Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
March 2, 1964
The Village Council met in Special Session and was called to order
by Mayor Gordon Erickson at 7 :30 P. M.
Roll Call: Mayor Gordon Erickson, Phil Cohen. Henry Dorff, John
Leary and Howard Heck were present.
Motion by Howard Heck and seconded by Phil Cohen to approve
the minutes of February 24, 1964. Voting for the motion Gordon Erickson,
John Leary, Phil Cohen and Howard Heck. Henry Dorff abstained from
voting since he was absent for a portion of the meeting.
Motion by Henry Dorff and seconded by John Leary to uphold the
action of the Planning Commission and approve application #64012 submitted
by R. C. Ernst regarding approval of the preliminary plat of Twin Lake Oaks
Addition on the following conditions:
Proposed Lots 1 and 2 shall be combined into one lot and the
balance of the lots renumbered.
The following variances are approved:
1. 30' wide street right -of -way Instead of 50' because the street
is designed to serve only the north side of the street.
2. Variance to the lot area requirement is given on Lots 2, 5, and
6 .
3. 25' front yard setback on Lots 3, 4, and 5. 30' front yard
setback on Lot 6.
4. 25' front property line width on Lots 10 and 11 instead of 75'.
5. 100' diameter cul -de -sac instead of 120'.
It is further required that;
1. Certified test borings to indicate sub soil condition be
submitted to the Building Inspector when applying for
Building Permits.
2. Basement floor elevations must be constructed no lower than
elevation 855.5.
3. Sanitary sewer shall be installed before Building Permits will
be issued.
Motion carried unanimously.
Member Phil Cohen introduced the following resolution and moved
its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING FOR THE
VACATION OF A PORTION OF 57TH AVE.
WHEREAS, the Village Council of Brooklyn Center, Minnesota has
received a petition, signed by a majority of the owners of property abutting
on 57th Avenue North between the East right -of -way line of State Highway
152 and the West right -of -way line of Xerxes Avenue North and between the
East right -of -way line of Xerxes Avenue North and the West right -of -way
line of Trunk Highway #100, requesting the vacation of said portion of
57th Avenue,

BE IT THEREFORE RESOLVED, that a public hearing shall be held at
the Village Hall of the Village of Brooklyn Center, Minnesota on Monday the
23rd day of March, 1964 at 8 :00 P. M. to hear objections, if any, to the
vacation of the above described street, and the Clerk shall publish and
post notice of the time and place of the hearing by two weeks' publication
in the official newspaper of the Village.
The motion for the adoption of the foregoing: resolution was duly seconded by
member Howard Heck, and upon vote being taken thereon the following voted
in favor thereof: Gordon Erickson, Howard Heck, Henry Dorff, Phil Cohen
and John Leary and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
The Village Council discussed the proposal to acquire park property
on Upper Twin Lake. Approximately 70 people were present to discuss this
matter with the Council. It was determined to study this matter further before
reaching a decision.
Motion by John Leary and seconded by Howard Heck to approve the
appointment of R.E. Ecklund as Assistant Director of Parks and Recreation
at an annual salary of $5900, to begin March 11, 1964. Motion carried
unanimously.
Motion by Howard Heck and seconded by Henry Dorff to employ
Charlotte Roe as "Teen Charm Class 'Instructor" at a wage of $15 per
session. Motion carried unanimously.
Motion by Henry Dorff and seconded by Phil Cohen to employ
James Bergstrom as a part time liquor store clerk at a wage of $1.50 per
hour. Motion carried unanimously.
Motion by John Leary and seconded by Howard Heck to employ
Gearid Paulson as a temporary Rodman at a wage of $2.10 per hour
effective March 2, 1964. Motion carried unanimously.
Motion by Henry Dorff and seconded by Howard Heck to approve
the appointment of Vivian 'V thite as switchboard operator as a temporary
replacement for Mrs, Anderson. Motion carried unanimously.
Member Howard Heck introduced the following resolution and moved
its adoption:
A RESOLUTION REQUESTING A SPECIAL CENSUS FOR
BROOKLYN CENTER IN 1965
WHEREAS, the Legislature of the State of Minnesota did in 1963
authorize those municipalities eligible for a distribution of state liquor
and cigarette tax revenues to request a special census in the year 1965
and every ten years thereafter for the purpose of determining an interim
population figure for use in the distribution of said revenues, and
WHEREAS, the Village of Brooklyn Center has in the past few years
experienced a vast increase in population '. indicated by the 1960 Census,
but since that time unmeasured.., and
WHEREAS, the Director of the reau of the Census has estimated
that such a census, based on currentiagtimates of Village population, would
cost approximately $5,,640, of which SR.' -20 is to be paid directly to said
Bureau with the request for a census, -and
WHEREAS, it is expected that the Village will realize a significant
Increase in revenues over and above the cost of such a census, in addition
to the benefit to be accrued from the resultant data for current planning, and
M the Village Council thus belleves such a census to be in
the best interest of the Village,

NOW, THEREFORE BE IT RESOLVED that the Village Council authorize
and direct the Mayor and Clerk to request a special census of :the, ViIjage,
to be taken in the year 1965, and to enter into the necessary contraots on
behalf of the Village, and
BE IT FURTHER RESOLVED that the sum of $2,220 be agp ed
from the Contingency Fund to pay the initial costs of the census.
The motion for the adoption of the foregoing resolution was duly seconded by
member Henry Dorff, and upon vote being taken thereon the following voted
in favor thereof; Cordon Erickson, Henry Dorff, john Leary, Howard Heck
and Phil Cohen and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Motion by Phil Cohen and seconded by Howard Heck to determine that
Brooklyn Center shall participate in the Municipal Personnel Survey proposed by
Stanton & Associates and to authorize the expenditure of $400 for this purpose
from the contingency fund. Motion carried unanimously.
Member john Leary introduced the following resolution and moved its
adoption:
RESOLUTION CANCELLING SPECIAL ASSESSMENTS ON STATE
HIGHWAY RIGHT -OF -WAY
WHEREAS, it has been determined that the special assessments for
storm sewer improvements levied on certain state highway right -of -way
have not been paid since 1959; and
WHEREAS, the state highway department has stated that the special
assessments on right -of -way will not be paid in the future; and
WHEREAS, an analysis of the 1958 A Bond Fund has shown that sufficient
surplus exists to absorb the cancellation of said special assessments, and
WHEREAS, the removal of said special assessments from the rolls of
the county and village will facilitate accounting accuracy. -
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center to cancel from the Hennepin County tax rolls all
special assessments for Storm Sewer 1958 A together with all interest and
penalties on the aforementioned right -of -way, and
BE IT FURTHER RESOLVED that the County Auditor is authorized and
directed to cancel the amounts of the storm sewer special assessments Levy
2133 including penalties, on the following properties in the amounts shown:

The motion for the adoption of the foregoing resolution was duly secawderdr by
member Phil Cohen, and upon vote being taken thereon the following vaho

Member Henry Dorff introduced the following resolution and moved
its adoption:
RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR WATER
TRUNK SYSTEM IMPROVEMENT NO. 1964 -1 SANITARY SEWZR
IMPROVEMENT NO. 1964 -3 STORM SEINER IMPROVEMENT
NO. 1964 -4 PUBLIC UTILITIES SERVICE EXTENSIONS -
IMPROVEMENT NO. 1964 -5 AND DIRECTING ADVERTISEMENT
FOR BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn Center,
Minnesota, as follows;
1. The plans and specifications for the following improvements yzapared,
by the Village Engineer, are hereby approved and ordered filed with the Clerk:
'Water Trunk System Improvement No. 1964 -1, Sanitary Sewer Improvement No.
1964 -3, Storm Sewer Improvement No. 1964 -4, Public Utilities Service
Extensions No. 1964 -5.
2. The Clerk shall advertise for bids for such improvements by
publication at least once in the official newspaper and in the Construction
Bulletin, the day of first publication not less than three weeks prior to the
date of receipt of bids. Said notice shall state that no bids will be considered
unless sealed and filed and accompanied by a cash deposit, bid bond,
cashiers check or certified f check payable to the Clerk in the amount of not
ch .
less than five (5) per cent of the bid.
3. Bid date is set for March 27, 1964, at 11 :00 A.M.
4. The Village Administrator and Village Engineer shall be authorized
to open and tabulate the bids.
The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck, and upon vote being taken thereon, the following voted

and Phil Cohen and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.

Member Howard Heck introduced the following resolution and moved
its adoption:
RESOLUTION REQUESTING RECONSIDERATION OF TRAFFIC
CONTROL SIGNALS AT TRUNK HIGMPTAY NO. 152 AND
COUNTY ROAD NO. 130 (69TH AVENUE NORTH)
WHEREAS, the Brooklyn Center Village Council has been requested
to approve Agreement No. 53996 which proposes cost apportionments for
certain traffic control signals on Trunk Highway No. 152, and
WHEREAS, said Agreement No. 53996 does not contain provisions
for the immediate installation of traffic control signals on Trunk Highway
No. 152 at County Road No. 130 (69th Avenue North), and
WHEREAS, County Road No. 130 (69th Avenue Norte) is one of only
two streets transversing the Village in an east -west direction, and
WHEREAS, intense and dangerous traffic congestion frequently occurs
at the intersection of Trunk Highway No. 152 and County Road No. 130
(69th Avenue North) to the extent that manual traffic direction must be furnished
by the municipal Police Department, and
WHEREAS, in January, 1963, the Hennepin County Highway Department
and the Minnesota Highway Department cooperated, at the request of the
Village Engineer, in a joint traffic study of the subject intersection for
the purpose of determining traffic signal warrants, and
WHEREAS, the data derived from said joint study was compared to
traffic warrants for pretimed signals only, and not to traffic warrants for
the traffic - accuated signals, and
WHEREAS, it was determined in May of 1963, that traffic conditions
at the subject intersection did not meet the warrants for pretimed signals,
and
WHEREAS, correspondence to the Village Engineer from the Hennepin
County Highway Department and the Minnesota Highway Department strongly
implied and suggested that concern for traffic activity at the subject intersection
should be relieved through signal installation at the time that construction
commenced on the Trunk Highway No. 152 improvement, and
WHEREAS, the Village Council and the citizenry of Brooklyn Center
are extremely concerned that traffic control signals be installed at the subject
Intersection coincident with improvement of Trunk Highway No. 152,
NOW, THEREFORE, BE IT RESOLVED, by the Village Council of the
Village of Brooklyn Center to postpone approval of Agreement No. 53996,
and to urgently request the Minnesota Highway Department and the Hennepin
County Highway Department to reconsider the installation of traffic control
signals at the intersection of Trunk Highway No. 152 and County Road No. 13`0
(69th Avenue North) during the improvement of Trunk Highway No. 152. Be it
resolved to request reconsideration according to Section #3E -3 of the MANUAL
ON UNIFORM TRAFFIC CONTROL DEVICES FOR STREETS AND HIGHWAYS OF THE
STATE OF MINNF SOTA.
The motion for the adoption of the foregoing .resolution was duly seconded by
member Phil Cohen and upon vote being taken thereon, the following voted in
favor thereof: Gordon Erickson, Henry Dorff, Phil Cohen, Howard Heck and
John Leary and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
The Village Council gave the first reading to an Ordinance amending
Section 23 -503, 23 -504, 23-505 23 -507 and 23 -508 of the Village Ordinances
regarding the licensing of bicycles and directed that it be placed on the agenda

Motion by Howard Heck and seconded by Henry Dorff to adjourn.
Motion carried unanimously. The Village Council adjourned at 12;50 A. IM.
