolution of the Board of Commissioners of Hennepin County passed November 26, 1963 relating to the Budget of General Hospital. 2. Such intervention and appeal shall be made pursuant to Minnesota Laws of 1963, Chapter 738, on the grounds that the Budget approved in such final resolution was not prepared, items of expense were not allocated, and tax levies to be made pursuant thereto were not determined,, in acco with applicable law. 3. Clayton L. LeFevre is hereby designated to act as attorney for the Village in the presentation of such appeal. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the fallowing, voted in favor thereof: Gordon Erickson, Howard Heck, Henry Dorff, John Leary and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted.
